An Act to amend the Gaming Machine Act 1991

The Parliament of Queensland enacts-- 1

Short
Clause 1. This Act may be cited as the Gaming Machine Amendment Act 1998. 3

Clause 2. This Act commences on a day to be fixed by proclamation. 5

Clause 3. This Act amends the Gaming Machine Act 1991. 7

"linked jackpot arrangement" means an arrangement under which 2 or 19
more gaming machines are linked to a device recording a winning 20
result or other event resulting in an amount, part of an amount, or 21
something else, being won by a player. 22
"metered amount" means the amount displayed on the total wins meter of 23
a gaming machine or on a progressive jackpot prize meter. 24

"percentage return to player" see section 6C. 2
"progressive jackpot prize meter" means a device for recording amounts 3
that, if won by a player, would be payable by a licensee as a jackpot 4
payout. 5
"promotions" means an amount, part of an amount, or something else, 6
able to be won on a gaming machine, whether or not a winning result 7
is obtained, and made available by the licensee or licensed operator. 8
"total wins meter" means a device for recording amounts that, if won by a 9
player, would be payable by a licensee other than as a jackpot payout.'. 10

`6A.(1) For this Act, a "jackpot payout" is a payment by a licensee to a 27
player for a winning result on a gaming machine if the payment-- 28
(a) does not increase the credit meter of the gaming machine; and 29

(b) is not discharged from the hopper. 1
`(2) In this section, a payment by a licensee for a winning result does not 2
include a promotion. 3

`Meaning
`6B.(1) For this Act, "metered payouts", for a licensed premises for an 5
assessment period, means the metered amount won by players for winning 6
results on gaming machines on the premises in the assessment period. 7
`(2) In this section, the metered amount won does not include an amount 8
payable under this Act from an approved trust account. 9

for subleasing the machine to a licensee for the conduct of 10
gaming or a gaming trainer for conducting a genuine training 11

(i) a licensed operator for subleasing the machine to a licensee 15
for the conduct of gaming or a gaming trainer for conducting 16

(ii) another approved financier for subleasing to-- 19
(A) a licensed operator for further subleasing by the 20
operator to a licensee for the conduct of gaming or a 21
gaming trainer for conducting a genuine training course 22
relating to the conduct of gaming; or 23
(B) a licensee for the conduct of gaming; or 24
(C) a gaming trainer for conducting a genuine training 25
course relating to the conduct of gaming; or 26
(iii) a licensee for the conduct of gaming; or 27
(iv) a gaming trainer for conducting a genuine training course 28
relating to the conduct of gaming; or'. 29

(a) a licensed operator can sublease a gaming machine only to a 1
licensee or a gaming trainer; and 2
(b) an approved financier can sublease a gaming machine only to a 3
licensed operator, licensee or gaming trainer; and 4
(c) a licensee and a gaming trainer cannot lease a gaming machine to 5
another person. 6
`(1E) A licensed operator's right to sublease or further sublease a 7
gaming machine to someone else is subject to the lease or sublease under 8
which the operator leases the gaming machine. 9
`(1F) An approved financier's right to sublease a gaming machine to 10
someone else is subject to the lease under which the financier leases the 11
gaming machine.'. 12

(i) if an audit under subsection (2)(b) has been done--starting 16
on the day to which the accounts were last audited under 17
subsection (2)(b) and ending on the day the former licensee 18
ceased to be a licensee; or 19
(ii) if an audit under subsection (2)(b) has not been 20
done--starting on the day gaming started and ending on the 21
day the former licensee ceased to be a licensee; and 22
(b) cause the accounts for the gaming and the conduct of gaming to 23
be audited by an accountant. 24

(d) a statutory declaration signed by the principal executive officer of 17
the licensee declaring that the proceeds from the conduct of 18
gaming were spent promoting the objects of the licensee; and 19
