The Parliament of Queensland enacts-- 1

(a) a government company within the meaning of the Government 14
Owned Corporations Act 1993; or 15
(b) a State instrumentality, agency, authority or entity; or 16

"owner-builder permit" means an owner-builder permit under the 19
Queensland Building Services Authority Act 1991; 20
"person" includes government entity and unincorporated body; 21
"substantially engaged in the building and construction industry" has 22
the meaning given by section 3A;'. 23

`63.(1) Levy is not payable for building and construction work, or the 6
part of the work, that the Board decides-- 7
(a) is to be carried out by or for a person (other than an individual 8
carrying out building and construction work under an 9
owner-builder permit) who is not substantially engaged in the 10
building and construction industry; and 11
(b) is carried out by the person's employees. 12
`(2) A regulation may provide that levy is not payable for-- 13
(a) specified building and construction work; or 14
(b) a specified part of specified building and construction work. 15

`Rate
`64.(1) The amount of the levy for building and construction work is the 17
percentage prescribed by regulation of the cost of the work. 18
`(2) An amount calculated under subsection (1) is to be rounded to the 19
nearest dollar (with 50c to be rounded downwards). 20

`Meaning
`65.(1) The "cost of building and construction work" is-- 22
(a) for work that is carried by an individual under an owner-builder 23
permit issued to the individual--the cost of the work as decided 24
by the Board less the value, under subsection (2), of the part of 25
the work carried out personally by the individual; or 26
(b) for other work-- 27

(i) the contract price for the work or, if the work involves more 1
than 1 contract, the total of the contract prices; or 2
(ii) if there is no contract price--the cost of the work as decided 3
by the Board. 4
`(2) The value under subsection (1)(a) of the part of the work carried out 5
personally by the individual is-- 6
(a) the percentage prescribed by regulation of the cost of the work; or 7
(b) if the individual can establish, to the satisfaction of the Board, a 8
higher value for the part of the work carried out personally by the 9
individual--that value. 10
`(3) Despite subsection (1)(b)(i), if the Board is satisfied that the contract 11
price for carrying out building and construction work is not an accurate 12
estimate of the cost of the work, the cost may be decided by the Board. 13

`Liability
`65A. Levy for building and construction work must be paid by-- 15
(a) if an application is made to a local authority under the Building 16
Act 1975 for approval of the work--the person who makes the 17
application; or 18
(b) in any other case--the person for whom the work is to be done. 19

`When
`65B.(1) Levy for building and construction work to be carried out by a 21
person (other than a government entity) must be paid-- 22
(a) before application is made to a local authority under the Building 23
Act 1975 for approval of the work; or 24
(b) if application is not made under that Act for approval of the 25
work--before the work is started or, if the Board allows a later 26
time for payment, that time. 27
`(2) Levy for building and construction work to be carried out by a 28

government entity must be paid before the time, after the start of the work, 1
decided by the Board. 2

`65C.(1) A government entity must notify the Board of building and 4
construction work the entity carries out, or causes to be carried out, within 5
3 months of the start of the work. 6
`(2) Subsection (1) applies only if the cost of the work is not less than the 7
cost prescribed by regulation. 8
`(3) Subsection (1) is in addition to section 70(2). 9

`Duty
`65D.(1) A local authority may accept an application under the Building 11
Act 1975 for the approval of building and construction work only if the local 12
authority has seen an approved form issued by the Board signifying, for the 13
work-- 14
(a) payment of levy; or 15
(b) payment of the first instalment of levy; or 16
(c) an exemption from payment of levy; or 17
(d) an exemption from immediate payment of levy. 18
`(2) A local authority is entitled to be paid remuneration by the Board for 19
carrying out its duty under this section at the rate prescribed by regulation.'. 20
