2002 A BILL FOR An Act to amend the Industrial Relations Act 1999, and for other purposes

 


 

s1 4 s5 Industrial Relations Amendment Bill 2002 The Parliament of Queensland enacts-- 1 1 Short title Clause 2 This Act may be cited as the Industrial Relations Amendment Act 2002. 3 2 Commencement Clause 4 This Act commences on a day to be fixed by proclamation. 5 3 Act amended Clause 6 This Act amends the Industrial Relations Act 1999. 7 4 Amendment of s 256 (Composition) Clause 8 (1) Section 256(1)(b)-- 9 omit, insert-- 10 `(b) the vice president, 2 deputy presidents and at least 5 other 11 industrial commissioners ("commissioners").'. 12 (2) Section 256(2)(b)-- 13 omit, insert-- 14 `(b) otherwise--3 or more members including at least 1 presidential 15 member.'. 16 5 Insertion of new s 258A Clause 17 After section 258-- 18 insert-- 19 `258A Deputy presidents of the commission 20 `(1) The Governor in Council may appoint a person as a deputy 21 president of the commission-- 22 (a) if the person is not already a commissioner--by commission; or 23 (b) if the person is already a commissioner--by gazette notice. 24

 


 

s6 5 s7 Industrial Relations Amendment Bill 2002 `(2) The person must be a person who has the experience, qualifications 1 and standing mentioned in section 259(2).'. 2 6 Amendment of section 264 (Administrative responsibilities for the Clause 3 commission and registry) 4 (1) Section 264(1) to (3), `commissioner administrator'-- 5 omit, insert-- 6 `vice president'. 7 (2) Section 264-- 8 insert-- 9 `(4) The vice president is to be assisted by the deputy presidents in 10 performing responsibilities under subsection (1) or (2) and may delegate a 11 power under subsection (3) to a deputy president. 12 `(5) A commissioner must comply with a direction of the vice president 13 or a deputy president given for the performance of responsibilities under 14 subsection (1) or (2). 15 `(6) The vice president must assign an industry or group of industries to 16 a panel of members. 17 `(7) The powers of the commission in relation to that industry, other than 18 the powers of the full bench, may only be exercised by-- 19 (a) a member of the panel; or 20 (b) another member of the commission to whom the vice president 21 has assigned a particular matter. 22 `(8) A panel must consist of at least 1 presidential member and 23 1 commissioner. 24 `(9) A member of the commission may be a member of more than 25 1 panel.'. 26 7 Insertion of new ch 20 Clause 27 After chapter 19-- 28 insert-- 29

 


 

s8 6 s9 Industrial Relations Amendment Bill 2002 `CHAPTER 20--OTHER TRANSITIONAL 1 PROVISIONS 2 `733 Transitional provision for 2002 amendment Act 3 `(1) The person who, immediately before the commencement of the 4 2002 amendment Act, was the commissioner administrator continues to be 5 a commissioner after the commencement. 6 `(2) The 2002 amendment Act does not affect the validity of any 7 decisions or delegations made before the commencement of that Act. 8 `(3) A delegation made by the commissioner administrator that was in 9 force immediately before the commencement of the 2002 amendment Act 10 continues to have effect after the commencement as if made by the vice 11 president. 12 `(4) In this section-- 13 "2002 amendment Act" means the Industrial Relations Amendment Act 14 2002.'. 15 8 Amendment of sch 2 (Appointments and procedures) Clause 16 (1) Schedule 2, section 4, heading, `Leave'-- 17 omit, insert-- 18 `Extended leave'. 19 (2) Schedule 2, part 1-- 20 insert-- 21 `4A Leave of absence 22 `(1) The Minister may grant leave of absence to the president or vice 23 president on the terms the Minister considers appropriate. 24 `(2) The vice president may grant leave of absence to a deputy president 25 or commissioner on the terms the vice president considers appropriate.'. 26 9 Amendment of sch 5 (Dictionary) Clause 27 Schedule 5-- 28 insert-- 29
