1996 A BILL FOR An Act to amend the Electoral Act 1992

 


 

s1 4 s5 Electoral Amendment The Parliament of Queensland enacts-- 1 title 2 Short Clause 1. This Act may be cited as the Electoral Amendment Act 1996. 3 4 Commencement Clause 2. This Act commences on a day to be fixed by proclamation. 5 amended 6 Act Clause 3. This Act amends the Electoral Act 1992. 7 of s 3 (Definitions) 8 Amendment Clause 4. Section 3, definition "registered officer", after `party's registered 9 officer'-- 10 insert-- 11 `, and includes a person nominated under section 72A as deputy of a 12 party's registered officer'. 13 of new s 72A 14 Insertion Clause 5. After section 72-- 15 insert-- 16 officer's deputy 17 `Registered `72A.(1) A registered officer may nominate a person as a deputy of the 18 registered officer for the purposes of this Act. 19 `(2) The nomination-- 20 (a) must be in writing, signed by the registered officer and lodged 21 with the commission; and 22 (b) must be signed by, and state the name and address of, the person 23

 


 

s6 5 s8 Electoral Amendment nominated; and 1 (c) may be revoked by the registered officer by written notice given 2 to the commission.'. 3 of s 99 (Scrutineers) 4 Amendment Clause 6. Section 102(2), `in'-- 12 omit, insert-- 13 `for'. 14 of s 106 (Who must make a declaration vote) 15 Amendment Clause 8.(1) Section 106(1)(b), (c), (d) and (e)-- 16 renumber as section 106(1)(c), (d), (e) and (f). 17 (2) Section 106(1)(a), `to a polling booth on polling day outside'-- 18 omit, insert-- 19 `on a polling day to a polling booth that has not been established for'. 20 (3) After section 106(1)(a)-- 21 insert-- 22 `(b) an elector who wishes to vote by going to a polling booth 23 described in section 94(4) or (6) that is outside the electoral 24 district for which the elector is enrolled;'. 25

 


 

s9 6 s 10 Electoral Amendment (4) Section 106(2) and (3)-- 1 omit. 2 of s 110 (Making a declaration vote using posted voting 3 Amendment papers) 4 Clause 9.(1) Section 110(1), `posted or sent by facsimile'-- 5 omit, insert-- 6 `posted, faxed or delivered (by the elector or someone else)'. 7 (2) Section 110-- 8 insert-- 9 `(1A) The request must state the address to which the ballot paper and 10 declaration envelope is to be posted, delivered or sent.'. 11 (3) Section 110(2), after `post'-- 12 insert-- 13 `, deliver or send'. 14 (4) Section 110(4), after `posted'-- 15 insert-- 16 `, delivered or sent'. 17 (5) Section 110(5)(d)(ii), after `post'-- 18 insert-- 19 `or send'. 20 of s 111 (Electoral visitor voting) 21 Amendment Clause 10.(1) Section 111(1), `posted or sent by facsimile'-- 22 omit, insert-- 23 `posted, faxed or delivered (by the elector or someone else)'. 24 (2) Section 111-- 25

 


 

s 11 7 s 14 Electoral Amendment insert-- 1 `(1A) The request must state the address the electoral visitor is to visit.'. 2 of s 114 (Formal and informal ballot papers) 3 Amendment Clause 11. Section 114(1)(c), after `ballot box'-- 4 insert-- 5 `by the elector'. 6 of s 116 (Preliminary processing of declaration envelopes 7 Amendment and ballot papers) 8 Clause 12. Section 116(2)(d), `within 10 days after'-- 9 omit, insert-- 10 `before 6 p.m. on the 10th day after'. 11 of s 125 (Notice of failure to vote etc.) 12 Amendment Clause 13. Section 125(4), `106(b)'-- 13 omit, insert-- 14 `106(1)(c)'. 15 of s 136 (Powers of the court) 16 Amendment Clause 14. Section 136-- 17 insert-- 18 `(3) To remove doubt, it is declared that the court may order the opening 19 of a sealed declaration vote envelope. 20 `(4) However, the court must ensure, as far as is reasonably practicable, 21 the secrecy of the ballot is maintained.'. 22

 


 

s 15 8 s 17 Electoral Amendment of s 137 (Restrictions on certain orders) 1 Amendment Clause 15.(1) Section 137(1), from `because of'-- 2 omit, insert-- 3 `because of a delay in-- 4 (a) the announcement of nominations under section 88; or 5 (b) complying with the requirements of part 6, division 5, 6 or 7. 6 `(1A) Also, the court must not make an order under section 136(2) 7 (other than an order to dismiss the petition)-- 8 (a) because of an absence or error of, or omission by, any member 9 of the commission's staff that appears unlikely to have had the 10 effect that the person elected would not have been elected; or 11 (b) because incorrect information an elector gives to an issuing 12 officer is written on a declaration envelope the elector signed.'. 13 (2) Section 137(2), `subsection (1)(b)'-- 14 omit, insert-- 15 `subsection (1A)'. 16 of s 161 (Author of election matter must be named) 17 Amendment Clause 16. Section 161(2)-- 18 omit, insert-- 19 `(2) The particulars are the name and address (other than a post office 20 box) of the person who authorised the advertisement, handbill, pamphlet or 21 notice.'. 22 of s 172 (Failure to post or send documents for someone 23 Amendment else) 24 Clause 17.(1) Section 172, heading, `or send'-- 25 omit, insert-- 26 `, fax or deliver'. 27 (2) Section 172(1)(a), `or send by facsimile'-- 28
