1999 A BILL FOR An Act to amend certain local government legislation, and for other purposes

 


 

s1 10 s3 Local Government and Other Legislation Amendment The Parliament of Queensland enacts-- 1 ART 1--PRELIMINARY 2 P title 3 Short Clause 1. This Act may be cited as the Local Government and Other Legislation 4 Amendment Act 1999. 5 6 Commencement Clause 2.(1) Sections 13, 17 and 78 commence on 1 July 1999. 7 (2) The following provisions commence on 1 January 2000-- 8 · part 5, division 4 9 · schedule 2, part 2 10 · schedule 3, part 2. 11 (3) Sections 14 and 79 commence on 1 July 2000. 12 (4) The remaining provisions commence on assent. 13 PART 2--AMENDMENTS OF CITY OF BRISBANE 14 ACT 1924 15 Division 1--Preliminary 16 amended in pt 2 and sch 1 17 Act Clause 3. This part and schedule 1 amend the City of Brisbane Act 1924. 18

 


 

s4 11 s6 Local Government and Other Legislation Amendment Division 2--Amendments of City of Brisbane Act 1924 about elections 1 of s 3 (Interpretation) 2 Amendment Clause 4. Section 3(1)-- 3 insert-- 4 ` "electoral commission" means the Electoral Commission of 5 Queensland.'. 6 of s 16 (Triennial elections) 7 Amendment Clause 5. Section 16(3) and (4)-- 8 omit. 9 of new s 16A 10 Insertion Clause 6. After section 16-- 11 insert-- 12 officers for elections 13 `Returning `16A.(1) This section applies to-- 14 (a) a triennial election of the mayor and other councillors; or 15 (b) a separate election to fill a vacancy in the office of mayor; or 16 (c) a separate election by the electors of an electoral ward to fill a 17 vacancy in the office of councillor for the ward. 18 `(2) However, this section does not apply to the conduct of an election 19 under section 17A. 20 `(3) The town clerk is the chief returning officer for the election. 21 `(4) Also, for an election mentioned in subsection (1)(a) or (c), the town 22 clerk must, by signed writing, appoint a returning officer for each electoral 23 ward or the relevant electoral ward. 24 `(5) However, a person who is not a returning officer for an electoral 25 district comprised completely or partly within the city is not eligible for 26

 


 

s7 12 s9 Local Government and Other Legislation Amendment appointment as returning officer without the written permission of the 1 Minister.'. 2 of s 17 (Provisions concerning elections) 3 Amendment Clause 7. Section 17(4), after `officer'-- 4 insert-- 5 `or, if under section 17A the electoral commission conducts the election, 6 the commission,'. 7 of new s 17A 8 Insertion Clause 8. After section 17-- 9 insert-- 10 of elections by electoral commission 11 `Conduct `17A.(1) The council may enter into an agreement with the electoral 12 commission for the conduct of an election by the commission. 13 `(2) However, the council may enter into the agreement only after it 14 passes a resolution authorising it to enter into the agreement. 15 `(3) The conduct of the election under this section is a function of the 16 commission.'. 17 Division 3--Amendments of City of Brisbane Act 1924 about rates 18 of s 3 (Interpretation) 19 Amendment Clause 9. Section 3(1)-- 20 insert-- 21 ` "budget meeting", of the council, means a meeting of the council at 22 which it adopts its budget for a financial year. 23 "discount date", for a rate, means a date, decided by the council, by which 24 the rate must be paid for a discount to be allowed. 25

 


 

s 10 13 s 12 Local Government and Other Legislation Amendment "discount period", for a rate, means the period of time, decided by the 1 council, during which the rate must be paid for a discount to be 2 allowed.'. 3 of s 51 (Meaning of "separate rate or charge") 4 Replacement Clause 10. Section 51-- 5 omit, insert-- 6 of "separate rate or charge" 7 `Meaning `51. A "separate rate or charge" is a rate or charge made and levied on 8 all or any rateable land for a service, facility or activity whether or not the 9 service, facility or activity is supplied, or proposed to be supplied, by the 10 council itself.'. 11 of s 56 (Minimum general rate levies) 12 Amendment Clause 11. Section 56-- 13 insert-- 14 `(3) The council must not make and levy a minimum general rate levy 15 for a parcel of land if-- 16 (a) the Valuation of Land Act 1944, section 25,1 applies to the parcel; 17 and 18 (b) under that section, the parcel's discounted valuation period has not 19 ended.'. 20 of s 57 (Separate rates and charges) 21 Amendment Clause 12. s 75 43 s 76 Local Government and Other Legislation Amendment ` "discount date", for a rate, means a date, decided by the local 1 government, by which the rate must be paid for a discount to be 2 allowed. 3 "discount period" , for a rate, means a period of time, decided by the local 4 government, during which the rate must be paid for a discount to be 5 allowed. 6 "overdue rate" for-- 7 (a) Brisbane City Council--means the unpaid amount of a rate under 8 the City of Brisbane Act 1924, section 67(1); or 9 (b) another local government--see section 1016.'. 10 of s 967 (Minimum general rate levy) 11 Amendment Clause 75. s 76 44 s 76 Local Government and Other Legislation Amendment (ii) the occupier of the land, or the use made or to be made of the 1 land, has, or will, specially contribute to the need for the 2 service, facility or activity. 3 4 Examples for subsection (1)(b)(i)-- 5 A rural fire services charge to raise funds for a rural fire brigade to 6 purchase or maintain equipment to service only part of the local 7 government's area. 8 A tourism promotion charge levied on land used for businesses that 9 would benefit from tourism promotion in the local government's 10 area. 11 A recreational facilities charge levied over a 2 year period to 12 contribute to the cost of building playground facilities and amenities 13 in a nominated park in part of the local government's area. 14 A cultural centre charge levied over an 8 year period to contribute 15 to the cost of building a centre in part of the local government's 16 area (e.g. 1 of 2 towns in the area), with construction to start within 17 a certain number of years after the charge is first levied. 18 A charge, levied over a 20 year period, to repay a loan for the 19 construction of a drainage system in part of the local government's 20 area, from which some land would commence receiving a benefit in 21 a year and the remainder in a later year of the 20 year period. 22 Example for subsection (1)(b)(ii)-- 23 An entity that relies on road transport for its business specially 24 contributes to the wear and tear on a local road adjoining its 25 property and is likely to need a higher standard of road than the 26 occupiers of other properties adjoining the road.'. (2) Section 971(3), `in the local government's opinion,' to `activity.'-- 27 omit, insert-- 28 `in the local government's opinion-- 29 (a) the land, or the occupier of the land, has or will specially benefit 30 from, or has or will have special access to, the service, facility or 31 activity; or 32 (b) the occupier of the land, or the use made or to be made of the 33 land, has, or will, specially contribute to the need for the service, 34 facility or activity.'. 35

 


 

s 77 45 s 77 Local Government and Other Legislation Amendment (3) Section 971(4)-- 1 omit, insert-- 2 `(4) The local government's resolution making the special rate or charge 3 must identify-- 4 (a) the rateable land to which the rate or charge applies; and 5 (b) the overall plan for the supply of the service, facility or activity. 6 `(4A) The overall plan must-- 7 (a) be adopted by the local government by resolution either before, or 8 at the same time as, the local government first makes the special 9 rate or charge; and 10 (b) identify the rateable land to which the rate or charge applies; and 11 (c) describe the service, facility or activity; and 12 (d) state the estimated cost of implementing the overall plan; and 13 (e) state the estimated time for implementing the overall plan. 14 `(4B) Under an overall plan, a special rate or charge may be made and 15 levied for 1 or more years before any of the funds received by the local 16 government from the special rate or charge are expended in implementing 17 the plan. 18 `(4C) If an overall plan will not be implemented within 1 year, the local 19 government must, at or before the budget meeting for each year of the 20 period for implementing the overall plan, by resolution, adopt an annual 21 implementation plan for the year. 22 `(4D) The local government may, by resolution, at any time, amend an 23 overall plan or an annual implementation plan.6'. 24 of new s 971A 25 Insertion Clause 77. s 78 46 s 78 Local Government and Other Legislation Amendment of special rates and charges 1 `Adjustment `971A.(1) If more funds are received by a local government from a 2 special rate or charge made and levied in a financial year than are expended 3 in carrying out the implementation plan for the year, the local government 4 may carry the unexpended funds forward for expending under an 5 implementation plan in a future financial year. 6 `(2) A special rate or charge is not invalid merely because a local 7 government made and levied a special rate or charge on land to which 8 section 971(1)(b) did not apply. 9 `(3) If a local government makes and levies a special rate or charge on 10 land to which section 971(1)(b) does not apply, the local government must 11 return the funds received to the person on whom the special rate or charge 12 was levied. 13 `(4) If a local government has funds received from a special rate or 14 charge remaining after an overall plan is implemented, or after the local 15 government decides not to fully implement an overall plan, the local 16 government must pay the remaining funds, in the same proportions as the 17 special rate or charge was last levied, to the current owners of the land on 18 which the special rate or charge was levied.'. 19 of s 1008 (Levying rates) 20 Amendment Clause 78. s 79 47 s 79 Local Government and Other Legislation Amendment of s 1008 (Levying rates) 1 Amendment Clause 79.(1) Section 1008-- 2 insert-- 3 `(2A) The local government must also state on, or include with, the rate 4 notice-- 5 (a) if the local government has decided 1 or more discount dates or 6 1 or more discount periods for payment of the rate--the discount 7 or information about how the discount is calculated; and 8 (b) if the local government has resolved that a rate may be paid by 9 instalments--requirements for payment by instalments.'. 10 (2) Section 1008-- 11 insert-- 12 `(2C) If a local government includes an amount mentioned in 13 subsection (2B) on a rate notice, it must be clear on the face of the rate 14 notice that-- 15 (a) the amount is not a rate; and 16 (b) payment of the amount, whether before or after any discount date 17 or discount period for a rate mentioned in the notice, does not 18 affect any discount relating to the rate. 19 `(2D) Subsection (2E) applies if-- 20 (a) the local government receives payment of an amount (the 21 "amount received") that is less than the total of all amounts, 22 mentioned on a rate notice (the "rate notice amounts"), that are 23 payable to the local government; and 24 (b) the person who pays the amount received does not specify which 25 of the rate notice amounts the person is intending to pay. 26 `(2E) The local government must use the amount received in payment of 27 the rate notice amounts in the following order-- 28 · overdue rates 29 · a rate or rates levied by the rate notice 30

 


 

s 80 48 s 81 Local Government and Other Legislation Amendment · amounts, other than rates, that are payable to the local 1 government.'. 2 of s 1008 (Levying rates) 3 Amendment Clause 80. Section 1008-- 4 insert-- 5 `(4A) If a person liable to pay a rate has paid the rate before the local 6 government has given the person a rate notice for the period for which the 7 rate is levied, the local government is not required to give the person a rate 8 notice for the period.'. 9 of s 1014 (Time within which rates must be paid) 10 Replacement Clause 81. Sections 1019 to 1022-- 2 omit, insert-- 3 for prompt payment 4 `Discount `1019.(1) At its budget meeting, a local government may, by resolution, 5 decide to allow a discount for prompt payment of a rate. 6 `(2) If a local government decides to allow a discount, the local 7 government must decide-- 8 (a) whether the discount is to be a fixed amount or a percentage of the 9 rate; and 10 (b) if the discount is to be a fixed amount--the amount; and 11 (c) if the discount is to be a percentage of the rate--the percentage; 12 and 13 (d) the discount date or discount period for the rate. 14 `(3) The discount date or discount period for a rate must not be-- 15 (a) for the discount date--after the date decided by the local 16 government under section 1014 as the date by which the rate must 17 be paid; and 18 (b) for the discount period--longer than the time decided by the local 19 government under section 1014 as the time within which the rate 20 must be paid. 21 `(4) The discount date or discount period may be altered by the local 22 government, by resolution, to allow each person liable to pay the rate a 23 greater period of time to pay the rate and be allowed the discount. 24 `(5) If the local government allows a discount for payment of a rate, it 25 must allow the discount to each person liable to pay the rate and who pays 26 the rate by the discount date or within the discount period for the rate. 27 `(6) The local government may allow more than 1 amount of discount or 28 percentage discount for a rate only if the local government-- 29 (a) decides more than 1 discount date or discount period for the rate; 30 and 31
