The Parliament of Queensland enacts-- 1
1 Short title

This Act may be cited as the Industrial Relations Amendment Act 2001. 3
2 Commencement

(1) Sections 16, 18 to 21 and 28 to 30 commence on 1 May 2002. 5
(2) Section 6 is taken to have commenced on 1 July 1999. 6

`86 When this division applies 5
`This division applies to an application about severance allowance or 6
other separation benefits. 7
`87 Orders about severance allowance and other separation benefits 8
`(1) The commission may make an order about severance allowance or 9
other separation benefits on application by-- 10
(a) an employee; or 11
(b) an organisation whose rules entitle it to represent the employee's 12
industrial interests. 13
`(2) An employer must not contravene the order. 14
`(3) If an employer contravenes the order, the commission may-- 15
(a) make any of the orders it may make under section 78(2), (3) 16
or (4);3 or 17
(b) order the employer to pay the employee an amount of not more 18
than the monetary value of 135 penalty units. 19
`(4) In this section-- 20
"severance allowance or other separation benefits" means severance 21
allowance or other separation benefits under article 12 of the 22
Termination of Employment Convention 1982. 23

`An application for an order under this division must be made-- 25
(a) before, or within 21 days after, the dismissal takes effect; or 26

(b) within a further period the commission allows on an application 1
made at any time. 2
`Division 2--Order giving effect to article 13 of Termination of 3
Employment Convention 4
`89 When this division applies 5
`This division applies if an employer decides to dismiss 15 or more 6
employees for an economic, technological or structural reason. 7
`90 Employer must give notice of proposed dismissals 8
`(1) The employer may dismiss the employees only if the employer, as 9
soon as practicable after making the decision, notifies-- 10
(a) the Commonwealth department or agency whose primary 11
function is helping unemployed people find work; and 12
(b) each employee organisation of which any of the employees is a 13
member. 14
`(2) The notice must state-- 15
(a) the number and categories of employees being dismissed; and 16
(b) the reasons for the dismissals; and 17
(c) the time when, or the period over which, the employer intends to 18
carry out the dismissals. 19
`(3) If satisfied an employer has dismissed, or proposes to dismiss, an 20
employee without giving the notice, the commission may make any or all 21
of the following orders-- 22
(a) any of the orders it may make under section 78(2), (3) or (4);4 23
(b) an order imposing on the employer a penalty of not more than 24
16 penalty units; 25
(c) an order that the employer pay the employee an amount of not 26
more than the monetary value of 135 penalty units; 27

(d) an order declaring the dismissal ineffective until the employer 1
has given the notice. 2
`(4) An application for an order may be made by-- 3
(a) an employee, including a dismissed employee; or 4
(b) an organisation whose rules entitle it to represent the employee's 5
industrial interests; or 6
(c) an inspector. 7
`(5) The commission may order that a penalty, or part of a penalty, under 8
subsection (3)(b) be paid to any person who may have made the 9
application, other than an officer or employee of the State or a public 10
service officer. 11
`(6) Any part of the penalty ordered to be paid to the person under 12
subsection (5) must first be paid to the person. 13
`(7) The remainder of the penalty must then be paid to the consolidated 14
fund. 15
`(8) A failure to give a notice is not an offence. 16
`90A Employer must consult with employee organisations about 17
dismissals 18
`(1) The employer must give each employee organisation of which any 19
of the employees is a member an opportunity to consult with the employer 20
on ways to-- 21
(a) avoid or minimise the dismissals; and 22
(b) minimise the adverse effects of the dismissals, for example, by 23
finding alternative employment. 24
`(2) The employer must do so as soon as practicable after making the 25
decision to dismiss employees, but in any case before dismissing any of the 26
employees. 27
`(3) If the employer does not give the organisation an opportunity to 28
consult as required, the commission may make the orders it considers 29
appropriate to put employees, and their organisations, in the same position, 30
as nearly as can be done, as if the employer had done so. 31
`(4) The commission may make an order on application from an 32
employee or organisation that is to be affected by the order. 33

`(5) Subsections (1) and (2) do not apply to an organisation if the 1
employer could not reasonably be expected to have known, at the time of 2
the decision, that the organisation's rules entitled it to represent the 3
industrial interests of a dismissed employee. 4

(a) before, or within 21 days after, the dismissal takes effect; or 7
(b) within a further period the commission allows on an application 8

`(4) In exercising the arbitration powers, the commission must limit its 1
consideration to the matters at issue during negotiations for the proposed 2
agreement. 3
`(5) In considering the matters at issue, the commission must consider at 4
least the following-- 5
(a) the merits of the case; 6
(b) the likely effects of the commission's proposed determination, 7
and any matters agreed before arbitration, on employees and 8
employers who will be bound by the proposed determination; 9
(c) the public interest, and to that end the commission must 10
consider-- 11
(i) the objects of this Act; and 12
(ii) the likely effects of the commission's determination on the 13
community, economy, industry generally and on the 14
particular enterprise or industry concerned; 15
(d) the extent to which the negotiating parties have negotiated in 16
good faith. 17
`(6) The commission must publish its reasons when determining a matter 18
under this section. 19
`(7) The reasons must address each of the things the commission 20
considered under subsection (5).'. 21
18 Amendment of s 156 (Certifying an agreement)

(i) remunerates all men and women employees of the employer 27
equally for work of equal or comparable value; or 28
(ii) will, because of the agreement if it is certified, remunerate 29
all men and women employees of the employer equally for 30
work of equal or comparable value; or 31

(iii) is implementing equal remuneration for work of equal or 1
comparable value for all men and women employees of the 2

(m) for a multi-employer agreement or project agreement--the 4
agreement provides for equal remuneration for all men and 5
women employees covered by the agreement for work of equal 6
or comparable value.'. 7
