2004 A BILL FOR An Act to amend the Community Ambulance Cover Act 2003

 


 

s1 6 s4 Community Ambulance Cover Amendment Bill 2004 The Parliament of Queensland enacts-- 1 1 Short title Clause 2 This Act may be cited as the Community Ambulance Cover Amendment 3 Act 2004. 4 2 Commencement Clause 5 This Act, other than sections 12, 18 to 23 and 24 (to the extent it inserts a 6 new section 157), is taken to have commenced on 11 November 2003. 7 3 Act amended Clause 8 This Act amends the Community Ambulance Cover Act 2003. 9 4 Insertion of new s 13A Clause 10 After section 13-- 11 insert-- 12 `13A Meaning of "separate domestic area" 13 `(1) A "separate domestic area" is a building or part of a building in 14 Queensland that is-- 15 (a) used, or, if not being used, available to be used, solely as a single 16 self-contained place of residence; and 17 (b) wired for the supply to it of electricity. 18 `(2) For subsection (1), a building or a part of a building is not used 19 solely as a single self-contained place of residence if it is to any extent used 20 for income producing or business purposes. 21 22 Examples of separate domestic areas-- 23 · a detached house, a residential unit or a flat, used only as a place of residence for a 24 family 25 · a detached house occupied by a family only as a place of residence, and occupied 26 also by an elderly family member who lives in separate living facilities in the 27 house and who does not pay a commercial rent for his or her occupation

 


 

s5 7 s7 Community Ambulance Cover Amendment Bill 2004 1 · a single residential unit in a residential unit complex, used solely as a residence, 2 that has been converted from 2 residential units'. 5 Amendment of s 30 (Exemption for later standard contracts) Clause 3 Section 30, heading, after `contracts'-- 4 insert-- 5 `for separate non-domestic area'. 6 6 Insertion of new s 30A Clause 7 After section 30-- 8 insert-- 9 `30A Exemption for later standard contracts for separate domestic 10 area 11 `(1) This section applies if there are 2 or more standard contracts for the 12 sale of electricity for consumption only at the one separate domestic area. 13 `(2) Each of the contracts that is a later standard contract is an exempt 14 standard contract. 15 `(3) For subsection (2), a standard contract is a later standard contract if 16 it is not the first of the contracts to have commenced. 17 18 Example-- 19 The owner of a house used only as a place of residence has 2 standard contracts with an 20 electricity retailer for the sale of electricity for consumption at the house. Contract A, 21 for the supply of electricity to the house, was entered into on 31 July 2002, and is now 22 a contract for the supply of electricity to the house, other than to a small flat located in 23 a section of the house not used for income producing or business purposes. Contract B, 24 for the supply of electricity to the flat, was entered into on 31 August 2002. Contract B 25 is an exempt standard contract.'. 7 Insertion of new ss 33A­33I Clause 26 After section 33-- 27 insert-- 28 `33A Hot water system exemption 29 `A standard contract is an exempt standard contract if all electricity sold 30 under the contract is supplied to a hot water system. 31

 


 

s7 8 s7 Community Ambulance Cover Amendment Bill 2004 `33B Public park facility exemption 1 `A standard contract is an exempt standard contract if all electricity sold 2 under the contract is supplied to a public park facility. 3 `33C Security lighting exemption 4 `(1) A standard contract (the "relevant contract") is an exempt standard 5 contract if-- 6 (a) all electricity sold under the relevant contract is supplied to 7 security lighting for premises; and 8 (b) there is at least 1 other electricity sale arrangement for the 9 premises; and 10 (c) the relevant contract is not an exempt standard contract under the 11 building common account exemption (type 1) or the building 12 common account exemption (type 2). 13 `(2) However, the relevant contract is not an exempt standard contract 14 if-- 15 (a) all electricity sold under the other arrangement, or other 16 arrangements, is supplied to security lighting for the premises; 17 and 18 (b) the relevant contract is the first of the electricity sale 19 arrangements to have commenced. 20 `33D Exemption for equipment for medical condition 21 `A standard contract is an exempt standard contract if-- 22 (a) all electricity sold under the contract is supplied to an item of 23 equipment; and 24 (b) the equipment is for the use of a person for a medical condition 25 the person has, whether or not the equipment is used only by the 26 person, and whether or not, when used by the person, the 27 equipment is used only for the medical condition; and 28 (c) the person has written advice from a doctor to the effect of either 29 of the following-- 30 (i) because of the medical condition, the person needs to use 31 the equipment; 32

 


 

s7 9 s7 Community Ambulance Cover Amendment Bill 2004 (ii) because of the medical condition, the person needs to have 1 the equipment readily available for use in a medical 2 emergency; and 3 (d) the equipment is not in premises that are, or that are in the nature 4 of, a hospital, an aged care hostel or a nursing home. 5 `33E Retirement village common account exemption 6 `A standard contract is an exempt standard contract if-- 7 (a) all electricity sold under the contract is sold for consumption at a 8 retirement village; and 9 (b) all electricity sold under the contract is supplied for 1 or more of 10 the following-- 11 (i) common facilities for the retirement village; 12 (ii) 1 or more on-supply arrangements; and 13 (c) there is an electricity sale arrangement, other than the standard 14 contract, for each occupied accommodation unit in the retirement 15 village that is a separate domestic area. 16 17 Example-- 18 A retirement village has 6 accommodation units. For each occupied accommodation 19 unit that is a separate domestic area, there is a separate standard contract for the supply 20 of electricity to it. Additionally, the retirement village operator is the non-contestable 21 customer under a standard contract for the supply of electricity for the retirement 22 village's common lighting. The standard contract for the lighting is an exempt standard 23 contract. `33F Building common account exemption (type 1) 24 `A standard contract is an exempt standard contract if-- 25 (a) all electricity sold under the contract is sold for consumption at a 26 multi-unit building; and 27 (b) the electricity is supplied for 1 or more of the following-- 28 (i) common facilities for the building; 29 (ii) 1 or more on-supply arrangements; and 30 (c) there is an electricity sale arrangement, other than the standard 31 contract, for each occupied separate area in the building. 32

 


 

s7 10 s7 Community Ambulance Cover Amendment Bill 2004 1 Examples-- 2 1. A residential unit building has 6 units and common property. For each occupied 3 unit, there is a separate standard contract for the supply of electricity to it. 4 Additionally, the body corporate for the residential building is the non-contestable 5 customer under a standard contract for the supply of electricity for the building's 6 common lighting. The standard contract for the lighting is an exempt standard 7 contract. 8 2. A shopping centre building has 14 shops. For each occupied shop there is an 9 on-supply arrangement (type 1) for the supply of electricity. Electricity for the 10 on-supply arrangements is supplied to the building owner under 1 standard 11 contract. Additionally, the building owner is the non-contestable customer under 12 5 standard contracts, all for security lighting for the shopping centre. All 6 standard 13 contracts are exempt standard contracts. 14 3. A residential building consists of 6 flats. For each occupied flat there is an 15 on-supply arrangement (type 2) for the supply of electricity. Electricity for the 16 on-supply arrangements (type 2) is supplied to the building owner under a standard 17 contract that relates also to the supply of electricity to the building's common use 18 laundry area. The standard contract is an exempt standard contract. `33G Building common account exemption (type 2) (2 pensioner 19 occupiers) 20 `(1) A standard contract is an exempt standard contract if all the 21 following circumstances apply-- 22 (a) all electricity sold under the contract is sold for consumption at a 23 double unit building; 24 (b) the electricity is supplied for 1 or more of the following-- 25 (i) common facilities for the building; 26 (ii) consumption at a separate area; 27 (c) if there were a separate electricity sale arrangement for each 28 separate area in the building, each electricity sale arrangement 29 would be an exempt arrangement because of the pensioner 30 exemption; 31 (d) the pensioner who occupies each separate area has notified the 32 non-contestable customer for the contract in the approved form 33 of the circumstances supporting the application of paragraph (c). 34 `(2) The pensioner who occupies a separate area is taken to have notified 35 the non-contestable customer under subsection (1)(d) if an electricity 36 rebate applies in relation to the supply of electricity to the separate area. 37

 


 

s7 11 s7 Community Ambulance Cover Amendment Bill 2004 `33H Building common account exemption (type 2) (1 pensioner 1 occupier) 2 `(1) A standard contract is an exempt standard contract if all the 3 following circumstances apply-- 4 (a) all electricity sold under 2 or more electricity sale arrangements 5 (the "relevant arrangements") is sold for consumption at a 6 double unit building; 7 (b) the contract is 1 of the relevant arrangements; 8 (c) all electricity sold under the contract is supplied for 1 or more of 9 the following-- 10 (i) common facilities for the building; 11 (ii) consumption at a separate area; 12 (d) if there were a separate electricity sale arrangement for each 13 separate area in the building, the arrangement applying for 1 of 14 the separate areas (the "relevant separate area") would be an 15 exempt arrangement because of the pensioner exemption; 16 (e) the pensioner who occupies the relevant separate area has 17 notified the non-contestable customer for the contract in the 18 approved form of the circumstances supporting the application of 19 paragraph (d); 20 (f) the contract is not the first of the relevant arrangements to have 21 commenced. 22 `(2) The pensioner who occupies the relevant separate area is taken to 23 have notified the non-contestable customer under subsection (1)(e) if an 24 electricity rebate applies in relation to the supply of electricity to the 25 separate area. 26 `33I Building common account exemption (type 2) (no pensioner 27 occupiers) 28 `A standard contract is an exempt standard contract if all the following 29 circumstances apply-- 30 (a) all electricity sold under 3 or more electricity sale arrangements 31 (the "relevant arrangements") is sold for consumption at a 32 double unit building; 33 (b) the contract is 1 of the relevant arrangements; 34

 


 

s8 12 s9 Community Ambulance Cover Amendment Bill 2004 (c) all electricity sold under the contract is supplied for 1 or more of 1 the following-- 2 (i) common facilities for the building; 3 (ii) consumption at a separate area; 4 (d) if there were a separate electricity sale arrangement for each 5 separate area in the building, neither of the arrangements would 6 be an exempt arrangement because of the pensioner exemption; 7 (e) the contract is not the first or second of the relevant arrangements 8 to have commenced.'. 9 8 Amendment of s 44 (Exemption for later power card 10 arrangements) Clause 11 Section 44, heading, after `arrangements'-- 12 insert-- 13 `for separate non-domestic area'. 14 9 Insertion of new s 44A Clause 15 After section 44-- 16 insert-- 17 `44A Exemption for later power card arrangements for separate 18 domestic area 19 `(1) This section applies if there are 2 or more power card arrangements 20 that relate to the sale of electricity for consumption only at the one separate 21 domestic area. 22 `(2) Each of the arrangements that is a later power card arrangement is 23 an exempt power card arrangement. 24 `(3) For subsection (2), a power card arrangement is a later power card 25 arrangement if it is not the first of the arrangements to have commenced. 26 27 Example-- 28 There are 2 power card arrangements for the sale of electricity for consumption at a 29 house used only as a place of residence. Power card arrangement A, for the supply of 30 electricity to the house, commenced on 31 July 2002, and is now a power card 31 arrangement for the supply of electricity to the house, other than a small flat located in 32 a section of the house not used for income producing or business purposes. s 10 13 s 10 Community Ambulance Cover Amendment Bill 2004 1 arrangement B, for the supply of electricity to the flat, commenced on 31 August 2002. 2 Power card arrangement B is an exempt power card arrangement.'. 10 Insertion of new ss 47A­47F Clause 3 After section 47-- 4 insert-- 5 `47A Hot water system exemption 6 `A power card arrangement is an exempt power card arrangement if the 7 power card premises for the arrangement are a hot water system. 8 `47B Public park facility exemption 9 `A power card arrangement is an exempt power card arrangement if the 10 power card premises for the arrangement are a public park facility. 11 `47C Security lighting exemption 12 `(1) A power card arrangement (the "relevant arrangement") is an 13 exempt power card arrangement if-- 14 (a) the power card premises for the relevant arrangement are security 15 lighting for particular premises; and 16 (b) there is at least 1 other electricity sale arrangement for the supply 17 of electricity for the particular premises; and 18 (c) the relevant arrangement is not an exempt power card 19 arrangement under the building common account exemption 20 (type 1) or the building common account exemption (type 2). 21 `(2) However, the relevant arrangement is not an exempt power card 22 arrangement if-- 23 (a) all electricity sold under the other arrangement, or other 24 arrangements, is supplied to security lighting also for the 25 particular premises; and 26 (b) the relevant arrangement is the first of the electricity sale 27 arrangements to have commenced. 28

 


 

s 10 14 s 10 Community Ambulance Cover Amendment Bill 2004 `47D Exemption for equipment for medical condition 1 `A power card arrangement is an exempt power card arrangement if-- 2 (a) the power card premises for the arrangement are an item of 3 equipment; and 4 (b) the equipment is for the use of a person for a medical condition 5 the person has, whether or not the equipment is used only by the 6 person, and whether or not, when used by the person, the 7 equipment is used only for the medical condition; and 8 (c) the person has written advice from a doctor to the effect of either 9 of the following-- 10 (i) because of the medical condition, the person needs to use 11 the equipment; 12 (ii) because of the medical condition, the person needs to have 13 the equipment readily available for use in a medical 14 emergency; and 15 (d) the equipment is not located in premises that are, or that are in 16 the nature of, a hospital, an aged care hostel or a nursing home. 17 `47E Retirement village common account exemption 18 `A power card arrangement is an exempt power card arrangement if-- 19 (a) the power card premises for the arrangement are a retirement 20 village; and 21 (b) all electricity sold under the arrangement is supplied for 1 or 22 more of the following-- 23 (i) common facilities for the retirement village; 24 (ii) 1 or more on-supply arrangements; and 25 (c) there is an electricity sale arrangement, other than the power card 26 arrangement, for each occupied accommodation unit in the 27 retirement village that is a separate domestic area. 28 29 Example-- 30 A retirement village has 6 accommodation units. For each occupied accommodation 31 unit that is a separate domestic area, there is a separate standard contract for the supply 32 of electricity to it. Additionally, there is a power card arrangement for the supply of 33 electricity for the retirement village's common lighting. The power card arrangement 34 for the lighting is an exempt power card arrangement.

 


 

s 11 15 s 11 Community Ambulance Cover Amendment Bill 2004 `47F Building common account exemption (type 1) 1 `A power card arrangement is an exempt power card arrangement if-- 2 (a) the power card premises for the arrangement are a multi-unit 3 building; and 4 (b) all electricity sold under the arrangement is supplied for 1 or 5 more of the following-- 6 (i) common facilities for the building; 7 (ii) 1 or more on-supply arrangements; and 8 (c) there is an electricity sale arrangement, other than the power card 9 arrangement, for each occupied separate area in the building. 10 11 Example-- 12 In a shopping centre with a number of shops, each occupied shop has a power card 13 arrangement for the supply of electricity to it. There is also a power card arrangement 14 for the supply of electricity for air conditioning for the shopping centre. The power card 15 arrangement for the air conditioning is an exempt power card arrangement.'. 11 Insertion of new ss 74A­74I Clause 16 After section 74-- 17 insert-- 18 `74A Hot water system exemption 19 `A contestable sale arrangement is an exempt contestable sale 20 arrangement if all electricity sold under the arrangement is supplied to a 21 hot water system. 22 `74B Public park facility exemption 23 `A contestable sale arrangement is an exempt contestable sale 24 arrangement if all electricity sold under the arrangement is supplied to a 25 public park facility. 26 `74C Security lighting exemption 27 `(1) A contestable sale arrangement (the "relevant arrangement") is an 28 exempt contestable sale arrangement if-- 29

 


 

s 11 16 s 11 Community Ambulance Cover Amendment Bill 2004 (a) all electricity sold under the relevant arrangement is supplied to 1 security lighting for premises; and 2 (b) there is at least 1 other electricity sale arrangement for the 3 premises; and 4 (c) the relevant arrangement is not an exempt contestable sale 5 arrangement under the building common account exemption 6 (type 1) or the building common account exemption (type 2). 7 `(2) However, the relevant arrangement is not an exempt contestable sale 8 arrangement if-- 9 (a) all electricity sold under the other arrangement, or other 10 arrangements, is supplied to security lighting for the premises; 11 and 12 (b) the relevant arrangement is the first of the electricity sale 13 arrangements to have commenced. 14 `74D Exemption for equipment for medical condition 15 `A contestable sale arrangement is an exempt contestable sale 16 arrangement if-- 17 (a) all electricity sold under the arrangement is supplied to an item 18 of equipment; and 19 (b) the equipment is for the use of a person for a medical condition 20 the person has, whether or not the equipment is used only by the 21 person, and whether or not, when used by the person, the 22 equipment is used only for the medical condition; and 23 (c) the person has written advice from a doctor to the effect of either 24 of the following-- 25 (i) because of the medical condition, the person needs to use 26 the equipment; 27 (ii) because of the medical condition, the person needs to have 28 the equipment readily available for use in a medical 29 emergency; and 30 (d) the equipment is not in premises that are, or that are in the nature 31 of, a hospital, an aged care hostel or a nursing home. 32

 


 

s 11 17 s 11 Community Ambulance Cover Amendment Bill 2004 `74E Retirement village common account exemption 1 `A contestable sale arrangement is an exempt contestable sale 2 arrangement if-- 3 (a) all electricity sold under the arrangement is sold for consumption 4 at a retirement village; and 5 (b) all electricity sold under the arrangement is supplied for 1 or 6 more of the following-- 7 (i) common facilities for the retirement village; 8 (ii) 1 or more on-supply arrangements; and 9 (c) there is an electricity sale arrangement, other than the contestable 10 sale arrangement, for each occupied accommodation unit in the 11 retirement village that is a separate domestic area. 12 13 Example-- 14 A retirement village has 6 accommodation units. For each occupied accommodation 15 unit that is a separate domestic area, there is a separate standard contract for the supply 16 of electricity to it. Additionally, the retirement village scheme operator is the relevant 17 contestable customer under a contestable sale arrangement for the supply of electricity 18 for the retirement village's common lighting. The contestable sale arrangement for the 19 lighting is an exempt contestable sale arrangement. `74F Building common account exemption (type 1) 20 `A contestable sale arrangement is an exempt contestable sale 21 arrangement if-- 22 (a) all electricity sold under the arrangement is sold for consumption 23 at a multi-unit building; and 24 (b) the electricity is supplied for 1 or more of the following-- 25 (i) common facilities for the building; 26 (ii) 1 or more on-supply arrangements; and 27 (c) there is an electricity sale arrangement, other than the contestable 28 sale arrangement, for each occupied separate area in the building. 29 30 Examples-- 31 1. A residential building has 6 units and common property. For each occupied unit, 32 there is a separate standard contract for the supply of electricity to it. Additionally, 33 the body corporate for the residential building is the relevant contestable customer 34 under a contestable sale arrangement for the supply of electricity for the building's

A shopping centre building has 14 shops. For each shop there is an on-supply 4 arrangement (type 1) for the supply of electricity. Electricity for the on-supply 5 arrangements is supplied to the building owner under 1 contestable sale 6 arrangement. Additionally, the building owner is the relevant contestable customer 7 under 5 contestable sale arrangements, all for security lighting for the shopping 8 centre. All 6 contestable sale arrangements are exempt contestable sale 9 arrangements. 10 3. A building consists of 6 flats. For each flat there is an on-supply arrangement 11 (type 2) for the supply of electricity. Electricity for the on-supply arrangement 12 (type 2) is supplied to the building owner under a contestable sale arrangement that 13 relates also to the supply of electricity to the building's common use laundry area. 14 The contestable sale arrangement is an exempt contestable sale arrangement. `74G Building common account exemption (type 2) (2 pensioner 15 occupiers) 16 `(1) A contestable sale arrangement is an exempt contestable sale 17 arrangement if all the following circumstances apply-- 18 (a) all electricity sold under the arrangement is sold for consumption 19 at a double unit building; 20 (b) the electricity is supplied for 1 or more of the following-- 21 (i) common facilities for the building; 22 (ii) consumption at a separate area; 23 (c) if there were a separate electricity sale arrangement for each 24 separate area in the building, each electricity sale arrangement 25 would be an exempt arrangement because of the pensioner 26 exemption; 27 (d) the pensioner who occupies each separate area has notified the 28 relevant contestable customer for the arrangement in the 29 approved form of the circumstances supporting the application of 30 paragraph (c). 31 `(2) The pensioner who occupies a separate area is taken to have notified 32 the relevant contestable customer under subsection (1)(d) if an electricity 33 rebate applies in relation to the supply of electricity to the separate area. 34

s 16 23 s 16 Community Ambulance Cover Amendment Bill 2004 `(2) The owner must, within 28 days after receiving the affected person's 1 written notice under subsection (1)(d), notify the commissioner by written 2 notice of the circumstances of the exemption. 3 `(3) After considering the owner's written notice under subsection (2), 4 the commissioner must -- 5 (a) decide the extent of exemption; and 6 (b) give written notice of the decision to-- 7 (i) the owner; and 8 (ii) the relevant electricity retailer for the power card 9 arrangement. 10 `(4) The relevant electricity retailer must treat the power card 11 arrangement as an exempt power card arrangement to the extent provided 12 for-- 13 (a) in the written notice given to the relevant electricity retailer; or 14 (b) in any subsequent notice the commissioner gives the relevant 15 electricity retailer following any objection or appeal dealt with 16 under this Act in relation to the commissioner's decision.'. 17 16 Insertion of new s 97A Clause 18 After section 97-- 19 insert-- 20 `97A Special provision for notification of hot water system exemption 21 for contestable sale arrangement instead of s 97 22 `(1) Subsections (2) to (4) apply, and section 97 does not apply, to the 23 relevant contestable customer for a contestable sale arrangement if-- 24 (a) the relevant contestable customer claims that the contestable sale 25 arrangement is, or has been for a particular period, an exempt 26 contestable sale arrangement because of the hot water system 27 exemption; and 28 (b) section 99(3) does not provide for the notification of the 29 exemption. 30 `(2) The relevant contestable customer may notify the commissioner by 31 written notice of the circumstances of the exemption. 32

 


 

s 17 24 s 17 Community Ambulance Cover Amendment Bill 2004 `(3) After considering the relevant contestable customer's written notice 1 under subsection (2), the commissioner must-- 2 (a) decide the extent of the exemption; and 3 (b) give written notice of the decision to-- 4 (i) the relevant contestable customer; and 5 (ii) the relevant electricity retailer for the contestable sale 6 arrangement. 7 `(4) The electricity retailer must treat the contestable sale arrangement as 8 an exempt contestable sale arrangement to the extent provided for-- 9 (a) in the written notice given to the electricity retailer; or 10 (b) in any subsequent notice the commissioner gives the electricity 11 retailer following any objection or appeal dealt with under this 12 Act in relation to the commissioner's decision.'. 13 17 Amendment of s 99 (Particular exemptions taken to be notified 14 under divs 2­5) Clause 15 Section 99-- 16 insert-- 17 `(3) For an exemption for an electricity sale arrangement on the basis of 18 the hot water system exemption, an electricity retailer is taken to be 19 notified, for division 2, 3 or 5, of the circumstances causing the electricity 20 sale arrangement to be, or to have been, an exempt arrangement if all 21 electricity retail services provided for the arrangement are charged or 22 chargeable at a tariff of a type prescribed under a regulation. 23 `(4) For an exemption for an electricity sale arrangement on the basis of 24 the retirement village common account exemption or the building common 25 account exemption (type 1), an electricity retailer is taken to be notified, for 26 division 2, 3 or 5, of the circumstances causing the electricity sale 27 arrangement to be, or to have been, an exempt arrangement if-- 28 (a) electricity sold under the arrangement is supplied to an 29 on-supplier for 1 or more on-supply arrangements; and 30 (b) the on-supplier has given to the electricity retailer, in relation to 31 the on-supply arrangements, a return under section 96.'. 32

 


 

s 18 25 s 19 Community Ambulance Cover Amendment Bill 2004 18 Amendment of s 120 (Ability of on-supplier to recover levy 1 amount) Clause 2 Section 120(2) and (3)-- 3 omit. 4 19 Insertion of new ss 121A and 121B Clause 5 After section 121-- 6 insert-- 7 `121A Recovery of levy by on-supplier before statement of levy liability 8 `(1) This section applies if-- 9 (a) a person (the "relevant person") is-- 10 (i) the receiver for an on-supply arrangement; or 11 (ii) the owner of the separate area for an on-supply 12 arrangement; or 13 (iii) the occupier of the separate area for an on-supply 14 arrangement; and 15 (b) the relevant person stops or is about to stop being the receiver for 16 the on-supply arrangement or the owner or occupier of the 17 separate area for the on-supply arrangement; and 18 (c) the statement of levy liability the on-supplier needs to entitle the 19 on-supplier to recover from the relevant person the relevant levy 20 amount has not yet been issued to the on-supplier for the 21 arrangement by the relevant electricity retailer for the 22 arrangement. 23 `(2) Despite section 121, the on-supplier may recover the relevant levy 24 amount from the relevant person without waiting for the statement of levy 25 liability to be issued. 26 `(3) In this section-- 27 "relevant levy amount" means the levy amount relating to a period ending 28 on the day the relevant person stops being the receiver for the 29 arrangement, or the owner or occupier of the separate area, and for 30 which the on-supplier has not recovered a levy amount under 31 section 120. 32

 


 

s 20 26 s 20 Community Ambulance Cover Amendment Bill 2004 `121B Subsequent recovery entitlements 1 `(1) If the on-supplier for an on-supply arrangement recovers a levy 2 amount from the receiver for the arrangement, the receiver may recover the 3 amount from, if the receiver is not the owner of the separate area for the 4 arrangement-- 5 (a) the owner of the separate area; or 6 (b) the occupier of the separate area, but only to the extent the 7 amount relates to the period of the occupier's lease, tenancy or 8 occupation. 9 `(2) If the on-supplier or the receiver for an on-supply arrangement 10 recovers a levy amount from the owner of the separate area for the 11 arrangement, the owner may recover the amount from the occupier of the 12 separate area, but only to the extent the amount relates to the period of the 13 occupier's lease, tenancy or occupation. 14 `(3) In this section-- 15 "levy amount" includes a relevant levy amount under section 121A.'. 16 20 Insertion of new pt 7, div 13 Clause 17 Part 7-- 18 insert-- 19 `Division 13--Limitations on levy recovery 20 `124A Recovery of levy amount prohibited for common account 21 exemptions 22 `(1) An electricity customer must not recover, or take action to try to 23 recover, from any person, all or part of a levy amount paid or payable for a 24 day for an electricity sale arrangement that is an exempt arrangement for 25 that day under-- 26 (a) the retirement village common account exemption; or 27 (b) the building common account exemption (type 1); or 28 (c) the building common account exemption (type 2). 29 `(2) Subsection (1) does not stop the electricity customer from claiming 30 a refund of the levy amount from the relevant electricity retailer for the 31 electricity sale arrangement. 32

 


 

s 20 27 s 20 Community Ambulance Cover Amendment Bill 2004 `124B Recovery of levy amount from pensioner prohibited for 1 standard contract 2 `(1) If a standard contract for a double unit building is an exempt 3 standard contract under section 33H, an electricity customer must not 4 recover, or take action to try to recover, from a pensioner, all or part of a 5 levy amount paid for an electricity sale arrangement for the building that is, 6 under section 33H(1)(f), the first of the relevant arrangements to have 7 commenced, if the pensioner is the occupier who-- 8 (a) gave the notification under section 33H(1)(e); or 9 (b) is taken to have given the notification under section 33H(2). 10 `(2) Subsection (3) applies if-- 11 (a) all electricity sold for consumption at a double unit building is 12 sold under a single standard contract; and 13 (b) if there were a separate electricity sale arrangement for each 14 separate area in the building, the arrangement applying for 1 of 15 the separate areas (the "relevant separate area") would be an 16 exempt arrangement because of the pensioner exemption; and 17 (c) the pensioner who occupies the relevant separate area has 18 notified the non-contestable customer for the standard contract in 19 the approved form of the circumstances supporting the 20 application of paragraph (b). 21 `(3) An electricity customer must not recover, or take action to try to 22 recover, from the pensioner, all or part of a levy amount paid for the 23 standard contract. 24 `(4) The pensioner who occupies the relevant separate area is taken to 25 have notified the non-contestable customer under subsection (2)(c) if an 26 electricity rebate applies in relation to the supply of electricity to the 27 separate area. 28 `124C Recovery of levy amount from pensioner prohibited for 29 contestable sale arrangement 30 `(1) If a contestable sale arrangement for a double unit building is an 31 exempt contestable sale arrangement under section 74H, an electricity 32 customer must not recover, or take action to try to recover, from a 33 pensioner, all or part of a levy amount paid for an electricity sale 34 arrangement for the building that is, under section 74H(1)(f), the first of the 35

A "common facility", for a multi-unit building, means an 10 electrical or mechanical installation or item of equipment that-- 11 (a) is located in or otherwise relates to a part of the building; 12 and 13 (b) is for the use and enjoyment of occupants of the building; 14 and 15 (c) is not for any particular separate area in the building. 16 17 Examples-- 18 an air conditioning plant, a lift, common lighting, a swimming pool filter or 19 a power point for the common use of the occupiers of units in a residential 20 unit building 2. A "common facility", for a retirement village, means an 21 electrical or mechanical installation or item of equipment that-- 22 (a) is located in or otherwise relates to a part of the retirement 23 village; and 24 (b) is for the use and enjoyment of the residents of the 25 retirement village; and 26 (c) is not for any particular accommodation unit in the 27 retirement village. 28 29 Examples-- 30 an air conditioning plant, a lift, common lighting, a swimming pool filter or 31 a power point for the common use of the residents of a retirement village "double unit building" means a multi-unit building for which all the 32 following apply-- 33 (a) the building has only 2 separate areas; 34

 


 

s 25 32 s 25 Community Ambulance Cover Amendment Bill 2004 (b) under an electricity sale arrangement, electricity is supplied for 1 consumption at both separate areas, and there is no separate 2 electricity sale arrangement for either of the separate areas; 3 (c) if the building had a third separate area, an on-supply 4 arrangement (type 2) would exist for each separate area. 5 "equipment" includes an apparatus or device. 6 "hot water system exemption" means the exemption applying to an 7 electricity sale arrangement because of the operation of section 33A, 8 47A or 74A. 9 "multi-unit building" -- 10 1. A "multi-unit building" is a building that includes 2 or more 11 separate areas. 12 13 Examples-- 14 · a home unit building 15 · a building made up of town houses 16 · a building that is a shopping centre 17 · an office building 18 · a building divided into flats 2. However, a "multi-unit building" does not include a detached 19 house. 20 "public facility" means a facility for the use and enjoyment of the public, 21 including the following-- 22 (a) a barbecue; 23 (b) a picnic shelter; 24 (c) a walkway; 25 (d) a rest room; 26 (e) a war memorial or similar memorial. 27 "public park"-- 28 1. A "public park" is a place that is designed for use as a park and 29 that is usually open to the public without payment of a fee for 30 entry or use. 31 2.
