An Act to amend the First Home Owner Grant Act 2000

The Parliament of Queensland enacts-- 1
1 Short title
Clause 2
This Act may be cited as the First Home Owner Grant Amendment 3
Act 2003. 4
2 Commencement
Clause 5
(1) Sections 3, 4 and 10 commence on assent. 6
(2) The remaining provisions of this Act commence on 1 January 2004. 7

This Act amends the First Home Owner Grant Act 2000. 9

`11 Criterion 1--Applicant to be a natural person and at least 14

`(1) An applicant for a first home owner grant must be-- 16
(a) a natural person; and 17
(b) at least 18 years of age at the commencement date for the eligible 18
transaction. 19
`(2) The commissioner may exempt an applicant from the requirement in 20
subsection (1)(b) if the commissioner is satisfied-- 21
(a) the applicant will comply with criterion 5 as applying to the 22
applicant under section 15; and 23
(b) the application does not form part of a scheme to circumvent 24
limitations on, or requirements affecting, eligibility for or 25
entitlement to a first home owner grant.'. 26

5 Amendment of s 13 (Criterion 3--Applicant or applicant's spouse

Section 13(2)-- 3

`(2) However, an applicant is not ineligible if-- 5
(a) the grant was later paid back; and 6
(b) the basis for the repayment of the grant was a failure to satisfy 7
section 10(1); and 8
(c) any penalty amount payable under section 47 was also paid in 9
relation to the earlier application.'. 10
6 Amendment of s 14 (Criterion 4--Applicant or applicant's spouse

`(5) However, for subsection (4), the applicant or the applicant's spouse 15
is taken not to have used the property as the residence of the applicant or 16
the applicant's spouse if-- 17
(a) the property was the subject of an earlier application under this 18
Act by the applicant; and 19
(b) a first home owner grant was paid under the earlier application; 20
and 21
(c) because of a failure to satisfy criterion 5 as applying to the 22
applicant under section 15 in relation to the earlier application, 23
the applicant repaid the grant.'. 24
7 Amendment of s 15 (Criterion 5--Residence requirement)

`(1) An applicant for a first home owner grant must occupy the home to 3
which the application relates as the applicant's principal place of residence 4
for a continuous period of at least 6 months. 5
`(2) However, if the commissioner is satisfied there are good reasons to 6
do so, the commissioner may-- 7
(a) approve a shorter period; or 8
(b) exempt the applicant from the requirement to comply with 9
subsection (1). 10
`(3) The period of occupation required under subsection (1), or the 11
shorter period approved under subsection (2)(a), must start within 1 year 12
after completion of the eligible transaction or a longer period approved by 13
the commissioner.'. 14
(4) Section 15(4) as renumbered, `requirement if'-- 15

8 Amendment of s 22 (Payment in anticipation of compliance with

`(3) Subsection (4) applies if-- 2
(a) a deceased applicant for a first home owner grant had not, when 3
the applicant died, complied with criterion 5, as applying to the 4
applicant under section 15 immediately before the applicant's 5
death; and 6
(b) the commissioner is satisfied the applicant intended to comply 7
with the criterion. 8
`(4) The deceased applicant is taken to have complied with criterion 5.'. 9
10 Insertion of new s 69A

After section 69-- 11
insert-- 12
`69A Disqualifying arrangements 13
`(1) A disqualifying arrangement exists in relation to an application for a 14
first home owner grant if-- 15
(a) a related person of an applicant for the application provides or 16
will provide financial help to the applicant, directly or indirectly, 17
to help the applicant enter into the eligible transaction to which 18
the application relates; and 19
(b) the related person has used, or will use, the home the subject of 20
the eligible transaction, frequently or otherwise to a significant 21
extent, in addition to any use of the home by the applicant; and 22
(c) the related person would not be eligible for the grant had the 23
related person entered into the eligible transaction; and 24
(d) the commissioner is not satisfied that in the circumstances there 25
are genuine family reasons for the matters mentioned in 26
paragraphs (a) and (b). 27
`(2) Without limiting subsection (1)(a), any of the following may be 28
taken to be financial help provided by the related person-- 29
(a) the related person makes a gift of money or property, whether or 30
not the gift is enough to meet all of the applicant's obligations 31
under the eligible transaction; 32
(b) the related person makes a contribution towards the cost of-- 33

(i) the applicant complying with his or her obligations under 1
the eligible transaction; or 2
(ii) maintaining the home the subject of the eligible transaction; 3
(c) the related person makes a loan repayment for the applicant in 4
relation to the eligible transaction; 5
(d) the related person forgives loan repayments otherwise owed by 6
the applicant to the related person. 7
`(3) A disqualifying arrangement exists in relation to an application for a 8
first home owner grant if the commissioner is satisfied-- 9
(a) there is an arrangement the sole or main purpose of which is to 10
obtain a first home owner grant, rather than acquiring a home; 11
and 12
(b) the application is made for the purposes of the arrangement. 13
`(4) For subsection (3), the commissioner must have regard to the 14
following-- 15
(a) the way the eligible transaction was entered into or carried out; 16
(b) the nature of the connection, whether business, family or another 17
connection, between the parties to the eligible transaction; 18
(c) the amount of consideration payable under the eligible 19
transaction; 20
(d) the value of the home the subject of the eligible transaction; 21
(e) the living and family arrangements of the applicant and any 22
related person; 23
(f) the financial circumstances of the applicant; 24
(g) the source of funds used to complete the eligible transaction and 25
meet the costs of owning and maintaining the home the subject of 26
the eligible transaction. 27
`(5) Subsection (4) does not limit the matters to which the commissioner 28
may or ought to have regard for subsection (3). 29
`(6) If a disqualifying arrangement exists in relation to an application for 30
a first home owner grant the commissioner may-- 31
(a) if the application has not yet been approved--refuse the 32
application; or 33

(b) if the application was approved but the grant has not yet been 1
paid--reverse the decision on the application and refuse to pay 2
the grant; or 3
(c) if the grant has already been paid--reverse the decision on the 4
application and act under section 47 to recover the grant as an 5
error amount, and to recover any penalty amount imposed under 6
the section. 7
`(7) The commissioner must give the applicant reasons for taking action 8
under this section. 9
`(8) In this section-- 10
"related person", of an applicant, means-- 11
(a) a parent, child, grandparent, sibling, uncle or aunt of the 12
applicant; or 13
(b) the spouse of any person mentioned in paragraph (a).'. 14

`72 Continuing operation of Act for particular eligible transactions 20
`(1) This Act continues to apply in relation to a relevant application as if 21
this Act had not been amended by the relevant provisions of the amending 22
Act. 23
`(2) In this section-- 24
"amending Act" means the First Home Owner Grant Amendment Act 25
2003. 26
"relevant application" means an application for a first home owner grant, 27
if the commencement date for the eligible transaction to which the 28
application relates is a date earlier than 1 January 2004. 29
"relevant provisions", of the amending Act, means the provisions of the 30
amending Act commencing on the day this section commences, other 31
than section 5.'. 32

12 Amendment of schedule (Dictionary)

(1) Schedule, definition "residence requirement"-- 2

(2) Schedule-- 4
insert-- 5
` "residence requirements" means the following requirements-- 6
(a) the requirement-- 7
(i) under section 15(1), that an applicant for a first home owner 8
grant must occupy the home to which the application relates 9
as the applicant's principal place of residence for a 10
continuous period of at least 6 months; or 11
(ii) under section 15(1) and (2)(a), that an applicant for a first 12
home owner grant must occupy the home to which the 13
application relates as the applicant's principal place of 14
residence for a shorter period approved by the 15
commissioner; 16
(b) the requirement under section 15(3) that the period of occupation 17
required under section 15(1), or section 15(1) and (2)(a), must 18
start within 1 year after completion of the eligible transaction or 19
a longer period approved by the commissioner.'. 20
