of the GST on home ownership, by establishing a scheme for the
payment of grants to first home owners

Meaning
4. The "eligibilitycriteria" are the criteria, under part 3, division 2, for 13
deciding whether an applicant for a first home owner grant is eligible for the 14
grant. 15

Meaning
5.(1) An "eligible transaction" is-- 17

(a) a contract made on or after 1 July 2000 for the purchase of a 1
home in the State; or 2
(b) a comprehensive home building contract made on or after 1 July 3
2000 by the owner of land in the State, or a person who will on 4
completion of the contract, be the owner of land in the State, to 5
have a home built on the land; or 6
(c) the building of a home in the State by an owner builder if the 7
building work starts on or after 1 July 2000. 8
(2) For subsection (1)(a), a contract is a contract for the purchase of a 9
home if the contract is a contract for the acquisition of a relevant interest in 10
land-- 11
(a) on which a home is built; or 12
(b) on which a home is to be built, before completion of the contract, 13
by or for the vendor and at the expense of the vendor. 14
(3) If, on or after 1 July 2000, a person purchases a building and intends 15
to use it as a place of residence on land in which the person has a relevant 16
interest but on which it is not situated at the time of purchase, the contract 17
for the purchase of the building is taken to be a contract to have a home 18
built. 19
(4) However, a contract is not an eligible transaction if the commissioner 20
is satisfied it forms part of a scheme to circumvent limitations on, or 21
requirements affecting, eligibility or entitlement to a first home owner grant. 22
(5) Unless satisfied to the contrary, the commissioner must presume the 23
existence of a scheme mentioned in subsection (4) if-- 24
(a) for a contract to purchase a home--the purchaser had an option to 25
purchase the home granted before 1 July 2000 or the vendor had 26
an option to require the purchaser to purchase the home granted 27
before that date; or 28
(b) for a comprehensive home building contract--either party had a 29
right or option granted before 1 July 2000 to require the other to 30
enter into the contract. 31

of "home" 1
Meaning
6. A "home" is a building, fixed to land, that-- 2
(a) may lawfully be used as a place of residence; and 3
(b) is a suitable building for use as a place of residence. 4
of "home owner" or "owner" of a home 5
Meaning
7. A person is a "home owner" or "owner" of a home if the person has 6
a relevant interest in the land on which the home is built. 7
of "relevant interest" 8
Meaning
8.(1) A "relevant interest" in land1 is-- 9
(a) an estate in fee simple in the land; or 10
(b) a life estate in the land; or 11
(c) a perpetual lease of the land granted by the Commonwealth or the 12
State; or 13
(d) a leasehold interest in the land granted by the Commonwealth or 14
the State that may be converted into an estate in fee simple under 15
the terms of the lease or the Act under which the lease is granted; 16
or 17
(e) a term lease for pastoral purposes granted under the Land Act 18
1994; or 19
(f) an interest as purchaser under-- 20
(i) a contract for the purchase from the Commonwealth or the 21
State, or any Commonwealth or State instrumentality or 22
authority, of an estate in fee simple in the land by 23
instalments; or 24
(ii) an instalment contract under the Property Law Act 1974, 25
part 6, division 4, for the purchase of an estate in fee simple 26
in the land; or 27

(g) a licence or right of occupancy granted by the Commonwealth or 1
the State, or any Commonwealth or State instrumentality or 2
authority, that gives, in the commissioner's opinion, the licensee 3
or the holder of the right reasonable security of tenure; or 4
(h) an interest in a company's shares if the commissioner is satisfied 5
that-- 6
(i) the interest entitles the holder of the interest to exclusive 7
occupation of a specified home owned by the company; and 8
(ii) the value of the shares is not less than the value of the 9
company's interest in the home; or 10
(i) another interest declared by regulation to be a relevant interest. 11
(2) However-- 12
(a) an interest is not a relevant interest at a particular time unless the 13
holder of the interest has, or will have within 1 year after that 14
time, a right to immediate occupation of the land; and 15
(b) an interest is not a relevant interest in the hands of a person who 16
holds it subject to a trust. 17
(3) A regulation under subsection (1)(i) may declare an interest to be a 18
relevant interest in land even though the interest may not be recognised at 19
law or in equity as an interest in land. 20
(4) If a person holds an interest in land on trust as guardian for a person 21
under a legal disability and the interest would be a relevant interest if it were 22
not for subsection (2)(b)-- 23
(a) the person under the legal disability is taken to be the person who 24
holds a relevant interest in the land; and 25
(b) the guardian is taken not to hold the interest. 26
of "spouse" 27
Meaning
9.(1) Subject to subsections (4) and (5), a "spouse" is a person who is-- 28
(a) married; or 29
(b) a de facto spouse. 30
(2) For subsection (1)(b), a de facto spouse is either 1 of 2 persons, 31

whether of the same or the opposite sex, who are living or have lived 1
together as a couple for at least 2 years. 2
(3) For subsection (2)-- 3
(a) 2 persons are a couple if they live together on a genuine domestic 4
basis in a relationship based on intimacy, trust and personal 5
commitment to each other; and 6
(b) 2 persons are not a couple only because they are cotenants. 7
(4) Subsection (5) applies if the commissioner is satisfied, when deciding 8
an application for a first home owner grant, an applicant for the grant-- 9
(a) is married but is living apart from the person to whom the 10
applicant is married; and 11
(b) they have no intention of again living together as a couple. 12
(5) The person to whom the applicant is married must not be regarded as 13
the applicant's spouse. 14

10.(1) A first home owner grant is payable on an application under this 18
Act if-- 19
(a) the applicant or, if there are 2 or more of them, each of the 20
applicants complies with the eligibility criteria; and 21
(b) the transaction for which the grant is sought-- 22
(i) is an eligible transaction; and 23
(ii) has been completed.2 24

(2) Despite subsection (1)(a), an applicant need not comply with the 1
eligibility criteria to the extent the applicant is exempted from compliance 2
under this Act. 3
(3) Only 1 first home owner grant is payable for the same eligible 4
transaction. 5
Division 2--Eligibility criteria--applicants 6
1--Applicant to be a natural person 7
Criterion
11. An applicant for a first home owner grant must be a natural person. 8
2--Applicant to be Australian citizen or permanent resident 9
Criterion
12.(1) Subject to subsection (2), an applicant for a first home owner grant 10
must be an Australian citizen or a permanent resident. 11
(2) If an application is made by joint applicants and 1 of the applicants is 12
an Australian citizen or a permanent resident, it is not necessary for the other 13
or others to be Australian citizens or permanent residents. 14
3--Applicant or applicant's spouse must not have received 15

13.(1) An applicant is ineligible if-- 17
(a) the applicant or the applicant's spouse has been a party to an 18
earlier application under this Act or a corresponding law; and 19
(b) a grant was paid on the application. 20
(2) However, an applicant is not ineligible if the grant was paid but later 21
paid back under the conditions on which the grant was made. 22
4--Applicant or applicant's spouse must not have had 23

14.(1) An applicant is ineligible if the applicant or applicant's spouse has, 25
before 1 July 2000, held-- 26

(a) a relevant interest in residential property in Queensland; or 1
(b) an interest in residential property in another State that is a relevant 2
interest under a corresponding law of that State. 3
(2) However, the applicant is not ineligible if-- 4
(a) the relevant interest is an interest as purchaser of an estate in fee 5
simple in land under a contract mentioned in section 8(1)(f); and 6
(b) the contract was terminated within 1 year after the contract was 7
entered into; and 8
(c) the applicant or applicant's spouse did not acquire an estate in fee 9
simple in the land. 10
(3) For subsection (1), in deciding whether an applicant held a relevant 11
interest, under this Act or a corresponding law, in residential property at a 12
particular time, any deferment of the applicant's right of occupation, because 13
the property was subject to a lease, must be disregarded. 14
(4) An applicant is ineligible if the applicant or the applicant's spouse has, 15
on or after 1 July 2000 and before the date on which the application is made, 16
held an interest in property (other than the property to which the application 17
relates) used at any time on or after 1 July 2000 as the residence of the 18
applicant or the applicant's spouse, being-- 19
(a) a relevant interest in residential property in Queensland; or 20
(b) an interest in residential property in another State that is a relevant 21
interest under the corresponding law of that State. 22
5--Residence requirement 23
Criterion
15.(1) An applicant for a first home owner grant must occupy the home 24
to which the application relates as the applicant's principal place of residence 25
within 1 year after completion of the eligible transaction or a longer period 26
approved by the commissioner. 27
(2) The commissioner may exempt an applicant from the residence 28
requirement if-- 29
(a) the applicant is 1 of 2 or more joint applicants for a first home 30
owner grant; and 31
(b) at least 1 of the applicants complies with the residence 32

requirement; and 1
(c) the commissioner is satisfied there are good reasons to exempt 2
the applicant from the residence requirement. 3
Division 3--Application for grant 4

Application
16.(1) An application for a first home owner grant must be made to the 6
commissioner or an agent of the commissioner. 7
(2) The application must be-- 8
(a) in the approved form; and 9
(b) supported by the information required by the commissioner. 10
(3) The application may only be made within a period (the "application 11
period")-- 12
(a) starting on the commencement date of the eligible transaction to 13
which the application relates; and 14
(b) ending 1 year after the completion of the eligible transaction to 15
which the application relates. 16
(4) However, the commissioner may allow an application to be made 17
before or after the application period. 18

17.(1) All interested persons must be applicants. 20
(2) For subsection (1), an interested person is a person who is, or will be, 21
on completion of the eligible transaction to which the application relates, an 22
owner of the relevant home, other than a person prescribed under a 23
regulation. 24

18.(1) An application may be made on behalf of a person under a legal 26
disability by a guardian. 27

(2) For deciding eligibility, the person under the legal disability must be 1
regarded as the applicant. 2

Commissioner
19.(1) If the commissioner is satisfied a first home owner grant is 5
payable on an application, the commissioner must authorise the payment of 6
the grant. 7
(2) The commissioner may authorise the payment of the grant before the 8
completion of the eligible transaction if the commissioner is satisfied it is 9
appropriate in particular circumstances. 10

20. The amount of a first home owner grant is the lesser of the 12
following-- 13
(a) the consideration for the eligible transaction; 14
(b) $7 000. 15

Payment
21.(1) A first home owner grant must be paid by electronic funds 17
transfer, cheque or in any other way the commissioner considers 18
appropriate. 19
(2) A first home owner grant must be paid to-- 20
(a) the applicant; or 21
(b) someone else to whom the applicant directs in writing the grant be 22
paid. 23
(3) If the applicant requests, the commissioner may apply the amount of 24
a first home owner grant, or part of the amount, towards a liability for State 25
taxes, fees or charges. 26

in anticipation of compliance with residence requirement 1
Payment
22.(1) The commissioner may authorise payment of a first home owner 2
grant in anticipation of compliance with the residence requirement if the 3
commissioner is satisfied each applicant intends to occupy the home as his 4
or her principal place of residence within 1 year after completion of the 5
eligible transaction or a longer period allowed by the commissioner. 6
(2) If a first home owner grant is paid in anticipation of compliance with 7
the residence requirement, the payment is made on condition that, if the 8
residence requirement is not complied with, the applicants must within 9
14 days after the relevant date-- 10
(a) give written notice of that fact to the commissioner; and 11
(b) repay the amount of the grant. 12
(3) For subsection (2), the relevant date is the earlier of the following-- 13
(a) the end of the period allowed for compliance with the residence 14
requirement; 15
(b) the date on which it first becomes apparent that the residence 16
requirement will not be complied with during the period allowed 17
for compliance. 18
(4) For a joint application, each applicant is individually liable to comply 19
with the requirements under subsection (2)(a) and (b) but compliance by 20
any 1 or more of them must be regarded as compliance by both or all. 21
(5) A person must not, without reasonable excuse, fail to comply with a 22
condition mentioned in subsection (2). 23

Conditions
23.(1) The commissioner may authorise the payment of a first home 26
owner grant on the reasonable conditions the commissioner considers 27
appropriate. 28
(2) A condition imposed by the commissioner, under this section or 29
another provision of this Act, may require a person on whose application 30
the first home owner grant is paid-- 31
(a) to give notice of non-compliance with the condition within a 32

period stated in the condition; and 1
(b) to repay the grant within a period stated in the condition. 2
(3) For a joint application, each applicant is individually liable to comply 3
with a requirement under subsection (2) but compliance by any 1 or more 4
of them must be regarded as compliance by both or all. 5
(4) A person must not, without reasonable excuse, fail to comply with a 6
condition imposed by the commissioner, under this section or another 7
provision of this Act. 8

Death
24.(1) An application for a first home owner grant does not lapse because 11
an applicant dies before the application is decided. 12
(2) If an applicant dies before the application is decided, the following 13
provisions apply-- 14
(a) if the deceased was 1 of 2 or more applicants and 1 or more 15
applicants survive--the application must be dealt with as if the 16
surviving applicants were the sole applicants; 17

authorised officer considers it necessary because of-- 13
(a) urgent circumstances; or 14

(2) Before applying for the special warrant, the authorised officer must 17
prepare an application stating the grounds on which the warrant is sought. 18
(3) The authorised officer may apply for the warrant before the 19
application is sworn. 20
(4) After issuing the special warrant, the magistrate must immediately 21
fax a copy to the authorised officer if it is reasonably practicable to fax the 22
copy. 23
(5) If it is not reasonably practicable to fax a copy to the authorised 24
officer-- 25
(a) the magistrate must tell the authorised officer-- 26
(i) what the terms of the warrant are; and 27
(ii) the date and time the warrant is issued; and 28
(b) the authorised officer must complete a form of warrant (a 29
"warrant form") and write on it-- 30

to the magistrate-- 8
(a) the sworn application; and 9
(b) if the authorised officer completed a warrant form--the 10
completed warrant form. 11
(8) On receiving the documents, the magistrate must attach them to the 12
warrant. 13
(9) A court must find the exercise of the power by an authorised officer 14
was not authorised by a special warrant if-- 15
(a) an issue arises in a proceeding before the court whether the 16
exercise of the power was authorised by a special warrant; and 17
(b) the warrant is not produced in evidence; and 18
(c) it is not proved by the person relying on the lawfulness of the 19
entry that the authorised officer obtained the warrant. 20

38.(1) This section applies if an authorised officer named in a warrant 22
issued under this subdivision for a place is intending to enter the place under 23
the warrant. 24
(2) Before entering the place, the authorised officer must do or make a 25
reasonable attempt to do the following things-- 26
(a) identify himself or herself, and anyone else helping the authorised 27
officer, to a person present at the place who is an occupier of the 28
place by producing the authorised officer's identity card; 29
(b) give the person a copy of the warrant or, if the entry is authorised 30
by a facsimile warrant or warrant form mentioned in 31
s 39 25 s 39

(c) tell the person the authorised officer is permitted by the warrant to 2

if the authorised officer believes on reasonable grounds that immediate entry 7
to the place is required to ensure the effective execution of the warrant is not 8
frustrated. 9
Subdivision 4--Powers of authorised officers on entry to places 10

39.(1) An authorised officer who enters a place under subdivision 3 may 12
exercise any of the following powers-- 13
(a) search any part of the place; 14
(b) inspect, examine, photograph or film a document or anything in 15
the place; 16
(c) take extracts from, and make copies of, any document in the 17

(d) take into the place any equipment and materials the authorised 19
officer reasonably requires for exercising a power under this 20
division; 21
(e) require a person in the place to-- 22
(i) give the authorised officer reasonable help to exercise the 23
powers mentioned in paragraphs (a) to (d); or 24
(ii) answer questions relevant to the investigation. 25
(2) When making a requirement mentioned in subsection (1)(e), the 26
authorised officer must warn the person it is an offence to fail to comply 27
with the requirement unless the person has a reasonable excuse. 28
(3) A person required to give reasonable help under subsection (1)(e)(i) 29
or answer a question under subsection (1)(e)(ii) must comply with the 30

(a) an authorised officer damages property when exercising or 10
purporting to exercise a power under this division; or 11
(b) a person (the "other person") acting under the direction of an 12

(2) The authorised officer must promptly give written notice of 14
particulars of the damage to the person who appears to the authorised officer 15
to be the owner of the property. 16
(3) If the authorised officer believes the damage was caused by a latent 17
defect in the property or circumstances beyond the control of the authorised 18
officer, contractor or other person, the authorised officer may state it in the 19
notice. 20
(4) If, for any reason, it is impracticable to comply with subsection (2), 21
the authorised officer must leave the notice in a conspicuous position and in 22
a reasonably secure way where the damage happened. 23
(5) This section does not apply to damage the authorised officer 24
reasonably believes is trivial. 25
(6) In subsection (2)-- 26

41.(1) A person may claim from the commissioner the cost of repairing 2
or replacing property damaged because of the exercise or purported exercise 3
of a power under this division. 4
(2) The cost may be claimed and ordered to be paid in a proceeding-- 5
(a) brought in a court with jurisdiction for the recovery of the amount 6
claimed; or 7
(b) for an offence against this Act brought against the person 8
claiming the amount. 9
(3) A court may order an amount be paid only if it is satisfied it is just to 10

written notice, impose a penalty of not more than the error amount (a 8
"penalty amount"). 9

to make a repayment required under subsection (1) or the conditions of the 11
grant, the commissioner may, by written notice impose a penalty of not 12
more than the error amount (also a "penalty amount"). 13
(4) If the error amount was paid to a third party, the commissioner, may 14
by written notice, require the third party to repay the amount to the 15
commissioner. 16

(a) the reasons for the decision to require the payment; 18

(c) an amount a third party is required, under section 47(4), to pay to 29

(3) The registrar must register the charge over the land if the 15
commissioner lodges with the registrar-- 16
(a) a request to register the charge in the appropriate form over the 17
land; and 18
(b) a certificate stating that-- 19
(i) the amount stated in the certificate is owing in relation to the 20
charge over the land; and 21
(ii) there is a charge over the land under this section. 22
(4) The commissioner must, as soon as practicable after payment of the 23
amount, lodge with the registrar-- 24
(a) a request to release the charge in the appropriate form; and 25
(b) a certificate stating that the amount owing in relation to the charge 26
over the land has been paid. 27

66.(1) The commissioner may, on behalf of the State, enter into an 16
agreement with a financial institution or other person for performing 17
functions related to administering the scheme for payment of first home 18
owner grants established under this Act. 19
(2) The commissioner may, at any time, revoke the agreement. 20

67.(1) An official is not civilly liable for an act done, or omission made, 22
honestly and without negligence under this Act. 23
(2) If subsection (1) prevents a civil liability attaching to an official, the 24
liability attaches instead to the State. 25

(3) In this section-- 1
"official" means-- 2
(a) the commissioner; or 3
(b) an authorised officer; or 4
(c) an officer or employee of the department to whom the 5
commissioner has, under section 65, delegated powers. 6

68.(1) This section applies to a person who-- 8
(a) is or has been engaged in the administration of this Act, including 9
an employee of an agent of the commissioner; or 10
(b) has obtained access to confidential information, whether directly 11
or indirectly, from a person mentioned in paragraph (a). 12
(2) The person must not disclose confidential information acquired by the 13
person to anyone else other than under subsection (3). 14

(3) The person may disclose confidential information-- 16
(a) at the request, or with the consent of, the person to whom the 17
information relates or someone else acting on the person's behalf; 18
or 19
(b) if the disclosure is expressly permitted or required under another 20
Act; or 21
(c) in connection with the administration or enforcement of-- 22
(i) this Act or a corresponding law; or 23
(ii) a taxation law of the Commonwealth or a State; or 24
(d) for any legal proceeding. 25
(4) In this section-- 26
"confidential information" means information-- 27
(a) given in an application for a first home owner grant; or 28

71.(1) The Governor in Council may make regulations under this Act. 13
(2) A regulation may provide for a maximum penalty of not more than 14
20 penalty units for a contravention of a regulation. 15

(a) whether an application under this Act or a corresponding law for a 17
first home owner grant has been properly made; or 18
(b) whether an objection to a decision made under this Act or a 19
corresponding law should be upheld; or 20
(c) whether an applicant to whom, or for whose benefit, a first home 21
owner grant has been paid under this Act or a corresponding law 22
was eligible for the grant; or 23
(d) whether a condition on which a first home owner grant has been 24
paid under this Act or a corresponding law has been complied 25
with; or 26
(e) another matter reasonably related to the administration or 27
enforcement of this Act or a corresponding law. 28

"authorised officer" means a person appointed as an authorised officer 1
under section 26. 2
"building" includes part of a building. 3
"commencement date", for an eligible transaction, means-- 4
(a) for a contract for the purchase of a home or to have a home 5
built--the date when the contract is made; or 6
(b) for the building of a home by an owner builder-- 7
(i) the date when laying the foundations for the home starts; or 8
(ii) another date the commissioner considers appropriate in the 9
circumstances of the case. 10
"commissioner" means the commissioner of stamp duties under the Stamp 11
Act 1894. 12
"completed", for an eligible transaction, means-- 13
(a) for a contract for the purchase of a home-- 14
(i) when the purchaser becomes entitled to possession of the 15
home under the contract; and 16
(ii) if the purchaser is to obtain a registered title to the land on 17
which the home is built--the purchaser's title is registered; 18
or 19
(b) for a contract to have a home built--when the building is ready 20
for occupation as a home and any prescribed completion 21
requirements are complied with; or 22
(c) for the building of a home by an owner builder--when the 23
building is ready for occupation as a home and any prescribed 24
completion requirements are complied with. 25
"comprehensive home building contract" means a contract under which 26
a builder undertakes to build a home from the start of building work to 27
the point where the home is ready for occupation and, if for any 28
reason, the work to be carried out under the contract is not completed, 29
includes any further contract under which the work is to be completed. 30
"consideration", for an eligible transaction, means-- 31

(a) for a contract for the purchase of a home--the consideration for 1
the purchase; or 2
(b) for a contract to have a home built--the total consideration 3
payable for the building work; or 4
(c) for the building of a home by an owner builder--the actual costs 5
to the owner of carrying out the work, excluding any allowance 6
for the owner builder's own labour. 7
"corresponding law" means an Act of another State corresponding to this 8
Act. 9
"eligibility criteria" see section 4. 10
"eligible transaction" see section 5. 11
"first home owner grant" means a grant payable under part 3. 12
"guardian", of a person under a legal disability, includes a trustee who 13
holds property on trust for the person under an instrument of trust or 14
by order or direction of a court or tribunal. 15
"home" see section 6. 16
"home owner" see section 7. 17
"obstruct" includes hinder and attempt to obstruct or hinder. 18
"occupier", of a place, includes the person apparently in charge of the place. 19
"option", to purchase, includes a right of preemption and right of first 20
refusal. 21
"owner" means-- 22
(a) for a home--see section 7; or 23
(b) for land--a person who has a relevant interest in the land. 24
"owner builder" means an owner of land who builds a home, or has a 25
home built, on the land without entering into a comprehensive home 26
building contract. 27
"penalty amount" see section 47(2) and (3). 28
"permanent resident" means the holder of a permanent visa as defined by 29

"place" includes the following-- 2
(a) vacant land; 3
(b) premises; 4
(c) a vehicle; 5
(d) a boat; 6

"premises" includes the following-- 8
(a) a building or structure of any kind; 9
(b) the land on which a building or structure is situated. 10
"prescribed completion requirements", for completion of an eligible 11
transaction, means requirements prescribed under a regulation. 12
"public place" means a place the public is entitled to use or is open to, or 13
used by, the public, whether or not on payment of an admission fee. 14
"registrar" means the registrar of titles or another person responsible for 15
keeping a register for dealings in land. 16
"relevant interest" see section 8. 17
"residence requirement" means the requirement that an applicant for a 18
first home owner grant must occupy the home to which the application 19
relates as the applicant's principal place of residence within 1 year after 20
the completion of the eligible transaction or a longer period approved 21
by the commissioner (see section 15). 22
"residential property" means land in Australia that, at a particular time, 23
has a building on it that is lawfully occupied as a place of residence or 24
is suitable for occupation as a place of residence. 25
"spouse" see section 9. 26
"structure" includes part of a structure. 27

"taxation law" means a law for the assessment or imposition of a tax, fee, 1
