The Parliament of Queensland enacts-- 1
Part 1 Preliminary 2
Clause 1 Short title 3
This Act may be cited as the Industrial Relations Act and 4
Other Legislation Amendment Act 2007. 5
Clause 2 Commencement 6
(1) Parts 5 and 6 commence on 1 January 2008. 7
(2) The following provisions commence on a day to be fixed by 8
proclamation-- 9
· sections 10 to 12 10
· section 30 11
· section 39 (to the extent it inserts section 740) 12
· section 41(2) (to the extent it inserts definitions 13
ombudsman and QWRO) 14
· sections 43 to 45 15

This part and the schedule amend the Industrial Relations Act 21

`(o) promoting collective bargaining and establishing the 4
primacy of collective agreements over individual 5
agreements.'. 6

`To remove any doubt, it is declared that the provisions of part 12
6 are to be applied when working out an employee's rights 13
and entitlements to long service leave under this part or an 14
industrial instrument.'. 15

required to be given under section 84 to a transferred 2
employee, any period of notice previously given in relation to 3
the transfer of the calling (whether given before or after the 4
commencement of this subsection) is to be disregarded. 5
`(4) In subsection (3)-- 6

`(1) An application for the commission to certify an agreement 23
may be made by a party to the agreement. 24
`(2) For an agreement made between a single employer and 1 or 25
more employee organisations, the application may be made 26
even though the agreement has not been signed by or for all 27
the parties if-- 28
(a) all the parties have agreed on the terms of the 29
agreement; and 30

(b) the agreement has been approved by a valid majority of 1
the relevant employees at the time in a properly 2
conducted ballot. 3
`(3) If an agreement has been signed by or for all the parties, the 4
application must be made within 21 days after it is signed.'. 5
Clause 11 Amendment of s 156 (Certifying an agreement) 6

`(1A) Subsection (1)(c) does not apply if the commission is 9
satisfied, in the particular circumstances, that-- 10
(a) although the agreement has not been signed by or for all 11
the parties, all the parties have agreed on the terms of 12
the agreement; and 13
(b) the application for the certification of the agreement was 14
made within a reasonable time after the agreement was 15
approved by a valid majority of the relevant employees 16
at the time in a properly conducted ballot. 17
`(1B) For subsection (1A), in deciding whether all parties have 18
agreed on the terms of the agreement, the commission may 19
consider-- 20
(a) whether the parties negotiated in good faith as required 21
under section 146; and 22
(b) any other evidence supporting or not supporting the 23
alleged agreement.'. 24

`(1) The ombudsman is appointed by the Governor in Council. 22
`(2) The ombudsman is appointed under this Act and not the 23
Public Service Act 1996. 24

`(1) A person is eligible to be appointed as ombudsman if the 26
person has-- 27

under an Act or under State authorisation for a 8
public or State purpose; or 9
(b) suitable experience, qualifications and standing in the 10
community to be appointed as ombudsman. 11
`(2) A person is not eligible to be or continue as ombudsman if the 12

(a) is a member of the Executive Council or Legislative 14
Assembly; or 15
(b) is a director of a corporation engaged in a calling: or 16
(c) is a auditor of a corporation engaged in a calling or of a 17

appointment as ombudsman to act as ombudsman-- 11
(a) during a vacancy in the office; or 12
(b) during any period, or during all periods, when the 13
ombudsman is absent from duty or from the State or is, 14
for another reason, unable to perform the duties of the 15

was, immediately before the appointment, a public service 13

`(2) The person keeps the rights the person has accrued because of 15
employment as a public service officer, or that would accrue 16
in the future to the person, as if service as ombudsman were a 17
continuation of service as a public service officer. 18
`(3) If the person's term of appointment as ombudsman ends 19
because the person resigns or for a reason other than a reason 20
mentioned in section 339O-- 21
(a) the person has the right to be employed as a public 22
service officer-- 23
(i) in the department that is the nearest practical 24
equivalent to the department in which the person 25
was employed as a public service officer 26
immediately before the person last stopped being a 27
public service officer; and 28
(ii) at the classification level at which the person was 29
employed as a public service officer immediately 30

disadvantage the child in relation to the child's employment 6

`(2) An agreement or arrangement disadvantages a child in 8
relation to the child's employment conditions only if the 9
agreement or arrangement reduces the child's employment 10
entitlements or protections. 11
`(3) In this section-- 12
employment entitlements or protections, in relation to a 13
child's employment conditions, means the entitlements or 14
protections that cover an employee performing similar work 15
to that performed by the child under-- 16
(a) a State award or order; or 17

those entitlements or protections as reviewed by a 19
general ruling of the full bench, or chapter 3, part 4, 20

`15F Issue of compliance notice 2
`(1) This section applies if an inspector considers an affected 3
employer-- 4
(a) is contravening section 15B; or 5
(b) has contravened section 15B in circumstances that make 6
it likely that the affected employer will continue to 7
contravene that section or repeat the contravention. 8
`(2) The inspector may issue to the affected employer a notice 9
(compliance notice) requiring the employer to remedy the 10
contravention or the matters giving rise to the contravention 11
within a stated period, of not less than 14 days, after the issue 12
of the notice or the shorter period stated under subsection (4). 13
`(3) The affected employer must comply with the compliance 14
notice, unless the employer has a reasonable excuse. 15
Maximum penalty--100 penalty units. 16
`(4) For subsection (2), an inspector may state a period of less than 17
14 days after the issue of the compliance notice if the 18
inspector is satisfied it is reasonably practicable for the 19
employer to comply with the notice within the stated shorter 20
period. 21
`(5) The compliance notice must-- 22
(a) state the inspector's reasons for issuing the notice; and 23
(b) include information about the affected employer's right 24
to appeal against the issue of the notice or the terms of 25
the notice to the industrial commission. 26
`15G Compliance notice may include directions 27
`(1) An inspector may include in a compliance notice directions in 28
relation to the steps an affected employer must take to remedy 29
a contravention or a matter to which the notice relates or to 30
otherwise comply with the notice. 31

`(2) Without limiting subsection (1), a direction may require an 1
affected employer to pay to a child an amount worked out by 2
the inspector that would have been payable to the child under 3
the Industrial Relations Act 1999 or a State award or order 4
applying to the child's employment if the employment was 5
not covered by an agreement or arrangement to which this part 6
applies. 7
`(3) Also, a direction may offer an affected employer a choice of 8
ways in which the affected employer may remedy the 9
contravention or matter or comply with the notice. 10
`15H Withdrawal of compliance notice 11
`(1) If, at any time, the inspector who issued a compliance notice 12
to an affected employer or another inspector authorised by the 13
chief executive for the purpose (both the appropriate 14
inspector) is satisfied the compliance notice was issued in 15
error or was incorrect, the appropriate inspector may 16
withdraw the compliance notice by signed notice given to the 17
affected employer. 18
`(2) The withdrawal has effect when notice of the withdrawal is 19
given to the affected employer. 20
`15I Industrial magistrate's powers in proceeding for 21
compliance notice offence 22
`(1) This section applies in relation to a proceeding against an 23
affected employer for a charge of a compliance notice offence. 24
`(2) If an industrial magistrate finds the affected employer guilty 25
of the compliance notice offence, the industrial magistrate 26
may, in addition to any penalty that may be imposed for the 27
offence, order the affected employer to pay to each affected 28
child the compliance notice amount for the child or the 29
amount the industrial magistrate considers appropriate for the 30
child. 31
`(3) Subsection (2) applies whether there is a finding of guilt or the 32
acceptance of a plea of guilty in relation to the compliance 33
notice offence and whether or not a conviction is recorded for 34
the offence. 35

`(4) However, if the industrial magistrate does not find the affected 1
employer guilty of the compliance notice offence but, on the 2
balance of probabilities, is satisfied the affected employer 3
should be required to pay an amount to each affected child, 4
the industrial magistrate may order the affected employer to 5
pay to each affected child the compliance notice amount for 6
the child or the amount the industrial magistrate considers 7
appropriate for the child. 8
`(5) The industrial magistrate may make the order despite any 9
express or implied provision of an agreement and on the terms 10
the industrial magistrate considers appropriate. 11
`(6) Without limiting the powers of an industrial magistrate in a 12
proceeding for a compliance notice offence, the industrial 13
magistrate may, before making an order against an affected 14
employer under this section, order that an inspector make an 15
application under section 15N and adjourn the proceeding 16
until a date fixed by the court or a date to be fixed without 17
making a finding of guilt against the employer. 18
`(7) If the industrial commission makes an order of the kind 19
mentioned in section 15O(2) or (3) on an application under 20
section 15N, the industrial magistrate must not make an order 21
under subsection (4). 22
`(8) In this section-- 23
affected child, in relation to a compliance notice, means a 24
child who is covered by an agreement or arrangement that is 25
the subject of the compliance notice. 26
compliance notice amount means the amount stated in a 27
direction in a compliance notice as the amount an affected 28
employer must pay to a child. 29
compliance notice offence means an offence against section 30
15F(3). 31
`15J Appeals 32
`(1) An affected employer to whom a compliance notice is issued 33
may appeal against the issue of the notice or the terms of the 34
notice to the industrial commission. 35

the same procedures as the procedures for an appeal under the 2
Industrial Relations Act 1999, chapter 9, division 5. 3

the compliance notice; and 6
(b) does not stay the operation of the notice appealed 7
against unless the industrial commission otherwise 8
orders. 9
`(4) However, the industrial commission may extend the time for 10
starting an appeal. 11
`(5) A defect in the compliance notice does not affect an affected 12
employer's right to appeal against the issue of the compliance 13
notice or the terms of the notice. 14
`15K Decision on appeal 15
`(1) The industrial commission may-- 16
(a) confirm the compliance notice appealed against; or 17
(b) allow the appeal and vary the compliance notice in the 18
way the commission considers appropriate; or 19
(c) allow the appeal and revoke the compliance notice. 20
`(2) For deciding the appeal, the powers of the industrial 21
commission under this part are-- 22
(a) the same powers as the industrial commission has in 23
relation to any proceeding for an appeal started under 24
the Industrial Relations Act 1999; and 25
(b) the powers an inspector has under this part. 26
`(3) Also, if, the industrial commission confirms a compliance 27
notice, it may, in the same proceeding, decide any application 28
under section 15N for orders in relation to the contravention 29
to which the compliance notice relates. 30

pay a child an amount, the application must be made within 6 24
years after the amount became payable. 25
`(4) However, the application can not relate to an amount payable 26
before 27 March 2006. 27
`15O Consideration of s 15N application 28
`(1) This section applies if, after considering an application under 29
section 15N, the industrial commission decides the affected 30
employer is contravening or has contravened section 15B. 31

`(2) The industrial commission may order the affected employer to 1
remedy the contravention or the matter of the contravention as 2
required under the compliance notice or in another way. 3
`(3) Also, if the matter of the non-compliance relates to a direction 4
in a compliance notice to pay a child a stated amount, the 5
industrial commission must make an order of the kind 6
mentioned in the Industrial Relations Act 1999, section 7
278(8)(a). 8
`(4) The industrial commission may make an order under 9
subsection (3) despite any express or implied provision of an 10
agreement to the contrary and may order the payment to be 11
made on the terms the industrial commission considers 12
appropriate. 13
`(5) To the extent an order made under subsection (3) relates to 14
contributions to a superannuation fund, the industrial 15
commission may, in the order, require the contributions to be 16
paid in the same way as it could if the order was made under 17
the Industrial Relations Act 1999, section 278(9) on an 18
application of a kind mentioned in section 278(1) of that Act. 19
`(6) If the order includes a requirement about superannuation 20
contributions and either of the following applies, the 21
contributions must be paid to the unclaimed moneys fund-- 22
(a) the child can not be located after reasonable inquiry; or 23
(b) after being required to do so, the child does not 24
nominate a superannuation fund for the purposes of the 25
order. 26

`(6) At the end of the time stated for filing an affidavit, or the time 19
as extended by the commission, the industrial registrar must, 20
in order to decide whether there has been substantial 21
compliance with the order-- 22
(a) examine all affidavits filed; and 23
(b) if all affidavits required to be filed have not been filed in 24
the stated time--make all necessary further inquiries. 25
`(7) If the industrial registrar is not satisfied that there has been 26
substantial compliance with the order, the registrar must issue 27
a notice under the Industrial Relations (Tribunals) Rules 2000 28
calling on the employee organisation or person to whom the 29
order was directed to show cause to the full bench at a stated 30
time why the organisation or person should not be dealt with 31
under section 90X. 32

`90X Remedies on show cause notice 1
`(1) If an employee organisation issued with the notice does not 2
show cause at the stated time, the full bench may do 1 or more 3
of the following-- 4
(a) impose on the organisation a penalty of not more than 5
1000 penalty units; 6
(b) make the other orders it considers appropriate to secure 7
the organisation's compliance with the commission's 8
order; or 9
(c) order the organisation to pay the costs of the show cause 10
proceedings. 11
`(2) If a person issued with the notice does not show cause at the 12
stated time, the full bench may do 1 or more of the 13
following-- 14
(a) impose on the person a penalty of-- 15
(i) for a corporation--not more than 1000 penalty 16
units; or 17
(ii) for an individual--not more than 40 penalty units; 18
(b) make any order or decision it considers appropriate 19
under section 90Q or 90R; 20
(c) make the other orders it considers appropriate to secure 21
the person's compliance with the commission's order; or 22
(d) order the person to pay the costs of the show cause 23
proceedings. 24
`(3) All persons concerned must comply with an order or direction 25
made or given by the full bench. 26
`(4) In this section-- 27
organisation includes a branch of the organisation. 28
stated time means at the time stated in the notice to show 29
cause under section 90W(7), or at a time to which the 30

`90Y Disobeying penalty orders 1
`(1) A person must obey a penalty order, unless the person has a 2
reasonable excuse. 3
Maximum penalty--the penalty provided for in the order. 4
`(2) In this section-- 5
penalty order means an order of the full bench under this 6
division that provides for payment of a penalty if the order is 7

`(1) A person whose interests are affected by an original decision 10
may appeal against the decision to the full bench. 11
`(2) If the decision is a decision of the industrial commission 12
under section 90U, the person may appeal against the decision 13
only on a ground other than-- 14
(a) error of law; or 15
(b) excess, or want, of jurisdiction. 16
`(3) Despite section 152(2), if a person wants to appeal against a 17
decision of the commission both on a ground mentioned in 18
section 152(2) and on a ground mentioned in subsection (2) of 19
this section, the person may only appeal against the decision 20
to the full bench. 21
`(4) The person has a right to a statement of-- 22
(a) the decision; and 23
(b) the reasons for the decision. 24
`151H How to start appeal 25
`(1) An appeal is started by-- 26
(a) filing written notice of appeal with the industrial 27
registrar; and 28

(b) complying with the rules applying to appeals to the full 1
bench under the Industrial Relations Act 1999. 2
`(2) The notice of appeal must be filed within 30 days after the day 3

`(3) The full bench may at any time extend the period for filing the 5
notice of appeal. 6
`(4) The notice of appeal must state fully the grounds of the appeal 7
and the facts relied on. 8
`151I Stay of operation of decisions 9
`(1) The full bench may grant a stay of a decision appealed against 10
to secure the effectiveness of the appeal. 11
`(2) A stay-- 12
(a) may be given on the conditions the full bench considers 13
appropriate; and 14
(b) operates for the period fixed by the full bench; and 15
(c) may be revoked or amended by the full bench. 16
`(3) The period of a stay must not extend past the time when the 17
full bench decides the appeal. 18
`(4) An appeal against a decision affects the decision, or the 19
carrying out of the decision, only if the decision is stayed. 20
`151J Hearing procedures 21
`(1) The procedure for an appeal is to be under the rules applying 22
to appeals to the full bench under the Industrial Relations Act 23
1999 or, if the rules make no provision or insufficient 24
provision, in accordance with directions of the full bench. 25
`(2) An appeal is by way of rehearing, unaffected by the decision 26
of the industrial commission. 27
