s1 4 s4 Environmental Legislation Amendment The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 title 3 Short Clause 1. This Act may be cited as the Environmental Legislation Amendment 4 Act 1995. 5 ART 2--AMENDMENT OF ENVIRONMENTAL 6 P PROTECTION ACT 1994 7 amended 8 Act Clause 2. This part amends the Environmental Protection Act 1994. 9 of s 42 (Public notice of applications for licences) 10 Amendment Clause 3. Section 42(3)(a)(ii), `paragraph (a)'-- 11 omit, insert-- 12 `subparagraph (i)'. 13 of s 48 (Refusal of application for environmental 14 Amendment authority) 15 Clause 4.(1) Section 48(1), definition"environmental authority"-- 16 omit. 17 (2) Section 48(1)-- 18 insert-- 19 ` "interstate environmental authority" means a licence, permit or other 20

s 10 7 s 14 Environmental Legislation Amendment PART 3--AMENDMENT OF MARINE PARKS ACT 1 1982 2 amended 3 Act Clause 10. This part amends the Marine Parks Act 1982. 4 of s 9 (Definitions) 5 Amendment Clause 11. Section 9-- 6 insert-- 7 ` "fee" includes tax.'. 8 PART 4--AMENDMENT OF NATURE 9 CONSERVATION ACT 1992 10 amended 11 Act Clause 12. This part amends the Nature Conservation Act 1992. 12 of s 35 (Chief executive's powers about permitted uses in 13 Amendment National Parks) 14 Clause 13. Section 35(1)(a)-- 15 omit, insert-- 16 `(a) the use under the authority is prescribed under a regulation made 17 for this section to be a permitted use for the area; and'. 18 of s 37 (Chief executive's powers to renew existing 19 Amendment authorities for National Parks) 20 Clause 14. Section 37(2)-- 21 omit, insert-- 22

 


 

s 15 8 s 17 Environmental Legislation Amendment `(2) The chief executive may renew, or consent to the renewal of, an 1 authority for the national park if the use under the authority is prescribed 2 under a regulation made for this section to be a permitted use for the area.'. 3 of s 112 (Conservation plans) 4 Amendment Clause 15. Section 112(5)-- 5 omit, insert-- 6 `(5) A conservation plan may make provision about the following 7 matters-- 8 (a) any matter for which a regulation may be made under this Act, 9 including, for example, prescribing offences for contraventions of 10 the plan, and fixing a maximum penalty of a fine of not more 11 than 165 penalty units for the contravention; 12 (b) the use or development of land, and activities, in an area identified 13 under the plan as, or including, a critical habitat or an area of 14 major interest.'. 15 of s 123 (Local governments' decisions to be consistent 16 Amendment with plans) 17 Clause 16. Section 123(2), `development on'-- 18 omit, insert-- 19 `use of, or a development on,'. 20 of s 124 (Amendment of plans) 21 Amendment Clause 17. Section 124-- 22 insert-- 23 `(2) However, subsection (1) does not apply to the amendment of a 24 management or conservation plan to-- 25 (a) correct an error in the plan; or 26 (b) make a change (other than a change of substance) in the plan; or 27 (c) if the plan or a regulation provides that an amendment of a stated 28

 


 

s 18 9 s 21 Environmental Legislation Amendment type may be made to the plan by amendment under this 1 subsection--make an amendment of that type.'. 2 PART 5--AMENDMENT OF QUEENSLAND 3 HERITAGE ACT 1992 4 amended 5 Act Clause 18. This part amends the Queensland Heritage Act 1992. 6 of s 4 (Definitions) 7 Amendment Clause 19.(1) Section 4, definition"cultural heritage significance"-- 8 omit. 9 (2) Section 4-- 10 insert-- 11 ` "aesthetic significance", of a place or object, includes its visual merit or 12 interest. 13 "cultural heritage significance", of a place or object, includes its aesthetic, 14 architectural, historical, scientific, social or technological significance to 15 the present generation or past or future generations.'. 16 of s 11 (Terms and conditions of membership) 17 Amendment Clause 20. Section 11(3)-- 18 omit. 19 of s 23 (Criteria for entry in the Register) 20 Amendment Clause 21. Section 23(1)(e)-- 21 omit, insert-- 22 `(e) the place is important because of its aesthetic significance;'. 23

s 26 11 s 28 Environmental Legislation Amendment ART 7--AMENDMENT OF WET TROPICS WORLD 1 P HERITAGE PROTECTION AND MANAGEMENT 2 ACT 1993 3 amended 4 Act Clause 26. This part amends the Wet Tropics World Heritage Protection and 5 Management Act 1993. 6 of s 41 (Preparation of plans by Authority) 7 Amendment Clause 27. Section 41(4) and (5)-- 8 omit, insert-- 9 `(4) A management plan may make provision for any matter for which a 10 regulation may be made under this Act, including, for example-- 11 (a) prescribing offences for contraventions of the plan, and fixing a 12 maximum penalty of a fine of not more than 165 penalty units for 13 the contravention; and 14 (b) exempting and prescribing acts for section 56(3), definition 15 `prohibited act'. 16 `(5) A regulatory impact statement under the Statutory Instruments Act 17 1992 need not be prepared for the first management plan for the wet tropics 18 area.'. 19 of s 47 (Approval of final plan) 20 Amendment Clause 28.(1) Section 47(1)-- 21 omit, insert-- 22 `47.(1) A final management plan does not have effect until approved by 23 the Governor in Council.'. 24 (2) Section 47(3)-- 25 omit, insert-- 26 `(3) A final management plan is subordinate legislation.'. 27
