s 28 13 s 28 Drugs Misuse Amendment Bill 2007 (b) disclosure of information to a police officer to enable 1 the police officer to perform his or her functions as a 2 police officer; or 3 (c) disclosure of information in compliance with lawful 4 process requiring production of documents or giving of 5 evidence before a court or tribunal; or 6 (d) disclosure of information in a way that conceals the 7 identity of the recipient of a controlled substance or 8 controlled thing, or if the recipient purports to obtain the 9 substance or thing for another person, the identity of the 10 other person. 11 `(3) In this section-- 12 recipient means recipient as defined under section 43D(1).'. 13 Clause 28 Amendment of s 124 (Defence of supply of lawfully 14 prescribed drug in a small quantity) 15 (1) Section 124-- 16 insert-- 17 `(1A) However, subsection (1) does not apply if-- 18 (a) the person is charged with an offence mentioned in 19 subsection (1) (the current charge); and 20 (b) the person relied on the defence mentioned in 21 subsection (1) in relation to a previous charge of an 22 offence mentioned in subsection (1) (the previous 23 charge); and 24 (c) the prosecution proves that-- 25 (i) the drug given under the current charge was the 26 same as the drug given under the previous charge; 27 and 28 (ii) the person to whom the drug was given under the 29 current charge was the same person to whom the 30 drug was given under the previous charge.'. 31 (2) Section 124-- 32 insert-- 33 `(2A) However, subsection (2) does not apply if-- 34

s 31 15 s 32 Drugs Misuse Amendment Bill 2007 Clause 31 Insertion of new s 134A 1 Part 6, after section 134-- 2 insert-- 3 `134A Recommendation of Minister 4 `In deciding whether to recommend the prescription of a thing 5 as a dangerous drug for the Drugs Misuse Regulation 1987, 6 schedules 1 to 5, the Minister must consider the following-- 7 (a) the likelihood or evidence of abuse of the drug, 8 including, for example, the prevalence of the drug, 9 consumption levels of the drug, the potential appeal of 10 the drug to vulnerable populations and drug seizure 11 trends; 12 (b) the specific effects of the drug, including, for example, 13 the pharmacological, psychoactive and toxicological 14 effects; 15 (c) the risks, if any, of the drug to public health and safety; 16 (d) the therapeutic value, if any, of the drug; 17 (e) the potential for use of the drug to cause death; 18 (f) the ability of the drug to create physical or 19 psychological dependence; 20 (g) the classification and experience of the drug in other 21 jurisdictions; 22 (h) any other matters the Minister considers appropriate.'. 23 Clause 32 Insertion of new pt 7, div 5 24 Part 7-- 25 insert-- 26

 


 

s 33 16 s 34 Drugs Misuse Amendment Bill 2007 `Division 5 Provisions for Drugs Misuse 1 Amendment Act 2007 2 `139 Transitional provision for offences committed before 3 the enactment of Drugs Misuse Amendment Act 2007 4 `(1) This section applies to the sentencing of a person convicted of 5 an offence committed against section 5, 6(1), 7, 8, 8A(1), 9, 6 10(1) or 11(1) before the commencement of this section even 7 if the conviction happens after the commencement. 8 `(2) The Act as in force immediately before the commencement 9 continues to apply to the sentencing. 10 `140 Amendment of regulation by Drugs Misuse 11 Amendment Act 2007 does not affect powers of 12 Governor in Council 13 `The amendment of the Drugs Misuse Regulation 1987 by the 14 Drugs Misuse Amendment Act 2007 does not affect the power 15 of the Governor in Council to further amend the regulation or 16 to repeal it.'. 17 Part 3 Amendment of Drugs Misuse 18 Regulation 1987 19 Clause 33 Regulation amended in pt 3 20 This part amends the Drugs Misuse Regulation 1987. 21 Clause 34 Amendment of s 4 (Prescribed procedure for disposal of 22 dangerous drugs) 23 Section 4(a), `section 9'-- 24 omit, insert-- 25 `section 3'. 26
