The Parliament of Queensland enacts-- 1

Short
1. This Act may be cited as the Fair Trading Amendment Act 1994. 3

2. This Act amends the Fair Trading Act 1989. 5

` "code of practice" means a code of practice prescribed by regulation 9

"Court" in sections 98, 100 and 102 has the meaning given by section 103; 12
"interest" in land includes a right to occupy the land, or a building or part 13
of a building on the land, conferred by shares, or under a contract to 14
purchase shares, in a corporation that owns the land or building;1'. 15

`Meaning
`6.(1) In this Act-- 2
"consumer" means a person who, in a particular transaction, whether a 3
separate contract or separate transaction within a contract, acquires 4
goods or services or an interest in land as a consumer. 5
`(2) A person acquires goods or services or an interest in land as a 6
consumer under subsection (1) if-- 7
(a) the person-- 8
(i) is an individual; and 9
(ii) acquires the goods, services or interest otherwise than for a 10
business carried on by the person, whether as an individual 11
or a member of a business partnership; or 12
(b) the price of the goods, services or interest is not more than 13
$40 000. 14
`(3) If a person acquires goods for resupply by way of sale, exchange, 15
lease, hire or hire-purchase, the person does not acquire the goods as a 16
consumer. 17
`(4) For the purposes of subsection (2)(b), if the price of goods or 18
services or an interest in land cannot be decided by reference to a cash price 19
specified in the contract concerned, the price is taken to be the reasonable 20
cash price having regard to the circumstances of the case. 21
`(5) If it is claimed in a proceeding or about an issue under this Act that a 22
person is a consumer of particular goods or services or an interest in land, it 23
must be presumed unless the contrary is proved that the person is a 24
consumer of the goods, services or interest.'. 25

the sale or grant, or the possible sale or grant, of an interest in land or in 22
connection with the promotion in any way of the sale or grant of an interest 23

(a) represent that the person has a sponsorship, approval or affiliation 25
the person does not have; or 26
(b) make a false or misleading representation about-- 27
(i) the nature of the interest in land; or 28
(ii) the price payable for the land; or 29

(iii) the location of the land; or 1
(iv) the characteristics of the land; or 2
(v) the use to which the land is capable of being put or may 3
lawfully be put; or 4
(vi) the existence or availability of facilities associated with the 5
land; or 6
(c) offer gifts, prizes or other free items with the intention of not 7
providing them or of not providing them as offered; or 8
(d) in Queensland do anything to cause a representation mentioned in 9
paragraph (a) or (b), or an offer mentioned in paragraph (c), to be 10
made outside Queensland. 11
`(2) A person must not use physical force, undue harassment or coercion 12
in connection with the sale or grant, or the possible sale or grant, of an 13
interest in land or the payment for an interest in land. 14
`(3) This section does not imply that other provisions of this Act do not 15
apply to the supply or acquisition, or the possible supply or acquisition, of 16
interests in land.'. 17

`85A.(1) The Minister may make an interim order under section 85(1). 14
`(2) Section 85(2) to (4A) does not apply to an interim order. 15
`(3) The Minister may make an interim order only if-- 16
(a) the Committee, after a reference is made to it under section 32, 17
recommends to the Minister or Commissioner that an order 18
under section 85(1) be made about the goods or services 19
concerned; or 20
(b) the supply of the goods or services concerned is prohibited or 21
restricted on a permanent or interim basis under a law of the 22
Commonwealth, another State or a Territory corresponding to 23
this Division. 24
`(4) To give effect to an interim order, the Minister may-- 25
(a) if the order relates to goods or services supplied by a particular 26
supplier--give written notice of the interim order to the supplier; 27
or 28
(b) in any case--publish the interim order in the Gazette. 29

`(5) An interim order stops having effect at the end of 42 days. 1
`(6) An interim order may be renewed on the recommendation of the 2
Committee. 3
`(7) An interim order may only be renewed once. 4
`(8) Sections 43 to 45 of the Statutory Instruments Act 1992 apply to an 5
interim order published in the Gazette as if it were subordinate legislation.2'. 6

`Examination
`103A.(1) In this section-- 22

`(2) The Commissioner may recover from a person who supplies goods 3
or services the Commissioner's reasonable costs of an examination of the 4
goods or services if the examination-- 5
(a) assists in establishing that the goods or services do not comply 6
with an information or safety standard applying to their supply; or 7
(b) results in an order being made under section 85 about the goods 8
or services. 9
`(3) Also, the Commissioner may recover from a person who gives to 10
an inspector false or misleading information, records or a copy of records in 11
contravention of this Act the Commissioner's reasonable costs of an 12
examination that assists in establishing the contravention had happened. 13
`(4) Costs recoverable under this section may be recovered-- 14
(a) as a debt payable to the Commissioner; or 15
(b) in a proceeding mentioned in subsection (6). 16
`(5) Before starting a proceeding to recover costs from a person under 17
this section, the Commissioner must give the person the Commissioner's 18
signed certificate-- 19
(a) outlining the examination; and 20
(b) stating the amount of the costs of the examination. 21
`(6) On application by the Commissioner, a court that finds a person 22
guilty of an offence against this Act may order the person to pay the 23
Commissioner the cost of an examination that assisted in establishing that 24
the offence had happened.'. 25

information about the supply or possible supply of goods to the Minister, 7
