(c) who has been excepted from the State Public Sector 19
Superannuation Scheme under section 3.4(4) of the 20
Superannuation (State Public Sector) Act 1990; and 21
(d) who is employed in the electricity supply industry; 22
becomes a member of the Queensland Electricity Supply Industry 23
Employees' Superannuation Scheme.'. 24

`16. Compliance with legislative requirements 3
(a) All buildings at the GPS on the Date of Transfer are taken to 4
comply with and to have complied with and not to breach and not 5
to have breached any statute, by-law, regulation, licence or lawful 6
order (whether current or repealed and whether or not binding on 7
the Crown) applying to the construction, modification, extension, 8
fire safety, occupation or use of those buildings. 9
(b) All certificates and approvals which were required to be issued or 10
given prior to the Date of Transfer (or which would have been 11
required to be issued if QEC or Queensland Electricity 12
Generating Board were not the Crown) under any statute, by-law, 13
regulation, licence or lawful order (whether current or repealed) 14
for the lawful construction, modification, extension, fire safety, 15
occupation or use of all buildings at the GPS on the Date of 16
Transfer are taken to have been duly issued or given.'. 17
7. Clause 22(b)(iii) (after `Agreement')-- 18
insert `(excluding the GPS Environmental Policy Schedule)'. 19

`(i) the maximum continuous capacity for Gladstone Power 22
Station will be the Net Maximum Capacity (as defined in the 23
Interconnection and Power Pooling Agreement) from time 24
to time under the Interconnection and Power Pooling 25
Agreement, together with the capacity of the gas turbine 26
associated with the Gladstone Power Station (nominally of 27
14MW) but in any event the Gladstone Power Station must 28
not exceed 6 operating units of a capacity each of nominally 29
280MW, together with the gas turbine of a capacity of 30
nominally 14MW associated with the Gladstone Power 31
Station;'. 32
