2000 A BILL FOR An Act to amend certain local government legislation, and for other purposes

 


 

s1 10 s3 Local Government and Other Legislation Amendment The Parliament of Queensland enacts-- 1 ART 1--PRELIMINARY 2 P title 3 Short Clause 1. This Act may be cited as the Local Government and Other Legislation 4 Amendment Act 2000. 5 6 Commencement Clause 2.(1) Sections 19, 24, 25, 45, 71, 76, 77, 79 and 81 are taken to have 7 commenced on 30 March 1998. 8 (2) Sections 63 to 66, 74 and 84(3) commence on 31 March 2000. 9 (3) Sections 28, 31(2), 32, 36, 40, 46, 53 and 67 commence on 10 1 July 2000. 11 (4) Sections 22, 61 and 84(2) and part 10 commence on a day to be fixed 12 by proclamation. 13 (5) The remaining provisions commence on assent. 14 ART 2--AMENDMENT OF LOCAL GOVERNMENT 15 P ACT 1993 16 amended in pt 2 17 Act Clause 3. This part amends the Local Government Act 1993. 18

 


 

s4 11 s6 Local Government and Other Legislation Amendment of s 771 (Meaning of relevant business activity) 1 Omission Clause 4. Section 771-- 2 omit. 3 of s 772 (Definitions for ch 10) 4 Amendment Clause 5. Section 772-- 5 insert-- 6 ` "access component", of a two-part tariff, means the component fixed for 7 access to water services, independently of the quantity of water 8 supplied. 9 "consumption component", of a two-part tariff, means the component 10 based on the quantity of water supplied. 11 "cost effective", for a two-part tariff for a relevant business activity, means 12 application of the tariff is likely to result in savings in costs to the 13 business activity for supplying water, including capital costs. 14 "relevant business activity" means-- 15 (a) a significant business activity providing water or sewerage 16 services; or 17 (b) an activity of a corporatised corporation providing water or 18 sewerage services that was a significant business activity.'. 19 of new s 772A 20 Insertion Clause 6. Chapter 10, part 2, after section 772-- 21 insert-- 22 as the basis for utility charges for water services 23 `Consumption `772A.(1) For this chapter, consumption is the basis for utility charges 24 for water services if a two-part tariff is applied.1 25 1 See section 783(b) (Local governments to implement charging and operational arrangements for relevant business activities).

 


 

s7 12 s9 Local Government and Other Legislation Amendment `(2) Subsection (1) does not limit the ways in which consumption may 1 be the basis for utility charges for water services.'. 2 of new s 783A 3 Insertion Clause 7. After section 783-- 4 insert-- 5 resolution under s 780 to apply two-part tariff 6 `Implementing `783A. A resolution under section 780 to apply a two-part tariff for a 7 relevant business activity must be implemented by making and levying a 8 utility charge under chapter 142 or the City of Brisbane Act 1924, part 3.3 '. 9 of new s 973A 10 Insertion Clause 8. After section 973-- 11 insert-- 12 of particular utility charges 13 `Validity `973A.(1) This section applies to a local government to which 14 chapter 104 applies. 15 `(2) A utility charge made and levied by the local government for 16 supplying water or sewerage services is not invalid merely because the local 17 government did not comply with chapter 10.'. 18 of new ch 19, pts 4 and 5 19 Insertion Clause 9. s9 13 s9 Local Government and Other Legislation Amendment ART 4--VALIDATION PROVISION FOR LOCAL 1 `P GOVERNMENT AND OTHER LEGISLATION 2 AMENDMENT ACT 1999 3 for particular rates 4 `Validation `1242. It is declared that a rate levied by a rate notice given by a local 5 government for, or for a period of, the financial year ending 30 June 2000 is 6 not, and never was, invalidly levied merely because the local government-- 7 (a) did not state on the rate notice, as required by section 1008(2)(b),5 8 the date by which, or the time within which, the rate must be paid 9 under section 1014(2)(a) 6 if the rate notice complied with 10 sections 1008(2) and 1014(1) as in force immediately before their 11 amendment by the Local Government and Other Legislation 12 Amendment Act 1999; or 13 (b) did not decide, under section 1014, the date by which, or the time 14 within which, the rate must be paid. 15 ART 5--VALIDATION PROVISION FOR LOCAL 16 `P GOVERNMENT AND OTHER LEGISLATION 17 AMENDMENT ACT 2000 18 to Brisbane City Council 19 `Application `1243.
