Clause 1. This Act may be cited as the Emergency Services Legislation 4
Amendment Act 1998. 5

Clause 2. This part and the schedule, part 1, amend the Ambulance Service 9
Act 1991. 10

`3F.(1) The chief executive of the department is the chief executive 6

`(3) Without limiting subsection (2), it is the chief executive officer's 10
role-- 11
(a) to decide the objectives, strategies and policies to be followed by 12
the service; and 13
(b) to ensure the service performs its functions in an appropriate, 14
effective and efficient way. 15

The chief executive officer could establish performance measures for the service.
`(4) The chief executive officer has the power necessary to carry out the 18
chief executive officer's responsibilities and role. 19
`(5) Anything done in the name of, or on behalf of, the service by the 20
chief executive officer is taken to have been done by the service. 21

direction about the carrying out of the chief executive officer's responsibility 24
under section 3F if the Minister is satisfied it is necessary to give the 25

(iii) satisfies the performance targets mentioned in the service's 24
annual strategic plan; and 25
(b) anything else relevant to the functions of the service, referred to 26
the council by the Minister. 27

`(2) However, the council does not have the function of advising about 4
the matters mentioned in section 49(a) and (b).1 5
`(3) The council also has the functions given to it under the Ambulance 6
Service Act 1991 and any other Act. 7

`Membership
`36.(1) The council consists of not more than 14 members appointed by 9
the Governor in Council. 10
`(2) A member may be appointed at any time. 11
`(3) Nominees for appointment to the council must be persons who the 12
Minister considers are competent to assist the council to perform its 13
functions. 14

`Chairperson
`37.(1) The Governor in Council is to appoint a member as the 16
chairperson of the council. 17
`(2) The chairperson is to preside at all council meetings at which the 18
chairperson is present. 19
`(3) If the chairperson is not present at a council meeting, a member 20
chosen by the members present at the meeting is to preside. 21
`(4) If appointed a member of the council, the following are not eligible 22
to be appointed chairperson-- 23
(a) the chief commissioner; 24
(b) the commissioner of the Queensland Ambulance Service; 25
(c) the chief executive officer of the authority or the Queensland 26

`How
`38.(1) An appointment under section 36 or 37 is to be by gazette notice. 4
`(2) The appointment starts on the day the notice is published in the 5
gazette or, if a later day is stated in the notice, the later day. 6
`(3) A person's appointment as chairperson may be combined with the 7
person's appointment as a member of the council. 8

`Term
`39. The term of office of a member is not to exceed 3 years. 10

`Removal
`40.(1) The Governor in Council may remove a member from office at 12
any time. 13
`(2) The removal takes effect on notice of the removal being given to the 14
member by the Minister. 15
`(3) It is unnecessary for any reasons to be given for the removal. 16

`41. A quorum for the council is the number equal to one-half of the 18
number of its members for the time being, and if one-half is not a whole 19
number, the next higher whole number. 20

`42. Subject to this part, the council may conduct its meetings and other 22
