The Parliament of Queensland enacts-- 1
Clause 1 Short title 2
This Act may be cited as the Freedom of Information 3
Amendment Act 2004. 4
Clause 2 Act amended 5
This Act amends the Freedom of Information Act 1992. 6
Clause 3 Insertion of new s 47A 7
After section 47-- 8
insert-- 9
`47A Matter relating to investment incentive scheme 10
`(1) Matter is exempt matter if its disclosure could reasonably be 11
expected to disclose information about-- 12
(a) a particular incentive given to or arranged for a relevant 13
person under an investment incentive scheme; or 14
(b) an incentive sought by or proposed for a relevant person 15
whether or not an incentive was, in fact, given to or 16
arranged for the relevant person under an investment 17
incentive scheme. 18
`(2) In this section-- 19
department means the department in which the State 20
Development and Public Works Organisation Act 1971 is 21
administered. 22
incentive includes any of the following-- 23
(a) an amount that is a refund of all or part of an amount 24
paid as a tax, fee or charge; 25
(b) another amount, whether as a lump sum or by 26
instalments; 27
(c) a benefit that is not an amount mentioned in paragraph 28
(a) or (b). 29

investment incentive scheme means a written scheme to 1
promote projects by providing incentives, that includes 2
processes for assessing an application under the scheme and is 3
administered by the department. 4
project means a project or proposed project that involves 5
investing or spending money, or the continued investing or 6
spending of money, and is intended to create job opportunities 7
or to continue existing jobs. 8
relevant person means a person to the extent the person is or 9
was any 1 or more of the following-- 10
(a) a person who inquires of, or enters into discussions 11
with, the department or a public service employee about 12
an incentive for a project, whether or not the person 13
makes an application under an investment incentive 14
scheme for an incentive; 15
(b) a person who makes an application under an investment 16
incentive scheme, whether or not the person is given an 17
incentive; 18
(c) a person who is given an incentive for a project, whether 19
or not the person continues to be subject to a provision 20
of an agreement about the incentive that allows the 21
department to monitor the person or project.'. 22
