`(3) Amounts in the prisoners trust fund to the credit of a prisoner-- 12
(a) may be spent by the prisoner, with the commission's consent; 13

(b) must be paid by the commission to the public trustee, if the public 15
trustee is managing the prisoner's estate and the public trustee 16
requests the payment; and 17
(c) must be paid by the commission to the prisoner on being 18
discharged or being released on parole.'. 19

commencement of this section for the purposes of the Juvenile 15
Justice Act 1992; 16

commencement of this section for the purposes of its functions in 18
relation to the Juvenile Justice Act 1992 before that 19

`79.(1) This section applies for a proceeding for an offence relating to 22
property that happened between the commencement of the Juvenile Justice 23
Legislation Amendment Act 1996, section 101 and the commencement of 24

`Transfer
`237.(1) The purpose of this section is to transfer officers and employees 13
of Queensland Corrections to the public service because of the change to the 14
chief executive's functions under the Juvenile Justice Legislation 15
Amendment Act 1998. 16
`(2) On the commencement of this section, the following persons 17
become public service employees employed in the department-- 18
(a) persons who, immediately before the commencement, were 19
officers or employees of Queensland Corrections employed as 20
members of the staff of detention centres; 21
(b) persons decided by the Governor in Council who, immediately 22
before the commencement, were employed by Queensland 23
Corrections. 24
`(3) Appointments for subsection (2) are to be made under the Public 25
Service Act 1996. 26
`(4) The remuneration under the Public Service Act 1996 of a person 27
under an appointment under subsection (3) must not be less than the 28

remuneration to which the person would have been entitled if the person's 1
employment as an officer or employee of Queensland Corrections had 2
continued. 3
`(5) The person may claim against the department all entitlements 4
accrued as an officer or employee of Queensland Corrections. 5
`(6) The person's leave entitlements are to be calculated as if previous 6
service as an officer of the public service and service as an officer or 7
employee of the Queensland Corrective Services Commission or 8
Queensland Corrections and service as a public service employee were 9
continuous service as a public service employee. 10
`(7) To remove any doubt, it is declared that for this section an officer or 11
employee of Queensland Corrections includes a person appointed under a 12
fixed-term contract of employment. 13
`(8) In this section-- 14
"remuneration" means total remuneration including entitlements. 15

`Disciplinary
`238.(1) This section applies to a person who becomes a public service 17
employee under section 237(2). 18
`(2) Disciplinary proceedings may be taken against the person after the 19
commencement of this section for a disciplinary matter that happened while 20
the person was an officer or employee of Queensland Corrections as if the 21
person were a public service employee at the time the matter happened. 22

`Termination
`240.(1) The detention centre contracts are terminated. 4
`(2) The State does not incur liability because of the termination. 5
`(3) In this section-- 6
"detention centre contracts" means the following contracts entered into 7
between the Queensland Corrective Services Commission and 8
Queensland Corrections-- 9
(a) a contract dated 29 August 1997 for the operation and 10
management of the John Oxley Youth Detention Centre; 11
(b) a contract dated 29 August 1997 for the operation and 12
management of the Sir Leslie Wilson Youth Detention Centre; 13
(c) a contract dated 29 August 1997 for the operation and 14
management of the Cleveland Youth Detention Centre.'. 15
