1 Short title

This Act may be cited as the Electricity Amendment Act 2001. 3

`89A Minister may decide distribution service pricing for 9
Mount IsaCloncurry supply network 10
`(1) This section applies to customer connection services provided by the 11
owner of the Mount IsaCloncurry supply network and relating to the 12
supply network. 13
`(2) The Minister may decide, in the way the Minister considers 14
appropriate, the prices, or a methodology to fix the prices that the owner 15
may charge to provide the services. 16
`(3) Without limiting subsection (2), a methodology to fix prices may 17
include a methodology for fixing a maximum revenue that the owner may 18
earn from operating the supply network. 19
`(4) The Minister must, in making a decision, consider the objects of the 20
Act and relevant service quality standards. 21
`(5) The Minister must notify the prices, or methodology to fix the 22
prices, by gazette notice. 23
`(6) The prices or methodology to fix the prices notified take effect-- 24
(a) on a day stated in the notice; or 25
(b) if no day is stated in the notice--on the day the notice is gazetted. 26
`(7) The owner must charge the prices, or prices fixed under the 27
methodology, notified under this section for the services. 28

`(8) A decision by the Minister under this section has effect despite the 2
Queensland Competition Authority Act 1997. 3
`89B Minister may direct the QCA to decide distribution service 4
pricing for Mount IsaCloncurry supply network 5
`(1) This section applies to a service provided by the owner of the 6
Mount IsaCloncurry supply network and relating to the supply network 7
that, if the supply network were part of the national grid, would be a 8
distribution service for the Market Code.1 9
`(2) Instead of making a decision under section 89A(2), the Minister 10
may, in writing, direct the QCA to regulate the pricing for the service under 11
the Market Code as if the supply network were part of the national grid. 12
`(3) The QCA must-- 13
(a) within 14 days after receiving the direction, give a copy of it to 14
the owner; and 15
(b) comply with the direction. 16
`(4) The owner must comply with the pricing regulation made by the 17
QCA under the direction. 18
Maximum penalty for subsection (4)--500 penalty units.'. 19

1 Market Code, chapter 10 (Glossary)--
`distribution service
The services provided by a distribution system which are associated with the
conveyance of electricity through the distribution system. Distribution services
include entry services, distribution network use of system services and exit
services.'

"Mount Isa-Cloncurry supply network"-- 1
1. The "Mount IsaCloncurry supply network" means the supply 2
network, other than the 220 kV supply network-- 3
(a) located in the Mount IsaCloncurry region; and 4
(b) owned by Ergon Energy at the commencement of this section; 5
and 6
(c) not connected to the national grid. 7
2. The "Mount IsaCloncurry supply network" includes any increase in 8
the supply network after the commencement. 9
"national grid" has the meaning given by the Market Code.'. 10
