An Act to transfer the Eagle Farm racecourse lands to the
Queensland Turf Club Ltd and for other purposes

Short
1. This Act may be cited as the Eagle Farm Racecourse Act 1997. 3

Commencement
2. This Act commences on 1 January 1998. 5

Definitions
3. In this Act-- 7
"QTC Ltd" means Queensland Turf Club Ltd ACN 079 598 235. 8
"repealed Act" means the Eagle Farm Racecourse Act 1993. 9
"trustee" means a person who was a trustee under the repealed Act 10
immediately before the commencement of this Act. 11
"trust land" means land that was trust land under the repealed Act 12
immediately before the commencement of this Act. 13
"trust property" means property that was trust property under the repealed 14
Act immediately before the commencement of this Act. 15

Abolition
4. The trust established under the repealed Act (the "trust") is at an end. 17

Vesting
5.(1) The trust property, including the trust land, is transferred to, and 19
vests in, the QTC Ltd. 20
(2) Any other asset or liability of the trustees is transferred to, and vests 21
in, the QTC Ltd. 22
(3) If, immediately before the commencement of this Act, the trust 23

property or another asset of the trustees was subject to an interest (a 1
"non-trust interest"), other than an interest under the trust, the trust 2
property or asset is transferred, and vests, subject to the non-trust interest. 3
(4) A transfer of a liability under subsection (2) discharges the trustees 4
from the liability. 5

Lodgement
6. The QTC Ltd must lodge an instrument of transfer for the trust land 7
with the registrar of titles for registration. 8

Limitations
7.(1) The trust land must not be sold without the Minister's prior written 10
consent. 11
(2) A sale in contravention of subsection (1) is of no effect. 12
(3) The trust land must be used for the purposes of a racecourse. 13
(4) However, all or part of the trust land may be used for another 14
purpose with the Minister's prior written approval. 15

Proceedings
8.(1) This section applies if, immediately before the commencement of 17
this Act, a proceeding might have been continued or started by or against 18
the trustees in their official name in relation to an asset or liability that is 19
transferred to the QTC Ltd under this Act. 20
(2) The proceedings may be continued or started by or against the 21
QTC Ltd. 22
(3) The QTC Ltd has the same rights, privileges and liabilities in relation 23
to the proceedings as the trustees would have had if there had been no 24
transfer. 25
(4) A document that could have been given in evidence by or against the 26
trustees if there had been no transfer may be given in evidence by or against 27
the QTC Ltd. 28

Transitional
9. In an Act or other document, a reference to the trustees or the Trustees 2
of Eagle Farm Racecourse may, if the context permits, be taken to be a 3
reference to the QTC Ltd. 4

Repeal
10.(1) The Eagle Farm Racecourse Act 1993 is repealed. 6
(2) This section expires the day after it commences. 7
