`7A Chairperson and deputy chairperson of the 1
corporation 2
`(1) The Governor in Council must appoint 1 member of the 3
corporation to be the chairperson, and another member to be 4
the deputy chairperson, of the corporation. 5
`(2) A person may be appointed as the chairperson, or deputy 6
chairperson, at the same time the person is appointed as an 7
appointed member. 8
`(3) The chairperson or deputy chairperson holds office for the 9
term decided by the Governor in Council. 10
`(4) However, a vacancy occurs in the office of chairperson or 11
deputy chairperson if the person holding the office resigns the 12
office by signed notice of resignation given to the Minister or 13
stops being a member of the corporation. 14
`(5) A person resigning the office of chairperson or deputy 15
chairperson may continue to be a member of the corporation. 16
`(6) The deputy chairperson is to act as chairperson-- 17
(a) during a vacancy in the office of chairperson; or 18
(b) during a period when the chairperson is absent from 19
duty or, for another reason, can not perform the 20
functions of the office.'. 21

`(1) The chief executive may appoint an officer of the department 7
to be a representative of the chief executive at meetings of the 8
corporation. 9
`(2) If the chief executive is absent from a meeting of the 10
corporation, the representative may attend the meeting in 11
place of the chief executive and is taken to be a member of the 12
corporation for the meeting. 13
`(3) Also, if the chief executive is chairperson, or deputy 14
chairperson, of the corporation, the representative attending a 15
meeting in place of the chief executive is taken to be the 16
chairperson, or deputy chairperson, for the meeting.'. 17

`34A Validation of certain appointments 4
`(1) Subsection (2) applies if before the commencement of this 5
section a person was purportedly appointed as a member for a 6
term and, as a consequence of the term, the person served, or 7
would serve, more than 6 consecutive years as a member. 8
`(2) The person is declared to always have been validly appointed 9
as a member for the duration of the term, even though, as a 10
consequence of the term, the person served, or would serve, 11
more than 6 consecutive years as a member. 12
`(3) Subsection (4) applies if before the commencement of this 13
section a person was purportedly appointed as chairperson for 14
a term and-- 15
(a) at the time of the appointment the person was a member; 16
and 17
(b) the person's term as a member ended during the 18
person's term as chairperson. 19
`(4) The person is declared to always have been-- 20
(a) validly appointed as chairperson for the duration of the 21
person's term as chairperson, even though the person's 22
term as a member ended during the person's term as 23
chairperson; and 24
(b) a member for the duration of the person's term as 25
chairperson, even though the person's term as a member 26
ended during the person's term as chairperson. 27
`(5) Anything done or omitted to be done by a person mentioned 28
in subsection (2) or (4) that would have been valid and lawful 29
under this Act had the person been validly appointed or 30
lawfully holding office is declared to always to have been 31
valid and lawful. 32
`(6) In this section-- 33
chairperson means chairperson of the corporation. 34
member means member of the corporation. 35
