PART 1--PRELIMINARY 2
1 Short title

This Act may be cited as the Environmental Protection and Another Act 4
Amendment Act 2002. 5
PART 2--AMENDMENT OF ENVIRONMENTAL 6

This part amends the Environmental Protection Act 1994. 9
3 Amendment of s 75 (Development for Integrated Planning Act,
Clause 10
sch 8, pt 1, item 6) 11
(1) Section 75(1), after `mining activity'-- 12
insert-- 13
`or petroleum activity'. 14
(2) Section 75(2)-- 15
insert-- 16
` "petroleum activity" means an environmentally relevant activity that is 17
carried out-- 18
(a) on land the subject of any of the following authorities granted or 19
issued under the Petroleum Act 1923-- 20
(i) a prospecting petroleum permit; 21
(ii) an authority to prospect; 22

(iii) a petroleum lease; 1
(iv) a pipeline licence; and 2
(b) for the purpose of the authority.'. 3

`617 Validation of particular environmental authorities 16
`(1) This section applies to an environmental authority issued or 17
purporting to have been issued-- 18
(a) on or after 1 July 1998 and before the commencement of this 19
section; and 20
(b) for-- 21
(i) a mining activity as defined in this Act when the authority 22
was issued or purported to have been issued; or 23
(ii) a petroleum activity as defined in section 75. 24
`(2) The environmental authority is taken to be, and to always have been, 25
valid.'. 26
