An Act to amend the Jury Act 1995

Jury Amendment
The Parliament of Queensland enacts-- 1

Short
Clause 1. This Act may be cited as the Jury Amendment Act 1996. 3

Clause 2. This Act amends the Jury Act 1995. 5
of s 4 (Qualification to serve as juror) 6
Amendment
Clause 3. Section 4(3)-- 7
omit, insert-- 8
`(3) The following persons are not eligible for jury service-- 9
(a) the Governor; 10
(b) a member of Parliament; 11
(c) a local government mayor or other councillor; 12
(d) a person who is or has been a judge or magistrate (in the State or 13
elsewhere); 14
(e) a lawyer actually engaged in legal work; 15
(f) a person who is or has been a police officer (in the State or 16
elsewhere); 17
(g) a person who is or has been a correctional officer; 18
(h) a person who is 70 years or more, if the person has not elected to 19
be eligible for jury service under subsection (4); 20
(i) a person who is not able to read or write the English language; 21
(j) a person who has a physical or mental disability that makes the 22
person incapable of effectively performing the functions of a 23
juror; 24
(k) a person who has been convicted of an indictable offence, 25

whether on indictment or in a summary proceeding; 1
(l) a person who has been sentenced (in the State or elsewhere) to 2
imprisonment. 3
`(4) A person who is 70 years or more may elect to be eligible for jury 4
service in the way prescribed under a regulation.'. 5

`(5) A person who has received a copy of the list must return the copy to 13
the sheriff as soon as practicable after the jury for the trial is selected, unless 14
the person has disposed of it in the way directed by a judge under 15
subsection (6). 16
Maximum penalty--10 penalty units or 2 months imprisonment. 17
`(6) A judge may direct a person who has received a copy of the list to 18
dispose of it as the judge directs. 19
`(7) The sheriff must destroy copies of the list returned to the sheriff.'. 20

`Transitional
`78.(1) This section applies for all juries for which prospective juror 12
notices were forwarded or given under the repealed Act, whether or not the 13
juries had been formed before the repeal. 14
`(2) The old law applies to the juries as if this Act had not been passed. 15
`(3) Without limiting subsection (2), the old law applies to the 16
following-- 17
(a) qualifications and liability of persons to serve as the jurors; 18
(b) exemptions from serving as the jurors; 19
(c) selection, notification, excusal and summonsing of prospective 20
jurors; 21
(d) the jurors; 22
(e) all proceedings for which the juries are formed. 23
`(4) In this section-- 24
"old law" means the statutory law of the State as in force immediately 25
before the repeals and amendments made by this Act. 26

"prospective juror notice" means notice forwarded or given by the sheriff 1
under the repealed Act under a jury precept or court order or direction 2
issued or made before the commencement. 3
"repealed Act" means the Jury Act 1929 as in force immediately before its 4
repeal. 5
`(5) This section expires 6 months after it commences.'. 6
