An Act to facilitate the granting of a long-term lease over the
Dalrymple Bay Coal Terminal by providing for the exclusion of
certain leases from the application of the Property Law Act 1974,
section 121

The Parliament of Queensland enacts-- 1
1 Short title 2
This Act may be cited as the Dalrymple Bay Coal Terminal (Long-term 3
Lease) Act 2001. 4
2 Non-application of the Property Law Act 1974, s 121 5
The Property Law Act 1974, section 121,1 does not apply to a lease 6
declared to be an exempt lease under section 3. 7
3 Declaration of exempt lease 8
(1) The Minister may, by written instrument, declare a lease to be an 9
exempt lease if-- 10
(a) the lease is granted over the terminal or a part of the terminal; 11
and 12
(b) a lessor is-- 13
(i) DBCT Holdings Pty Ltd ACN 096 395 783; or 14
(ii) Ports Corporation of Queensland established under the 15
Government Owned Corporations (Ports) Regulation 1994; 16
or 17
(iii) the State. 18
(2) As soon as practicable after making the instrument, the Minister must 19
give a copy of the instrument to the lessee. 20
(3) Within 21 days after making the instrument, the Minister must 21
publish a gazette notice setting out the declaration contained in the 22
instrument. 23
(4) Failure to comply with subsection (2) or (3) does not affect the 24
validity of the instrument. 25

(5) In this section-- 1
"terminal" means the land, plant, equipment and other assets comprising 2
the facility known as the Dalrymple Bay Coal Terminal, located at the 3
port of Hay Point, Queensland. 4
