`54A Chief executive may issue guidelines 14
`(1) The chief executive may issue guidelines to inform persons about-- 15
(a) the attitude the chief executive is likely to adopt on a particular 16
matter; or 17
(b) how the chief executive administers this Act. 18

The chief executive might issue a guideline stating how the chief executive decides
21
applications for a decrease under section 86 for category 1 licensed premises.

Example 2--

The chief executive might issue a guideline about dealing with operating authorities
24
under this Act.
`(2) The chief executive must keep copies of the guidelines available for 25
inspection, free of charge, by members of the public at-- 26
(a) the department's head office and regional offices; and 27
(b) other places the chief executive considers appropriate. 28
`(3) Also, the chief executive must, if asked by a person, give the person 29
a copy of a guideline, or an extract from a guideline, free of charge.'. 30

7 Amendment of s 56 (Application for gaming machine licences)
Clause 1
(1) Section 56(1)(b) and (c)-- 2
omit, insert-- 3
`(b) the holder of a general liquor licence; or 4
(c) the holder of a prescribed liquor licence; or 5
(d) a body corporate that-- 6
(i) has applied to become the holder of a general liquor licence 7
or a club liquor licence; or 8
(ii) is the proposed transferee in a liquor licence transfer 9
application relating to a club liquor licence; or 10
(e) an individual who has applied to become the holder of a general 11
liquor licence; or 12
(f) the proposed transferee in a liquor licence transfer application 13
relating to a general liquor licence or prescribed liquor licence; 14
or 15
(g) a subsidiary operator, other than a subsidiary operator that is a 16
non-proprietary club.'. 17
(2) Section 56(2)(a), (b) and (c)-- 18

subsection (1)(a), (b) or (c)--premises specified in the 21
applicant's liquor licence; or 22

application for a liquor licence or the liquor licence transfer 25
application naming the applicant as the proposed transferee; or 26
(c) if the application is made by an applicant mentioned in 27

proposed transferee; or 30
(d) if the application is made by an applicant mentioned in 31
subsection (1)(g)--the part of special facility premises for which 32
the applicant is a subsidiary operator.'. 33

`(6) In subsection (2)(d), a reference to the part of special facility 3
premises for which an applicant for a gaming machine licence mentioned 4
in subsection (1)(g) is a subsidiary operator is a reference to-- 5
(a) the part of special facility premises the holder of the special 6
facility liquor licence for the premises has, with the approval of 7
the relevant chief executive, let or sublet to the applicant; or 8
(b) the part of special facility premises in relation to which the 9
holder of the special facility liquor licence for the premises has, 10
with the approval of the relevant chief executive, entered into a 11
franchise or management agreement with the applicant.'. 12

made for a gaming machine licence (a "new licence") to be issued at the 12
same time as the transfer of a liquor licence and an associated gaming 13

the transfer of the liquor licence. 15
`(5) All operating authorities, if any, for the licensed premises under the 16
cancelled associated gaming machine licence are transferred by operation 17
of this subsection to the holder of the new licence. 18
`(6) In subsection (5)-- 19
"operating authority", for the licensed premises under the cancelled 20
associated gaming machine licence, does not include an operating 21
authority that must be sold at an authorised sale.'. 22

the date of the sale. 27
`(2) However, subsection (1) does not apply to a licensee if the chief 28
executive is satisfied that compliance with the subsection is likely to 29
impose an unreasonable financial burden on the licensee.'. 30

`(1) The chief executive must consider a decrease proposal received by 5
the chief executive and either-- 6
(a) approve, by a stated number, a decrease in the approved number 7
of gaming machines for the licensed premises of the licensee; or 8
(b) refuse to approve a decrease in the approved number. 9
`(2) The chief executive-- 10
(a) may approve a decrease that is less than the decrease sought in a 11
decrease proposal; and 12
(b) must not, for category 1 licensed premises, approve a decrease 13
that is more than half the approved number of gaming machines 14
for the licensed premises immediately before the application for 15
the decrease is made. 16
`(3) If the decrease proposal is a request or report, the chief executive 17
must, before making a decision-- 18
(a) by written notice given to the licensee affected by the proposal-- 19
(i) advise the licensee of the relevant details of the proposal; 20
and 21
(ii) invite the licensee to give the chief executive a written 22
submission about the proposal within a reasonable time 23
stated in the notice; and 24
(b) consider any written submission of the licensee received within 25
the stated time. 26
`(4) If the decrease proposal is an application, the chief executive-- 27
(a) must not refuse to approve a decrease if the refusal is likely to 28
impose an unreasonable financial burden on the licensee; and 29
(b) must not approve a decrease that is greater than the decrease 30
sought in the application. 31
`(5) If the decrease proposal is an application by a category 1 licensee 32
and the decrease is approved under subsection (1)(a), the number of 33

operating authorities for the licensee's licensed premises that is more than 1
the approved number of gaming machines for the licensed premises must 2
be sold at an authorised sale. 3
`(6) If the decrease proposal is an application by a category 1 licensee, 4
the chief executive may, if asked in writing by the licensee at the time the 5
application is made, approve a decrease conditional on the sale of an 6
operating authority for the licensed premises under the licensee's gaming 7
machine licence for each gaming machine to be disposed of under the 8
approval. 9
`(7) If an approval is conditional as mentioned in subsection (6), the 10
approval has effect, in relation to each gaming machine to be disposed of 11
under the approval, when an operating authority for the gaming machine is 12
sold. 13
`(8) If the decrease proposal is a request or report relating to category 2 14
licensed premises, the chief executive may not approve a decrease if the 15
approval is likely to impose an unreasonable financial burden on the 16
licensee. 17
`88 Disposal of gaming machines for decrease proposal 18
`(1) If the chief executive approves a decrease in the approved number of 19
gaming machines for licensed premises of a licensee, the chief executive 20
must approve the way in which the gaming machines subject to the 21
decrease may be disposed of. 22
`(2) An approval under subsection (1) may provide for the disposal of the 23
gaming machines by the sale or destruction of the machines. 24
`88A Notice of decision about decrease proposal 25
`(1) The chief executive must immediately give written notice of a 26
decision under section 87(1) to the licensee if-- 27
(a) the decision relates to an application and is a decision approving 28
a decrease that is equal to the decrease sought in the application; 29
or 30
(b) the decision relates to a request or report and is a decision 31
refusing to approve a decrease. 32

`(2) The chief executive must immediately give the licensee an 1
information notice for a decision under section 87(1) if-- 2
(a) the decision relates to an application and is a decision-- 3
(i) refusing to approve a decrease; or 4
(ii) approving a decrease that is less than the decrease sought in 5
the application; or 6
(b) the decision relates to a request or report and is a decision 7
approving a decrease. 8
`(3) A notice under subsection (1) or (2) must include notice of, or be 9
accompanied by written notice of, any relevant approval of the chief 10
executive under section 88(1). 11
`88B Replacement licence for decrease proposal 12
`(1) This section applies if a licensee receives a notice under section 88A 13
relating to a decision approving a decrease for the licensee's licensed 14
premises. 15
`(2) The licensee must, within 7 days after receiving the notice, give to 16
the chief executive-- 17
(a) the licensee's gaming machine licence; and 18
(b) the fee prescribed under a regulation. 19
Maximum penalty--40 penalty units. 20
`(3) If the chief executive receives a gaming machine licence for a 21
licensee under subsection (2), the chief executive must as soon as 22
practicable-- 23
(a) replace the licensee's licence; and 24
(b) give the replacement licence to the licensee. 25
`(4) If the replacement licence is for category 1 licensed premises, the 26
replacement licence must include the information mentioned in 27
section 68(2)(d).'. 28

18 Amendment of s 95 (Surrender of gaming machine licences)

machine licence by giving the chief executive-- 5
(a) a notification in the approved form; and 6
(b) the gaming machine licence, unless the surrender is conditional 7
on the sale of the licensee's operating authorities.'. 8

`(2A) If a category 1 licensee surrenders the licensee's gaming machine 11
licence, all operating authorities for the licensed premises under the licence 12

subsection (1) may state the surrender is conditional on the sale of the 15
licensee's operating authorities for the licensed premises under the licence. 16
`(2C) If the notification states the surrender is conditional on the sale of 17
the licensee's operating authorities, the licensee must give the licence to the 18
chief executive immediately after the licensee is aware all the operating 19
authorities have been sold. 20

machines that is more than the licensee's endorsed number of 19

authority is purchased are located in the authority region for 23
which the authorised sale is conducted. 24

`109F When operating authorities become operating authorities of the 5
State 6
`(1) An operating authority of a licensee becomes an operating authority 7
of the State and stops being an operating authority of the licensee by 8
operation of this subsection if the licensee's gaming machine licence-- 9
(a) expires under section 72; or 10
(b) is not renewed under section 76; or 11
(c) lapses under section 80A(1); or 12
(d) is cancelled under section 96 because the licensee's liquor 13
licence is cancelled or surrendered; or 14
(e) is cancelled under section 97(16)(d) or (17)(a). 15
`(2) Subsection (3) applies if, at any time, the endorsed number of 16
operating authorities for licensed premises is more than the approved 17
number of gaming machines for the licensed premises because of-- 18
(a) the operation of section 80A(2) or 85AA(2) or (3); or 19
(b) the approval of a decrease proposal that is a request or report 20
under section 87(1);2 or 21
(c) other circumstances prescribed under a regulation. 22
`(3) The number of operating authorities that is more than the approved 23
number of gaming machines for the licensed premises stop being operating 24
authorities of a licensee and become operating authorities of the State by 25
operation of this subsection. 26

licensee's licensed premises are allocated to the licensee for the licensed 10
premises by operation of this subsection. 11
`410 Notice about registering for allocation of operating authorities 12
`As soon as practicable after the commencement, the chief executive 13
must give each category 1 licensee a written notice stating the licensee 14
must register for the allocation of operating authorities to the licensee 15
under section 409. 16
`411 Registration for allocation of operating authorities 17
`(1) A category 1 licensee must, within 28 days after receiving a notice 18
under section 410, register, in the approved form, for the allocation of 19
operating authorities to the licensee under section 409. 20

`(2) The registration happens by the licensee giving the approved form 22
properly completed to the chief executive. 23
`(3) The approved form must be accompanied by the licensee's gaming 24

`412 Chief executive to issue replacement gaming machine licence 3
`The chief executive must, as soon as practicable after the 4
commencement-- 5
(a) replace the gaming machine licence of each category 1 licensee; 6
and 7
(b) give the replacement licence to the licensee. 8
`413 Information for replacement gaming machine licence 9
`A replacement licence given to a licensee under section 412 must 10
state-- 11
(a) the number of operating authorities allocated to the licensee by 12
operation of section 409; and 13
(b) the registration number of each operating authority allocated to 14
the licensee; and 15
(c) the authority region in which the licensee's licensed premises are 16
located. 17
`Subdivision 3--Dealing with allocation disputes under Tribunal Act 18
`414 Jurisdiction of tribunal 19
`The tribunal's jurisdiction for this Act is limited to hearing and deciding 20
an allocation dispute between parties and matters relating or relevant to 21
hearing and deciding the dispute. 22
`415 Application of Tribunal Act 23
`Subject to this subdivision, the Tribunal Act applies to a proceeding 24
started under that Act for hearing and deciding an allocation dispute to the 25
extent the Tribunal Act is capable of applying. 26

`416 Application to tribunal 1
`(1) A party to an allocation dispute may, within the period prescribed 2
under a regulation, apply to the tribunal, under the Tribunal Act, 3
section 31,3 to hear and decide the dispute. 4
`(2) The application must be accompanied by the fee (the "mediation 5
fee") prescribed under a regulation. 6
`(3) Despite the Tribunal Act, section 31(1)(b), the applicant need not 7
pay the fee mentioned in that section to start a proceeding for an allocation 8
dispute. 9
`(4) If a party starts a proceeding under the Tribunal Act for an allocation 10
dispute-- 11
(a) the tribunal must give a copy of the application to the chief 12
executive; and 13
(b) each entity that is a respondent under the Tribunal Act in relation 14
to the proceeding, must, within 14 days after being served with a 15
copy of the application, also pay the mediation fee to the tribunal. 16
`417 Mediation of allocation dispute 17
`(1) This section applies if a party starts a proceeding under the Tribunal 18
Act for an allocation dispute. 19
`(2) Despite the Tribunal Act, section 117,4 the tribunal must under the 20
section, before hearing the dispute, appoint a mediator or mediators to try 21
to achieve a negotiated settlement of the proceeding. 22
`418 Proceeding before tribunal 23
`(1) This section applies if a party starts a proceeding under the Tribunal 24
Act for an allocation dispute and the dispute is not settled at mediation. 25
`(2) Each party to the proceeding must, within 7 days after the end of the 26
mediation, pay to the tribunal the fee (the "proceeding fee") prescribed 27
under a regulation. 28

`419 Allocation dispute to be taken to tribunal 1
`(1) Subject to this subdivision, a proceeding for an allocation dispute 2
must be heard and decided under the Tribunal Act. 3
`(2) Payment of a mediation fee or a proceeding fee in relation to a 4
proceeding under the Tribunal Act for an allocation dispute is not a 5
prerequisite for the tribunal appointing a mediator for the dispute or 6
hearing and deciding the dispute. 7
`(3) However, if a fee is not paid by a party, the fee is a debt due to the 8
State and may be recovered by the chief executive in a court having 9
jurisdiction for the recovery of the amount claimed. 10
`420 Orders relating to allocation dispute 11
`(1) Without limiting the Tribunal Act, section 50, the tribunal may

make an order in relation to an allocation dispute about dealing with 13
operating authorities of a party to the dispute, including, for example, an 14
order-- 15
(a) about the sharing, as between the parties, of any amounts payable 16
to a party under section 109E;6 or 17
(b) about compensating a party in another way for the sale or other 18
disposal of an operating authority. 19
`(2) Also, without limiting the Tribunal Act, section 50, the tribunal may, 20
in hearing and deciding an allocation dispute, consider the following 21
matters-- 22
(a) the terms of any lease, agreement or other arrangement between 23
the parties relating to the conduct of the business of gaming at 24
category 1 licensed premises; 25
(b) the effect a sale or other disposal of operating authorities would 26
have on the capacity of a party to the dispute to obtain finance 27
relating to the future use or development of the licensed 28
premises; 29

(c) a matter included in a guideline issued by the chief executive 1
under section 54A to the extent it is relevant; 2

`Subdivision 4--Other transitional matters 4
`421 Appeals 5
`(1) Subsection (2) applies if-- 6
(a) a person has appealed to the Minister before the commencement 7
against a decision of the commission made under the appeal 8
provision; and 9
(b) the appeal has not been decided before the commencement. 10
`(2) The Minister may hear, or continue to hear, and decide the appeal 11
under this Act as in force before the commencement. 12
`(3) Subsection (4) applies if-- 13
(a) immediately before the commencement a person could have 14
appealed against a decision of the commission made under the 15
appeal provision; and 16
(b) the person has not appealed before the commencement. 17
`(4) The person may appeal, and the Minister may hear and decide the 18
appeal, under this Act as in force before the commencement. 19
`(5) In deciding the appeal, the Minister may make any decision the 20
Minister could have made in relation to the appeal before the 21
commencement. 22
`(6) In this section-- 23
"appeal provision" means section 88(1) as in force before the 24
commencement. 25
`422 Applications for decrease proposal 26
`(1) This section applies if-- 27

(a) a licensee has applied, under section 86, to have the approved 1
number of gaming machines for licensed premises of the licensee 2
decreased; and 3
(b) the application has not been decided before the commencement. 4
`(2) The application must be dealt with under this Act as in force after 5
the commencement. 6

`Section 80B does not apply to a category 1 licensee until the licensee 8
receives a replacement licence under section 412(1) for the licensee's 9
licensed premises. 10
`424 Restriction on surrender of gaming machine licence for 11
category 1 licensed premises 12
`(1) Despite section 95, a category 1 licensee can not, without the chief 13
executive's written approval, surrender a gaming machine licence after the 14
commencement. 15
`(2) Subsection (1) ceases to apply to the category 1 licensee 16
immediately after-- 17
(a) if the licensee or another person has applied to the tribunal to 18
start a proceeding under the Tribunal Act for an allocation 19
dispute relating to the licence--the allocation dispute is decided 20
under the Tribunal Act; or 21
(b) otherwise--the end of the period prescribed under a regulation 22
for section 416(1). 23
`425 Disposal of gaming machines 24
`(1) This section applies if, before the commencement-- 25
(a) the commission approved a decrease in the approved number of 26
gaming machines for a licensed premises; and 27
(b) the required time under section 90 for disposing of the gaming 28
machines for the decrease has not ended. 29
`(2) The licensee for the licensed premises must dispose of the number 30
of gaming machines stated for the decrease within the required time. 31

`426 Directions relating to allocation dispute 1
`(1) If a category 1 licensee has not paid a mediation fee or a proceeding 2
fee payable to the tribunal, the chief executive may, by written notice, give 3
the licensee a direction to pay the fee. 4
`(2) Subsection (3) applies if, from information available to the chief 5
executive, the chief executive considers an allocation dispute exists. 6
`(3) The chief executive may, by written notice, given to the category 1 7
licensee who the chief executive believes is a party to the dispute a 8
direction to start a proceeding for an allocation dispute in the tribunal by 9
making an application under section 416 in relation to the dispute. 10
`427 Disclosure of information 11
`(1) A person who is a departmental officer may, to assist a party to an 12
allocation dispute to settle the dispute, disclose to the party information 13
that has come to the person's knowledge in the exercise of functions under 14
part 3 of this Act.7 15
`(2) For section 54(5)(a),8 a disclosure under subsection (1) is a 16
disclosure for a purpose under this Act.'. 17
