1 Short title

This Act may be cited as the Environmental Protection Legislation 4
Amendment Act (No. 2) 2001. 5

3 Amendment of s 13 (Waste)

(1) Section 13(1), after `any thing'-- 11

`, other than a resource approved under subsection (4),'. 13

`(4) The administering authority may approve a resource, or a stated type 16
of resource, for subsection (1) if it considers the resource, or type of 17

`(1) A person must not, for fee or reward, perform waste management 20
works in a local government's area unless the works-- 21
(a) are performed-- 22
(i) by or for the local government; or 23
(ii) under an approval, under section 369A, from the local 24
government to perform the works; or 25
(iii) under a development approval; or 26
(b) are an environmentally relevant activity. 27

Maximum penalty--100 penalty units. 1
`(2) However, subsection (1)(b) does not apply if the activity is waste 2
transport. 3
`369A Obtaining approval to perform waste management works 4
`(1) A person may apply to a local government for approval to perform 5
waste management works in its area. 6
`(2) The application must be in the approved form and accompanied by 7
any fee required by the local government to consider the application. 8
`(3) However, the local government can not require a fee that is more 9
than the lesser of-- 10
(a) the reasonable cost of considering the application; or 11
(b) the maximum fee prescribed under a regulation. 12
`(4) The local government must, as soon as practicable after the 13
application is made, decide whether to grant or refuse the approval. 14
`(5) If the local government does not decide the application within 15
60 days after receiving it, the approval is taken to have been refused. 16
`(6) The local government may impose relevant conditions on the 17
approval it considers are necessary or desirable. 18
`(7) If the local government decides to grant the approval, it must give 19
the applicant the approval in writing within 10 business days after making 20
the decision. 21
`(8) The local government must, within 10 business days after making a 22
decision as follows, give the applicant an information notice about the 23
decision-- 24
(a) a decision to refuse the approval; 25
(b) a decision to impose a condition on the approval, other than a 26
condition that is the same, or to the same effect, as a condition 27
agreed to or requested by the applicant. 28
`(9) An information notice under subsection 8(b) may accompany, or be 29
included in, the approval. 30

`369B Amendment or cancellation of approval 1
`(1) A local government may, at any time, amend an approval under 2
section 369A, by giving the approval holder written notice of the 3
amendment, if the amendment-- 4
(a) is to correct a clerical or formal error; or 5
(b) does not adversely affect the holder's interests; or 6
(c) is at the holder's written request. 7
`(2) A local government may, by complying with subsections (4) to (7), 8
otherwise amend, or cancel, an approval under section 369A. 9
`(3) However, the approval may be cancelled only on the ground that a 10
condition imposed on the approval has not been complied with. 11
`(4) The local government must give the approval holder written notice 12
stating each of the following-- 13
(a) the action the local government proposes to take, and, if it is an 14
amendment, the proposed amendment; 15
(b) the grounds for the action; 16
(c) the facts and circumstances that form the basis for the grounds; 17
(d) that the holder may make, within a stated period (the "show 18
cause period"), written representations to show why the action 19
should not be taken. 20
`(5) The show cause period must end at least 28 days after the holder is 21
given the notice. 22
`(6) The local government must consider any representations made 23
within the show cause period. 24
`(7) If the local government decides to take the action, it must, within 25
10 business days after making the decision, give the approval holder, or 26
former approval holder, an information notice about the decision. 27
`(8) The decision takes effect when the notice is given. 28
`(9) In this section-- 29
"amend", an approval, includes-- 30
(a) amending a condition imposed on the approval; and 31
(b) imposing a new condition on the approval.'. 32
