2005 A Bill for An Act to amend the Health Practitioner Registration Boards (Administration) Act 1999 and the Medical Practitioners Registration Act 2001

 


 

s1 4 s4 Health Practitioners Legislation Amendment Bill 2005 The Parliament of Queensland enacts-- 1 Part 1 Preliminary 2 Clause 1 Short title 3 This Act may be cited as the Health Practitioners Legislation 4 Amendment Act 2005. 5 Clause 2 Commencement 6 This Act commences on 1 January 2006. 7 Part 2 Amendment of Health 8 Practitioner Registration 9 Boards (Administration) Act 10 1999 11 Clause 3 Act amended in pt 2 12 This part amends the Health Practitioner Registration Boards 13 (Administration) Act 1999. 14 Clause 4 Amendment of s 8 (Function of office) 15 Section 8, from `to help'-- 16 omit, insert-- 17 `to-- 18 (a) help each board to perform its functions; and 19 (b) help the executive officer to perform his or her functions 20 and exercise his or her powers.'. 21

 


 

s5 5 s7 Health Practitioners Legislation Amendment Bill 2005 Clause 5 Amendment of s 13 (Powers of executive officer) 1 (1) Section 13(3)-- 2 renumber as section 13(4). 3 (2) Section 13-- 4 insert-- 5 `(3) The executive officer may exercise a power delegated to the 6 executive officer under the Medical Practitioners Registration 7 Act 2001, section 135.1'. 8 Clause 6 Amendment of s 15 (Delegation by executive officer) 9 Section 15(2)-- 10 omit, insert-- 11 `(2) However, the executive officer may not delegate-- 12 (a) the power to enter into a service agreement with a board; 13 or 14 (b) a power delegated to the executive officer under the 15 Medical Practitioners Registration Act 2001, section 16 135.'. 17 Part 3 Amendment of Medical 18 Practitioners Registration Act 19 2001 20 Clause 7 Act amended in pt 3 21 This part amends the Medical Practitioners Registration Act 22 2001. 23 1 Medical Practitioners Registration Act 2001, section 135 (Practice in area of need)

 


 

s8 6 s8 Health Practitioners Legislation Amendment Bill 2005 Clause 8 Amendment of s 135 (Practice in area of need) 1 Section 135-- 2 insert-- 3 `(5) The Minister may delegate the Minister's power under this 4 section to the executive officer. 5 `(6) Subsection (5) does not limit any other law under which the 6 Minister may delegate the Minister's power under this section 7 to a person.'. 8 © State of Queensland 2005
