(a) a chattel under a bill of sale; or 2
(b) stock under a stock mortgage; or 3
(c) a crop under a lien on crops; or 4

"unregistered security interest" means a security interest that-- 6
(a) is not registered under this Act; or 7
(b) has expired.'. 8

`7. This part does not apply to a security interest, whether created before 10
or after the commencement of this section, to the extent that the interest 11
relates to a motor vehicle within the meaning of the Motor Vehicles 12
Securities Act 1986. 13

`8.(1) The chief executive must keep a register of security interests. 16
`(2) The register must include the following particulars in relation to each 17
security interest included in the register-- 18
(a) the name and address of the lender and the borrower; 19
(b) whether the interest is given under a bill of sale, stock mortgage 20
or lien; 21
(c) the day and time the particulars are included in the register; 22
(d) other particulars that may be prescribed under a regulation. 23

`(3) The security interest is "registered" when the particulars are 1
included in the register. 2

`9.(1) An application for the registration of a security interest must-- 4
(a) be made in the way prescribed under a regulation; and 5
(b) if the security interest is an interest in stock under a stock 6
mortgage or a crop under a lien on crops or wool under a lien on 7
wool--nominate the day the security interest expires; and 8
(c) be accompanied by the fee that may be prescribed under a 9
regulation. 10
`(2) The application must include a description of the chattels to which 11
the interest relates, to the extent to which the chattels are ascertainable. 12

`(3) The chief executive is not required to inquire into the validity of 17
information supporting the application. 18

`10.(1) An application for the renewal of registration of a security interest 20
must-- 21
(a) be made in the way prescribed under a regulation; and 22
(b) if the security interest is an interest in stock under a stock 23
mortgage or a crop under a lien on crops or wool under a lien on 24
wool--nominate the day the security interest expires; and 25
(c) be accompanied by the fee that may be prescribed under a 26
regulation. 27

`11.(1) If the chief executive is satisfied that an application for the 4
registration, or renewal of the registration, of a security interest is properly 5
made, the chief executive must register, or renew the registration of, the 6
security interest by including in the register the relevant particulars 7
mentioned in section 8(2). 8

interests must be registered in the order of time of lodgment with the chief 10

`12.(1) A registration of a security interest after the commencement of 13
this section expires-- 14
(a) for a security interest in stock under a stock mortgage or a crop 15
under a lien on crops or wool under a lien on wool--the day 16
nominated by the lender in the application for registration as the 17

(b) otherwise--the day 5 years after the registration takes effect. 19

`13.(1) A person may, on payment of the fee prescribed under a 25
regulation-- 26
(a) inspect the register at an office of the department prescribed under 27
a regulation when the office is open to the public; and 28

(b) take extracts from, or obtain a copy of the particulars in, the 1
register (a "printed search result"). 2
`(2) A printed search result certified by the chief executive is evidence of 3
the matters stated in it. 4

`14.(1) The lender must, at the written request of the borrower, give the 6
borrower a copy of the bill of sale, stock mortgage or lien to which the 7
interest relates. 8
Maximum penalty--30 penalty units. 9
`(2) For subsection (1), the copy must be given-- 10
(a) within 14 days, if the original came into existence 1 year or less 11
before the request is given; or 12
(b) within 30 days, if the original came into existence more than 13
1 year before the request is given. 14
`(3) The copy may be a computer generated facsimile containing the 15
same information contained in the original document. 16
`(4) The lender may charge a reasonable amount for providing the copy, 17
which must not be more than the actual cost of providing the copy. 18

`Registration
`15.(1) A restraining order under the Crimes (Confiscation) Act 1989 20
made in relation to chattels of a person may be registered. 21
`(2) Registration of the restraining order has effect for the duration of the 22
restraining order. 23
`(3) The chief executive must, on receipt of a request accompanied by a 24
certified copy of the restraining order, include in the register particulars of 25
the restraining order for the chattels that may be prescribed under a 26
regulation. 27

`16.(1) An assignment of a registered security interest may be registered, 3
but is not required to be registered. 4
`(2) An application for registration of the assignment of a registered 5
security interest must be-- 6
(a) made in the way prescribed under a regulation; and 7
(b) accompanied by the fee that may be prescribed under a regulation. 8
`(3) The chief executive is not required to inquire into the validity of 9
information supporting the application. 10

`17.(1) If the chief executive is satisfied that an application for 12
registration of the assignment of a registered security interest is properly 13
made, the chief executive must register the assignment by including in the 14
register particulars of the assignment. 15
`(2) Applications for registration of assignments of registered security 16
interests must be registered in the order of time of lodgment with the chief 17
executive. 18

`18.(1) An unregistered security interest has no effect against a person 20
who is not a party to the instrument creating the interest. 21

`(2) A registered security interest in chattels ranks in priority over another 4
registered security interest in the same chattels according to the order of 5
registration. 6
`(3) An unregistered security interest in chattels ranks in priority over a 7
registered security interest in the same chattels if-- 8
(a) under the unregistered security interest the lender takes 9
possession of the chattels; and 10
(b) the taking of possession happens before the registered security 11

a security interest under this section has effect for all amounts, including 14

in the notice or the longer time that the chief executive may allow in writing. 23

chief executive may, if reasonably satisfied the interest is not a security 26
interest, remove the particulars of the interest included in the register. 27
`(5) However, before removing the particulars, the chief executive must 28
give to the lender and the borrower under the interest written notice of the 29
decision and the reasons for the decision. 30

(a) to file an application under section 7J for the full or partial 3

change the particulars in the register. 7
`(2) A lienee who receives a request under subsection (1) must, within 8
30 days after receiving the request-- 9
(a) file the application or join with the lienor in filing the application; 10

(b) apply to a Magistrates Court for an order maintaining the 12
registration. 13
`(3) If, at the end of the time allowed under subsection (2), the lienee has 14
not complied with subsection (2)(a) or (b), the lienor may ask the chief 15
executive in the approved form to give the lienee a notice under 16
subsection (4). 17
`(4) The notice must state that, unless the lienee obtains a court order 18
maintaining the registration before the end of the notice period, at the end of 19
the notice period-- 20
(a) the discharge will be registered; or 21
(b) stated particulars will be changed under section 7N. 22
`(5) If a lienee who has been given notice under subsection (4) has not-- 23
(a) filed an application for the discharge or the change to particulars 24
in accordance with the request under subsection (1); or 25
(b) given the chief executive a copy of a court order maintaining the 26
registration; 27
before the end of the notice period, the chief executive must register the 28
discharge or change the particulars included in the register as requested. 29
`(6) On application by the lienee, the court may make any of the 30
following orders-- 31
(a) an order that the registration be maintained; 32

(d) another order, including an order for costs, the court considers 3

apply to the accountable officer for payment of compensation to the person. 18
`(2) The accountable officer may make a payment to the applicant under 19
the Financial Administration and Audit Act 1977, section 106.12 20
`(3) The accountable officer must not make a payment in relation to a 21
loss for a reason mentioned in section 7P(e) if the applicant, at the time of 22
suffering the loss-- 23
(a) had actual notice of the lien; or 24
(b) had been put on inquiry as to the existence of the lien and had 25
abstained from inquiry or further inquiry when the person might 26
reasonably have expected the inquiry or further inquiry to reveal 27
