An Act to amend the Criminal Code in relation to child
exploitation material to provide, in particular, for immediate
confiscation of devices used for filming or possessing images
of violence against children

The Parliament of Queensland enacts-- 1
Clause 1 Short title 2
This Act may be cited as the Criminal Code (Filming or 3
Possessing Images of Violence Against Children) Amendment 4
Act 2009. 5

This Act amends the Criminal Code. 7
Clause 3 Amendment of s 207A (Definitions for this chapter) 8
(1) Section 207A, definition child exploitation material, `under 9

`228DA Confiscating devices used to commit offences in 20

`(1) This section applies if a police officer or school principal 22
reasonably believes a mobile phone, computer or other thing 23
has just been used, or is being used, to commit an offence 24
against section 228A, 228B, 228C or 228D that involves child 25
exploitation material describing or depicting someone who is, 26
or apparently is, a child being subjected to abuse by bullying. 27

`(2) The police officer or school principal may seize the thing. 3
`(3) In this section-- 4
school principal means, if the school has no position by that 5
name, the person responsible for the school's day-to-day 6
