s1 4 s4 Emergency Services Legislation Amendment Bill 2002 The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 1 Short title Clause 3 This Act may be cited as the Emergency Services Legislation 4 Amendment Act 2002. 5 2 Commencement Clause 6 This Act commences on a day to be fixed by proclamation. 7 PART 2--AMENDMENT OF AMBULANCE SERVICE 8 ACT 1991 9 3 Act amended in pt 2 Clause 10 This part amends the Ambulance Service Act 1991. 11 4 Amendment of s 2 (Definitions) Clause 12 (1) Section 2, `In this Act--'-- 13 omit, insert-- 14 `The dictionary in the schedule defines particular words used in this 15 Act.'. 16 (2) Section 2-- 17 insert-- 18 ` "constitution", of a committee, means the committee's constitution 19 under this Act.'. 20 (3) Section 2, definitions (as amended)-- 21 relocate to the schedule as inserted by this Act. 22

 


 

s5 5 s7 Emergency Services Legislation Amendment Bill 2002 5 Amendment of s 4A (Acting commissioner) Clause 1 (1) Section 4A, `Governor in Council'-- 2 omit, insert-- 3 `Minister'. 4 (2) Section 4A-- 5 insert-- 6 `(2) The Minister's power to appoint a person to act in the office of 7 commissioner does not limit the Governor in Council's powers under the 8 Acts Interpretation Act 1954, section 25(1)(b)(iv) and (v).1 9 6 Amendment of s 28 (Constitution) Clause 10 (1) Section 28, heading-- 11 omit, insert-- 12 `28 Conduct of business'. 13 (2) Section 28(1) to (3)-- 14 omit, insert-- 15 `(1) Subject to its constitution, a committee may conduct its business, 16 including its meetings, in the way it considers appropriate.'. 17 (3) Section 28(4)-- 18 renumber as section 28(2). 19 7 Amendment of s 29 (Members of committees) Clause 20 (1) Section 29(1)(a) and (2)(a), `administrative'-- 21 omit. 22 (2) Section 29-- 23 insert-- 24 `(2A) Also, a person is not eligible to be a member of a committee while 25 the person is a member of another committee.'. 26 1 Acts Interpretation Act 1954, section 25 (Powers of appointment imply certain incidental powers)

 


 

s8 6 s8 Emergency Services Legislation Amendment Bill 2002 (3) Section 29(3), `5 other'-- 1 omit, insert-- 2 `11 other'. 3 (4) Section 29-- 4 insert-- 5 `(3A) Despite subsection (3), a committee may consist of more than 6 11 other members if the Minister is satisfied additional members are 7 required to ensure the community is adequately represented on the 8 committee.'. 9 (5) Section 29(4), from `manner'-- 10 omit, insert-- 11 `way stated in the committee's constitution, from members of the 12 public.'. 13 (6) Section 29(9), from `dismiss' to `committee,'-- 14 omit, insert-- 15 `remove a member of a committee from office'. 16 8 Insertion of new s 29A Clause 17 After section 29-- 18 insert-- 19 `29A Dealing with vacancy in office of a member 20 `(1) This section applies if a vacancy arises in the office of a member of a 21 committee (the "first member"). 22 `(2) Despite section 29(1), the remaining members of the committee may 23 appoint a subscriber (a "replacement member") to the office. 24 `(3) Subject to section 29(2), (2A) and (9) and section 35, a replacement 25 member holds office for the balance of the first member's term of office. 26 `(4) In this section-- 27 "subscriber" does not include a person who is not eligible to be a member 28 of a committee under section 29(2) or (2A).'. 29

 


 

s9 7 s9 Emergency Services Legislation Amendment Bill 2002 9 Insertion of new pt 4, div 3 Clause 1 Part 4, after section 31-- 2 insert-- 3 `Division 3--Other matters about committees 4 `31A Minister may approve or amend constitution 5 `(1) The Minister may approve a constitution for the conduct of a 6 committee's business. 7 `(2) Without limiting subsection (1), the constitution may provide for the 8 following-- 9 (a) the election of committee members; 10 (b) the term of office of a committee member; 11 (c) the times and places of committee meetings; 12 (d) the quorum for meetings; 13 (e) other matters the Minister considers relevant to the conduct of a 14 committee's business. 15 `(3) The Minister may amend the constitution approved under 16 subsection (1). 17 `(4) The constitution as approved and amended from time to time under 18 this section is the constitution for each committee. 19 `31B Commissioner to give constitution to committees 20 `(1) The commissioner must give a copy of the constitution to each 21 committee as soon as practicable after it is approved under section 31A(1). 22 `(2) Also, if a committee is established after the commencement of this 23 section, the commissioner must give a copy of the constitution to the 24 committee as soon as practicable after it is established. 25 `(3) If the Minister amends the constitution, the commissioner must, as 26 soon as practicable after it is amended, give each committee-- 27 (a) a written notice stating the amendment; or 28 (b) a copy of the amended constitution.'. 29

 


 

s 10 8 s 10 Emergency Services Legislation Amendment Bill 2002 10 Insertion of new pt 8, div 4 Clause 1 Part 8-- 2 insert-- 3 `Division 4--Provisions for Emergency Services Legislation Amendment 4 Act 2002 5 `87 Definitions for div 4 6 In this division-- 7 "approval day" means the day the Minister approves, under 8 section 31A(1), the constitution for the conduct of a committee's 9 business. 10 "former constitution", of a committee, means the committee's 11 constitution immediately before the approval day. 12 `88 Former constitution ceases to apply 13 `On the approval day, a committee's former constitution ceases to apply 14 to the committee. 15 `89 Committee members continue in office 16 `(1) This section applies to a person who, immediately before the 17 approval day, is a member of a committee. 18 `(2) Subject to section 29(2), (2A) and (9) and section 35,2 the person 19 continues as a member of the committee, unless the person earlier 20 resigns-- 21 (a) for the period the person would have been a member under the 22 committee's former constitution; or 23 (b) until the end of any longer period specified under section 29(6). 24 2 Sections 29 (Members of committees) and 35 (Dissolution of committees)

 


 

s 11 9 s 12 Emergency Services Legislation Amendment Bill 2002 `90 Office holders continue to hold office 1 `(1) This section applies to a person who, immediately before the 2 approval day, holds an office mentioned in section 29(3)(a) to (d) for a 3 committee. 4 `(2) Subject to section 29(2), (2A) and (9) and section 35, the person 5 continues to hold the office, unless the person earlier resigns-- 6 (a) for the period the person would have been a member of the 7 committee under the committee's former constitution; or 8 (b) until the end of any longer period specified under section 29(6). 9 `91 Minister must notify approval day 10 The Minister must notify the approval day by a gazette notice.'. 11 PART 3--AMENDMENT OF FIRE AND RESCUE 12 SERVICE ACT 1990 13 11 Act amended in pt 3 Clause 14 This part amends the Fire and Rescue Service Act 1990. 15 12 Amendment of s 6 (Definitions) Clause 16 (1) Section 6, `In this Act--'-- 17 omit, insert-- 18 `The dictionary in schedule 6 defines particular words used in this Act.'. 19 (2) Section 6, definition "chemical incident"-- 20 omit. 21 (3) Section 6-- 22 insert-- 23 ` "ADG Code" means the Australian Code for the Transport of Dangerous 24 Goods by Road and Rail approved by the Ministerial Council for 25 Road Transport, as in force from time to time. 26

 


 

s 12 10 s 12 Emergency Services Legislation Amendment Bill 2002 "chemical" see the Environmental Protection Regulation 1998, 1 schedule 9. 2 "combustible liquid" means a combustible liquid under the flammable 3 and combustible liquids standard. 4 "dangerous goods" means goods defined under the ADG Code as 5 dangerous goods or goods too dangerous to be transported. 6 "environment" includes-- 7 (a) ecosystems and their constituent parts; and 8 (b) all natural and physical resources; and 9 (c) the qualities and characteristics of locations, places and areas, 10 however large or small, that contribute to their biological 11 diversity and integrity, intrinsic or attributed scientific value or 12 interest, amenity, harmony and sense of community; and 13 (d) the social, economic, aesthetic and cultural conditions that affect, 14 or are affected by, things mentioned in paragraphs (a) to (c). 15 "flammable and combustible liquids standard" see the Dangerous 16 Goods Safety Management Act 2001, schedule 2.3 17 "hazardous material" means-- 18 (a) all dangerous goods, combustible liquids and chemicals; or 19 (b) any other substance with potential to cause harm to persons, 20 property or the environment because of 1 or more of the 21 following-- 22 (i) the chemical properties of the substance; 23 (ii) the physical properties of the substance; 24 (iii) the biological properties of the substance. 25 "hazardous materials emergency" means a situation involving hazardous 26 materials or suspected hazardous materials that includes a loss of 27 control, or an imminent risk of loss of control, of the materials or a 28 loss of control of anything that may impact on the materials if the loss 29 3 Dangerous Goods Safety Management Act 2001, schedule 2-- "flammable and combustible liquids standard" means-- (a) if a standard is prescribed under a regulation as a flammable and combustible liquids standard--that standard; or (b) otherwise--AS 1940.
