1997 A BILL FOR An Act to amend the Electricity Act 1994 and another Act and for other purposes

 


 

s1 6 s6 Electricity Amendment (No. 2) The Parliament of Queensland enacts-- 1 title 2 Short 1. This Act may be cited as the Electricity Amendment Act (No. 2) 1997. 3 4 Commencement 2. This Act commences on a day to be fixed by proclamation. 5 amended 6 Act 3. This Act amends the Electricity Act 1994. 7 of s 7 (System control) 8 Omission 4. Section 7-- 9 omit. 10 of s 18 (Application of Act to government entities) 11 Amendment 5. Section 18(2)(e), after `(Gladstone power station provisions)'-- 12 insert-- 13 ` and section 287A (Gladstone power station arrangements)'. 14 of s 26 (Generation authorities) 15 Amendment 6. Section 26(1)-- 16 omit, insert-- 17 `(1) A "generation authority" authorises its holder-- 18 (a) to connect the generating plant stated in the authority to the 19 transmission grid or supply network stated in the authority; and 20 (b) to sell electricity-- 21

s 17 10 s 17 Electricity Amendment (No. 2) of ss 90­92 1 Replacement 17. Sections 90 to 92-- 2 omit, insert-- 3 1--Queensland System Operator 4 `Division of Queensland System Operator 5 `Appointment `90. Queensland Electricity Transmission Corporation Limited is the 6 Queensland System Operator. 7 of Queensland System Operator 8 `Functions `91.(1) The Queensland System Operator must administer the wholesale 9 market for electricity and seek to maintain the security and reliability of the 10 Queensland system in accordance with the Market Code. 11 `(2) For its function under subsection (1), the Queensland System 12 Operator also has the following functions-- 13 (a) monitoring, controlling and coordinating the transfer of electricity 14 to, from and along the transmission grid or grids; 15 (b) monitoring the actions of market participants and, if requested, 16 reporting on them to the Minister, the regulator or other person 17 responsible for market surveillance; 18 (c) regulating the measurement of the supply of electricity to, from 19 and along the transmission grid or grids; 20 (d) providing information and other services to facilitate decisions for 21 investment and the use of resources in the electricity industry; 22 (e) any other functions it may be given under a regulation. 23 of functions of Queensland System Operator 24 `Separation `92.(1) Queensland Electricity Transmission Corporation Limited must 25 perform its functions as Queensland System Operator in a way that 26 separates the functions from its other functions. 27

 


 

s 17 11 s 17 Electricity Amendment (No. 2) `(2) The way in which the Queensland Electricity Transmission 1 Corporation Limited must perform its functions as Queensland System 2 Operator so that they are separate from its other functions may be provided 3 for under a regulation. 4 `(3) Without limiting subsection (2) a regulation may provide for-- 5 (a) the principles, policies and reporting procedures that must be 6 followed; and 7 (b) the funds, accounts and records that must be kept. 8 for network control 9 `Responsibility `92A.(1) A distribution entity is responsible for network control of its 10 supply network. 11 `(2) However, a distribution entity is subject to directions given to it by 12 the Queensland System Operator under section 92B. 13 System Operator may give directions 14 `Queensland `92B.(1) The Queensland System Operator may direct code participants 15 and other persons about things to be observed and action taken-- 16 (a) to ensure the reliability of supply of electricity in the Queensland 17 system; or 18 (b) to ensure the security of the Queensland system; or 19 (c) to maintain the voltage or reactive flow of power through the 20 Queensland system; or 21 (d) in the interest of public safety; or 22 (e) to give effect or to help give effect to a direction given or action 23 taken by the Queensland System Operator. 24 `(2) Without limiting subsection (1) a direction may require a code 25 participant or other person-- 26 (a) to switch off, reconnect or re-route the output of generating plant; 27 or 28 (b) to call equipment into service; or 29

 


 

s 17 12 s 17 Electricity Amendment (No. 2) (c) to take equipment out of service; or 1 (d) to begin operation or maintain, increase or reduce active or 2 reactive power output; or 3 (e) to shut down or vary operation; or 4 (f) to shed or restore customer load; or 5 (g) to disconnect a code participant's facilities, works or electrical 6 installations from a transmission grid or a supply network; or 7 (h) to do anything necessary or desirable in relation to a matter 8 mentioned in subsection (1). 9 participant or other persons must comply with direction 10 `Code `92C. A code participant or other persons must comply with a direction 11 given to it by the Queensland System Operator under section 92B. 12 Maximum penalty--1 333 penalty units. 13 that may be taken for failure to comply with direction or for a 14 `Action breach of the Market Code 15 `92D.(1) If a code participant or other person fails to comply with a 16 direction given to it by the Queensland System Operator under section 92B 17 or a code participant breaches a provision of the Market Code the 18 Queensland System Operator may take the action stated in subsection (2). 19 `(2) The Queensland System Operator may-- 20 (a) give directions under section 92B(2); or 21 (b) itself do, or authorise another person to do, anything it may direct 22 anyone to do under section 92B(2); or 23 (c) suspend the registration of a person as a code participant for a 24 stated period or until stated conditions are satisfied; or 25 (d) suspend other stated rights of the code participant under the 26 Market Code for a stated period or until stated conditions are 27 satisfied. 28

 


 

s 17 13 s 17 Electricity Amendment (No. 2) `(3) To remove doubt, it is declared that action under this section is in 1 addition to other action that may be taken by the Queensland System 2 Operator against a code participant or other person under this Act, the 3 Market Code, a regulation or otherwise. 4 of liability of Queensland System Operator 5 `Limitation `92E.(1) The Queensland System Operator is not civilly liable to anyone 6 for anything done or omitted to be done in good faith by it in the exercise of 7 its powers and performance of its functions as Queensland System 8 Operator. 9 `(2) However, the Queensland System Operator may agree with a person 10 to vary or exclude the operation of subsection (1) in relation to the person. 11 `(3) In this section-- 12 "Queensland System Operator" includes-- 13 (a) agents appointed by the Queensland System Operator; and 14 (b) persons authorised by the Queensland System Operator under 15 section 92D(2). 16 2--Queensland Interim Market Code 17 `Division of Queensland Interim Market Code 18 `Approval `92F.(1) The Minister must approve a code of conduct called the 19 Queensland Interim Market Code for the administration of the pool. 20 `(2) The Minister must notify the approval of the Market Code by gazette 21 notice within 14 days. 22 `(3) The approval takes effect-- 23 (a) on a day stated in the notice; or 24 (b) if no day is stated in the notice--on the day the notice is given. 25

 


 

s 17 14 s 17 Electricity Amendment (No. 2) of Market Code 1 `Amendment `92G.(1) The Minister may amend the Market Code by written notice to 2 the Queensland System Operator. 3 `(2) The amendment takes effect on the day, or on the day and at the time 4 stated in the Minister's written notice. 5 `(3) After amendment, the Market Code as amended becomes the 6 Market Code. 7 `(4) The Minister must notify the amendment, and when it took effect, 8 by gazette notice within 7 days. 9 Code to be open for inspection 10 `Market `92H.(1) The regulator must keep a copy of the Market Code available 11 for inspection at the office of the regulator at any time when the regulator's 12 office is open for public business.1 13 `(2) The regulator must give a copy of the Market Code to anyone on 14 payment of an amount-- 15 (a) that the regulator considers reasonable; and 16 (b) that is not more than the reasonable cost of providing the copy. 17 with Queensland System Operator 18 `Registration `92I.(1) A person must not engage in the activity of owning, controlling 19 or operating-- 20 (a) generating plant that supplies electricity to the Queensland 21 system; or 22 (b) a transmission grid or supply network forming part of the 23 Queensland system; 24 unless the person is registered by the Queensland System Operator under 25 the Market Code as a code participant for the activity or exempted from 26 registration under the Market Code. 27 Maximum penalty--1 333 penalty units. 28 1 The office of the regulator is located at 61 Mary Street, Brisbane.

 


 

s 17 15 s 17 Electricity Amendment (No. 2) `(2) A person ("the purchaser") must not purchase electricity from a 1 person administering a market for wholesale trade in electricity unless-- 2 (a) the person administering the market is the Queensland System 3 Operator; and 4 (b) the purchaser is registered by the Queensland System Operator 5 under the Market Code as a code participant for the purchase, or 6 is exempted under the Market Code from the requirement to be 7 registered for the purchase. 8 Maximum penalty--1 333 penalty units. 9 System Operator to operate market 10 `Queensland `92J. A person, other than the Queensland System Operator, must not 11 engage in the activity of administering or operating a market for wholesale 12 trade in electricity. 13 Maximum penalty--1 333 penalty units. 14 in relation to the Market Code 15 `Proceedings `92K.(1) A person may bring proceedings against a code participant for 16 an alleged contravention of the Market Code only if the alleged 17 contravention is recognised under the Market Code or this Act, as a 18 contravention giving rise to an obligation or liability of the code participant 19 to the person. 20 `(2) A person may not in any proceedings rely on an alleged 21 contravention of the Market Code by another person unless the person and 22 the other person are code participants. 23 `(3) Nothing in subsection (1) or (2)-- 24 (a) affects the right of a person to bring proceedings in relation to a 25 matter or thing, or seek a relief or remedy, if the cause of action 26 arises, or the relief or remedy is sought, on grounds that do not 27 rely on the Market Code; or 28 (b) prevents the use of the Market Code in any proceedings as 29 evidence of standards of conduct, practices, procedures or rules 30 that apply in the electricity industry. 31

 


 

s 18 16 s 18 Electricity Amendment (No. 2) of amounts payable under the Market Code 1 `Recovery `92L. If an amount payable under the Market Code by one code 2 participant to another remains unpaid for 28 days it may be recovered as a 3 civil debt in a court of competent jurisdiction. 4 of liability of other persons 5 `Limitation `92M.(1) This section applies to a member of any of the following 6 panels established under the Market Code-- 7 (a) the code change panel; 8 (b) the dispute resolution panel; 9 (c) the reliability panel. 10 `(2) The member is not civilly liable to a code participant or anyone else 11 because of an act or omission done in good faith as a member of the panel. 12 making power about market and system arrangements 13 `Regulation `92N. A regulation may make provision for any matter about market and 14 system arrangements including, for example, about-- 15 (a) procedures for registration with the Queensland System Operator; 16 or 17 (b) the appointment of persons to exercise powers and perform 18 functions under the Market Code. 19 3--Pricing'. 20 `Division of s 93 (Powers (including reserve powers) about 21 Amendment electricity pricing) 22 18. s 19 17 s 20 Electricity Amendment (No. 2) of new s 116B 1 Insertion 19. After section 116A-- 2 insert-- 3 to include carriage services 4 `Easements `116B.(1) Despite anything to the contrary in any Act or instrument, an 5 easement, licence or consent to which a transmission or distribution entity is 6 entitled may be used by the entity or another person authorised by the entity 7 for the provision of a carriage service or content service. 8 `(2) This section does not authorise a transmission or distribution entity 9 to take land under the Acquisition of Land Act 1967 only for a carriage 10 service or content service. 11 `(3) In this section-- 12 "carriage service" has the meaning given in the Telecommunications Act 13 1997 (Cwlth). 14 "content service" has the meaning given in the Telecommunications Act 15 1997 (Cwlth). 16 of s 133 (Types of disciplinary action) 17 Amendment 20.(1) Section 133(2), `400'-- 18 omit, insert-- 19 `1 333'. 20 (2) Section 133(3), `supply entity or authorised supplier'-- 21 omit, insert-- 22 `generation entity or retail entity'. 23 (3) Section 133(3), after `this Act'-- 24 insert-- 25 `or the Market Code'. 26

 


 

s 21 18 s 22 Electricity Amendment (No. 2) of new s 133A 1 Insertion 21. After section 133-- 2 insert-- 3 action under the Market Code 4 `Disciplinary `133A.(1) If a code participant or other person fails to comply with a 5 direction given to it by the Queensland System Operator under section 92B, 6 or a code participant fails to comply with a provision of the Market Code, 7 the regulator may make 1 or more of the orders mentioned in 8 subsection (2). 9 `(2) The orders that may be made are-- 10 (a) to stop, within a stated time, the act, activity or practice that is the 11 non-compliance with the direction or failure to comply with the 12 Market Code; or 13 (b) to take the action or adopt the practice the regulator requires for 14 remedying or preventing a recurrence the non-compliance with 15 the direction or failure to comply with the Market Code; or 16 (c) to carry out a stated program for compliance with-- 17 (i) for a code participant--directions given by the Queensland 18 System Operator and the Market Code; or 19 (ii) for another person--directions given by the Queensland 20 System Operator. 21 `(3) To remove doubt, it is declared that action by the regulator under this 22 section does not affect any other action that may be taken about the matters 23 mentioned in subsection (1).'. 24 of s 178 (Issue of generation authorities) 25 Amendment 22. Section 178(2)(c)-- 26 omit, insert-- 27 `(c) whether the person is authorised to sell electricity and, if so, the 28 basis of the authorisation; and 29 (d) the term of the authority.'. 30
