The Parliament of Queensland enacts-- 1

This Act may be cited as the Building and Other Legislation 4
Amendment Act 2008. 5

This part and the schedule amend the Building Act 1975. 9
Clause 3 Replacement of s 67 (Temporary building or structure 10
that does not comply with other building assessment 11
provisions) 12
Section 67-- 13

`67 Temporary building or structures 15
`(1) A building development approval for any temporary building 16
or structure must include a condition that-- 17
(a) limits the period during which the temporary building or 18
structure may remain in place; and 19
(b) requires removal or demolition of the temporary 20
building or structure at the end of the period. 21
`(2) Subsection (3) applies to a building development application 22
for a temporary building or structure if-- 23

(a) no building assessment provision is expressed to apply 1
specifically to temporary buildings or structures 2
generally or to temporary buildings or structures of the 3
same type as the temporary building or structure; and 4
(b) the building or structure, would not otherwise comply 5
with the building assessment provisions. 6
`(3) The assessment manager must not approve the application 7
unless the building certifier has decided the temporary 8
building or structure-- 9
(a) is structurally sound and capable of withstanding the 10
loadings likely to arise from its use; and 11
(b) reasonably provides for all of the following-- 12
(i) the safety of persons to be accommodated in the 13
building or structure if there is a fire (including, for 14
example, means of egress); 15
(ii) the prevention and suppression of fire; 16
(iii) the prevention of the spread of fire; 17
(iv) the health and amenity of persons to be 18
accommodated in the building or structure.'. 19
Clause 4 Amendment of s 103 (Certificate requirements) 20
Section 103(e)-- 21

`(e) if the development uses alternative solutions--state the 23
materials, systems, methods of building, procedures, 24
specifications and other things required under the 25
alternative solutions. 26
Examples of possible alternative solution requirements relating to 27
materials-- 28
· a limitation on the use of finishes with fire hazard properties as 29
defined under the BCA 30
· a prohibition on storing hazardous materials above a stated height 31
· a limitation on storing or using stated materials. 32

Examples of possible alternative solution requirements relating to systems 1
or procedures-- 2
· a requirement that all of the building's final exit doors be unlocked 3
before it is occupied on the start of any day 4
· a requirement to implement stated evacuation strategies or 5
procedures 6
· a restriction on the number and the distribution of the building's 7
occupants 8
· a requirement that evacuation routes be kept clear of fittings and 9
furnishings or be kept sterile 10
· a prohibition on carrying out any hazardous processes or storage 11
mentioned in BCA, part E1.5, table E1.5, note 3, paragraph (a).'. 12

`108A Owner's obligations about access to certificate of 16
classification 17
`(1) This section applies to the owner of a building if-- 18
(a) a certificate of classification has been given for the 19
building; and 20
(b) the certificate was given on or after 1 July 1997; and 21
(c) all or part of the building is occupied. 22
`(2) If the building is not a class 1a building, the owner must 23
ensure the certificate is conspicuously displayed as near as 24
practicable to the building's main entrance. 25
Maximum penalty--165 penalty units. 26

`(3) An authorised officer may require the owner to produce the 1
certificate for inspection at the building. 2
`(4) The owner must comply with the requirement. 3
Maximum penalty--165 penalty units. 4
`(5) Subsections (3) and (4) do not apply if the certificate is 5
displayed as mentioned in subsection (2). 6
`(6) For subsections (2) to (5), a reference to the certificate 7
includes a reference to a copy of the certificate. 8
`(7) In this section-- 9
authorised officer means-- 10
(a) a fire service officer under the Fire and Rescue Service 11
Act 1990; or 12
(b) an authorised person under the Local Government Act 13
1993 carrying out functions in relation to this Act.'. 14
Clause 6 Insertion of new s 114A 15

`114A Owner's obligation to comply with certificate of 18
classification 19
`(1) This section applies if-- 20
(a) a certificate of classification has been given for a 21
building; and 22
(b) the certificate states a restriction mentioned in section 23
103(d) or a requirement of a type mentioned in section 24
103(e). 25
`(2) The owner of the building must, unless the owner has a 26
reasonable excuse, ensure the requirement or restriction is 27
complied with. 28
Maximum penalty--165 penalty units.'. 29

(iii) whose benefit under the LG Super scheme has not 31
been fully paid out, withdrawn or transferred from 32
