This part amends the Fluoridation of Public Water Supplies 9
Act 1963. 10

`controlling entity, for a public water supply, means-- 14
(a) if the public water supply is under the control of a local 15
government--the local government; or 16
(b) if the public water supply is under the control of another 17
entity--the other entity.'. 18

`3 Adding fluorine to public water supplies 1
`(1) A controlling entity for a public water supply must add 2
fluorine, in a form prescribed under a regulation, to the public 3
water supply. 4
`(2) The controlling entity for a public water supply must maintain 5
the content of fluorine in the public water supply at a 6
concentration of not more than the maximum or less than the 7
minimum prescribed under a regulation. 8
`(3) However, subsections (1) and (2) do not apply to a controlling 9
entity for a public water supply if the public water supply is 10
used for supplying water to fewer than the number of persons 11
prescribed under a regulation. 12
`(4) A controlling entity for a public water supply must not add 13
fluorine to the public water supply, other than as provided by 14
this section.'. 15
