2003 A BILL FOR An Act to amend Acts administered by the Minister for Health, and for other purposes

 


 

s1 8 s4 Health and Other Legislation Amendment Bill 2003 The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 1 Short title Clause 3 This Act may be cited as the Health and Other Legislation Amendment 4 Act 2003. 5 2 Commencement Clause 6 Section 67 and the schedule, in relation to the amendment of the 7 Pharmacists Registration Act 2001, are taken to have commenced on 8 1 February 2002. 9 PART 2--AMENDMENT OF FREEDOM OF 10 INFORMATION ACT 1992 11 3 Act amended in pt 2 Clause 12 This part amends the Freedom of Information Act 1992. 13 4 Amendment of s 11 (Act not to apply to certain bodies etc.) Clause 14 Section 11(1)-- 15 insert-- 16 `(pa)a committee declared to be an approved quality assurance 17 committee under the Health Services Act 1991, section 31(1); 18 or'. 19

 


 

s5 9 s8 Health and Other Legislation Amendment Bill 2003 PART 3--AMENDMENT OF HEALTH ACT 1937 1 5 Act amended in pt 3 Clause 2 This part amends the Health Act 1937. 3 6 Amendment of s 5 (Interpretation) Clause 4 Section 5(1)-- 5 insert-- 6 ` "nurse", for part 2, division 1, see section 6.'. 7 7 Insertion of new s 6 Clause 8 Part 2, division 1, before section 7-- 9 insert-- 10 `6 Definition for div 1 11 `In this division-- 12 "nurse" means a nurse, midwife, or other person authorised to practise 13 nursing, under the Nursing Act 1992.'. 14 8 Insertion of new s 18B Clause 15 Part 2, division 1, after section 18A-- 16 insert-- 17 `18B Chief executive may inform boards about particular matters 18 `(1) This section applies if the chief executive reasonably believes-- 19 (a) a registrant, nurse or veterinary surgeon has committed an 20 offence against this Act; or 21 (b) a ground exists for the chief executive to suspend or cancel, or 22 impose or vary conditions on, an approval or authority held by a 23 registrant, nurse or veterinary surgeon under the Health (Drugs 24 and Poisons) Regulation 1996. 25 `(2) The chief executive may give information about the belief, including 26 the grounds for the belief-- 27

s 17 12 s 21 Health and Other Legislation Amendment Bill 2003 PART 5--AMENDMENT OF HEALTH RIGHTS 1 COMMISSION ACT 1991 2 17 Act amended in pt 5 Clause 3 This part amends the Health Rights Commission Act 1991. 4 18 Amendment of s 3 (Definitions) Clause 5 Section 3(1), definition "complainant"-- 6 omit, insert-- 7 ` "complainant" means-- 8 (a) a person who makes a health service complaint; or 9 (b) a person substituted, under section 61(5), for a person mentioned 10 in paragraph (a).'. 11 19 Amendment of s 59 (Who may complain) Clause 12 Section 59(1)(b), `61'-- 13 omit, insert-- 14 `61(1), (3) or (4)'. 15 20 Amendment of s 60 (Complaints about persons who are no longer Clause 16 registered providers) 17 Section 60(3)-- 18 omit, insert-- 19 `(3) This Act applies, with any necessary changes, to the person about 20 whom the complaint was made as if a reference to a registered provider 21 included the person.'. 22 21 Amendment of s 61 (Representative complaints) Clause 23 (1) Section 61(1), `subsection (3)'-- 24 omit, insert-- 25 `subsections (3) to (5)'. 26

 


 

s 22 13 s 22 Health and Other Legislation Amendment Bill 2003 (2) Section 61(3)-- 1 omit, insert-- 2 `(3) Any of the following persons may make a health service complaint 3 on behalf of a user who has impaired capacity for a matter within the 4 meaning of the Guardianship and Administration Act 2000-- 5 (a) an attorney for the user under an enduring power of attorney, or 6 advance health directive, under the Powers of Attorney Act 1998; 7 (b) a statutory health attorney under the Powers of Attorney 8 Act 1998; 9 (c) a guardian for the user under the Guardianship and 10 Administration Act 2000; 11 (d) the adult guardian under the Guardianship and Administration 12 Act 2000. 13 `(4) Also, a health service complaint may be made by a person on behalf 14 of a user, after the user's death, if the commissioner is satisfied the person 15 has a sufficient interest. 16 `(5) A person may be substituted as the complainant for a health service 17 complaint if-- 18 (a) the original complainant dies; and 19 (b) the commissioner is satisfied the person has a sufficient interest.'. 20 22 Amendment of s 64 (Complainant to reveal identity) Clause 21 (1) Section 64(1), `person who makes a health service complaint'-- 22 omit, insert-- 23 `complainant'. 24 (2) Section 64, `person's'-- 25 omit, insert-- 26 `complainant's'. 27 (3) Section 64(2), `person'-- 28 omit, insert-- 29 `complainant'. 30

s 28 15 s 30 Health and Other Legislation Amendment Bill 2003 28 Insertion of new s 151 Clause 1 After section 150-- 2 insert-- 3 `151 Validating provision for Health and Other Legislation 4 Amendment Act 2003 5 `(1) This section applies if, before the commencement of this section-- 6 (a) a health service complaint was made, or was purported to be 7 made, to the commissioner by a person acting on behalf of a user, 8 after the user's death; or 9 (b) a person was substituted, or was purported to be substituted, as 10 the complainant for a health service complaint, after the original 11 complainant died. 12 `(2) The complaint is taken to be, and always to have been, as valid as if 13 it were made, after the commencement, under section 61(4) or (5).2'. 14 PART 6--AMENDMENT OF HEALTH SERVICES 15 ACT 1991 16 29 Act amended in pt 6 Clause 17 This part amends the Health Services Act 1991. 18 30 Amendment of s 2 (Definitions) Clause 19 Section 2-- 20 insert-- 21 ` "committee", for part 4, division 2, see section 30. 22 "relevant person", for part 4, division 2, see section 30.'. 23 2 Section 61 (Representative complaints)

s 45 23 s 45 Health and Other Legislation Amendment Bill 2003 `150D Suitability of proposed non-practising registrant 1 `(1) In deciding whether an applicant for non-practising registration is a 2 suitable person to be a non-practising registrant, the board may have regard 3 to each of the following-- 4 (a) any conviction of the applicant for an indictable offence; 5 (b) any conviction of the applicant for an offence against the 6 repealed Act, this Act, the Health Practitioners (Professional 7 Standards) Act 1999 or a corresponding law; 8 (c) any conviction of the applicant for an offence, relating to the 9 practice of the profession-- 10 (i) against the Health Act 1937 or the Fair Trading Act 1989; or 11 (ii) against another law applying, or that applied, in the State, 12 the Commonwealth, another State or a foreign country; 13 (d) if the applicant is, or has been, registered under this Act, has been 14 registered under the repealed Act or is, or has been, registered 15 under a corresponding law, and the registration was affected-- 16 (i) by the imposition of a condition--the nature of the 17 condition and the reason for its imposition; or 18 (ii) by its suspension or cancellation--the reason for its 19 suspension or cancellation; or 20 (iii) in another way--the way it was affected and the reason for 21 it being affected; 22 (e) any other issue relevant to the applicant's suitability to be a 23 non-practising registrant. 24 `(2) In subsection (1), mention of a conviction does not include a 25 conviction that is not part of the applicant's criminal history. 26 `(3) The board may ask the commissioner of the police service for a 27 written report about the applicant's criminal history. 28 `(4) If asked by the board, the commissioner of the police service must 29 give the board a written report about the criminal history of the applicant, 30 including the criminal history in the commissioner's possession or to which 31 the commissioner has access. 32 `(5) In this section-- 33 "criminal history", of an applicant, means the applicant's criminal history 34 as defined under the Criminal Law (Rehabilitation of Offenders) 35

 


 

s 45 24 s 45 Health and Other Legislation Amendment Bill 2003 Act 1986, other than convictions for which the rehabilitation period 1 has expired, and has not been revived, under that Act. 2 `150E Board's powers before deciding applications 3 `(1) Before deciding an application for non-practising registration, the 4 board-- 5 (a) may investigate the applicant; and 6 (b) may, by notice given to the applicant, require the applicant to 7 give the board, within a reasonable time of at least 30 days stated 8 in the notice, further information or a document the board 9 reasonably requires to decide the application. 10 `(2) The board may require the information or document mentioned in 11 subsection (1)(b) to be verified by a statutory declaration. 12 `(3) The applicant is taken to have withdrawn the application if, within 13 the stated time, the applicant does not comply with a requirement under 14 subsection (1)(b). 15 `(4) A notice under subsection (1)(b) must be given to the applicant 16 within 60 days after the board receives the application. 17 `150F Failure to decide application 18 `(1) Subject to subsections (2) and (3), if the board fails to decide the 19 application within 60 days after its receipt, the failure is taken to be a 20 decision by the board to refuse to register the applicant as a non-practising 21 registrant. 22 `(2) Subsection (3) applies if the board has, under section 150E(1)(b), 23 required the applicant to give the board further information or a document. 24 `(3) The board is taken to have decided to refuse to register the applicant 25 as a non-practising registrant if it fails to decide the application by the day 26 that is 60 days after the board receives the further information or document. 27 `150G Forms of certificates of non-practising registration 28 `(1) A certificate of non-practising registration must be in the approved 29 form. 30
