The Parliament of Queensland enacts-- 1
1 Short title
Clause 2
This Act may be cited as the Building Amendment Act 2003. 3
2 Commencement

This Act commences on a day to be fixed by proclamation. 5

`In this part-- 2
"construct", an outdoor swimming pool on residential land, includes 3
install or place the pool on the land. 4

Examples--

1. A person constructs an outdoor swimming pool on residential land if the
7
person installs the pool above ground level on the land.
8
2. A person constructs an outdoor swimming pool on residential land if the
9
pool is a portable one and the person places it on the land.
"fencing standards" see section 12U. 10
"pool owner" see section 12V. 11
`12U Meaning of "fencing standards" 12
`(1) The "fencing standards", for an outdoor swimming pool on 13
residential land, are-- 14
(a) for a pool constructed before the commencement of this 15
section--the requirements, including standards, applying under 16
this Act for the fencing of the pool immediately before the 17
commencement; or 18
(b) for a pool constructed on or after the commencement of this 19
section--the standards prescribed under a regulation for the 20
fencing of the pool. 21
`(2) However, if on the commencement of this section an existing 22
outdoor swimming pool on residential land is not fenced or the fencing 23
does not comply substantially with the fencing standards under 24
subsection (1)(a) for the fencing of the pool immediately before the 25
commencement, the "fencing standards" for the pool are the standards 26
prescribed under subsection (1)(b). 27
`12V Meaning of "pool owner" 28
`(1) The owner of residential land on which there is an outdoor 29
swimming pool is the "pool owner" of the pool. 30
`(2) However, if the occupier of residential land, or that part of the land, 31
on which an outdoor swimming pool is situated is the owner of the pool but 32

not the owner of the land, the occupier, and not the owner of the land, is the 1
"pool owner" of the pool.'. 2

`14 Outdoor swimming pool must be fenced 6
`(1) The pool owner of an outdoor swimming pool on residential land 7
must ensure-- 8
(a) the pool has, around the pool, fencing complying with the 9
fencing standards for the pool; and 10
(b) the fencing is kept in good condition. 11
Maximum penalty--165 penalty units. 12
`(2) However, if the pool's fencing no longer complies with 13
subsection (1)(a) only because the owner or occupier of adjoining land has 14
constructed or placed something on the adjoining land, the pool owner of 15
the pool is not required to construct additional fencing or change existing 16
fencing to comply with subsection (1)(a). 17
`15 Resuscitation sign for outdoor swimming pool 18
`(1) This section applies to an outdoor swimming pool on residential 19
land if the pool is constructed after the commencement of this section. 20
`(2) The pool owner of the pool must, in the way prescribed under a 21
regulation, ensure that there is always displayed for the pool a resuscitation 22
sign complying with the requirements for a resuscitation sign prescribed 23
under a regulation. 24
Maximum penalty--20 penalty units. 25
`(3) In this section-- 26
"resuscitation sign" means a sign showing procedures for providing first 27
aid, including, for example, expired air resuscitation and external 28
cardiac compression. 29

`16 Replacing fencing 1
`If a fence around a pool owner's outdoor swimming pool on residential 2
land has been demolished or removed, or is in substantial disrepair to the 3
extent that it is impracticable to keep the fencing in good condition as 4
required under section 14(1)(b), the pool owner must ensure-- 5
(a) there is constructed around the pool a new fence complying with 6
the fencing standards for the pool, as if the pool were a pool 7
constructed at the time the new fence is required to be 8
constructed;1 and 9
(b) a building certifier has provided a certificate in the approved 10
form stating the fencing complies with the fencing standards for 11
the pool. 12
Maximum penalty--20 penalty units. 13
`16A Warning sign required before constructing outdoor swimming 14
pool 15
`(1) This section applies to the construction of an outdoor swimming 16
pool on residential land. 17
`(2) Each relevant person must ensure that-- 18
(a) before the construction starts, a warning sign, complying with 19
the requirements for a warning sign prescribed under a 20
regulation, is displayed on the land in the way prescribed under a 21
regulation; and 22
(b) the warning sign is displayed until-- 23
(i) fencing complying with the fencing standards for the pool 24
has been constructed; and 25
(ii) a building certifier certifies the fencing complies with the 26
fencing standards for the pool. 27
Maximum penalty--20 penalty units. 28
`(3) In this section-- 29
"relevant person" means-- 30

(a) the person who is, or is to become, the pool owner of the pool; or 1
(b) the builder of the pool. 2

`(1) This section applies to a person if-- 4
(a) an outdoor swimming pool has been constructed, or is being 5
constructed, on residential land; and 6
(b) the pool has not been filled with water to a depth of 300 mm or 7
more; and 8
(c) the person is, or is to become, the pool owner of the pool. 9
`(2) The person must, unless the person has a reasonable excuse, ensure 10
that, before the pool is filled with water to a depth of 300 mm or more-- 11
(a) fencing that complies with the fencing standards for the pool is 12
constructed around the pool; and 13
(b) a building certifier has provided a certificate in the approved 14
form stating the fencing complies with the fencing standards for 15
the pool. 16
Maximum penalty--165 penalty units. 17
`16C Application for exemption from fencing 18
`(1) A person may apply to the local government for an exemption from 19
complying with the fencing standards for an outdoor swimming pool on 20
residential land if the person is-- 21
(a) the pool owner of the pool; or 22
(b) if the pool is still to be constructed--the person who is to be the 23
pool owner of the pool. 24
`(2) If an application for exemption is made under this section, the local 25
government must decide the application within 5 business days after the 26
application is made. 27
`(3) The local government may grant the exemption only if it is satisfied 28
that-- 29
(a) a person with a disability is, or is to become, an occupier of the 30
land; and 31

(b) it would be physically impracticable for the person, because of 1
the person's disability, to access the pool if it had fencing 2
complying with the fencing standards for the pool. 3
`(4) The local government may require the applicant to produce medical 4
evidence to support the application. 5
`(5) The local government may grant the exemption on conditions it 6
considers necessary or desirable to prevent a young child accessing the 7
pool. 8
`16D Steps to be taken after application decided 9
`(1) As soon as practicable after making its decision on an application 10
for exemption under section 16C, the local government must give the 11
applicant written notice of the decision. 12
`(2) The notice must state the following-- 13
(a) the reasons for the decision; 14
(b) the decision may be appealed to a tribunal under the Integrated 15
Planning Act 1997; 16
(c) the appeal must be made within 20 business days after the day 17
the applicant receives the notice. 18
`(3) If the local government grants the exemption, the fencing standards 19
for the pool continue to apply for the pool to the extent the exemption does 20
not apply. 21
`(4) The exemption ends if-- 22
(a) the applicant stops being the pool owner for the pool; or 23
(b) the person because of whom the exemption was granted is no 24
longer an occupier of the land; or 25
(c) it would no longer be physically impracticable for the person 26
because of whom the exemption was granted to access the pool if 27
it had fencing complying with the fencing standards for the pool. 28
`(5) If the exemption is granted on conditions, the applicant must comply 29
with each condition attached to the exemption. 30
Maximum penalty for subsection (5)--165 penalty units. 31

`16E Revocation of exemption 1
`(1) This section applies if-- 2
(a) a local government has, under section 16C, previously granted an 3
applicant an exemption; and 4
(b) the local government is satisfied 1 or more of the following 5
applies-- 6
(i) the decision on the application for the exemption was based 7
on a false or misleading particular given by the applicant; 8
(ii) the exemption has ended under section 16D(4); 9
(iii) the exemption was subject to conditions and there has been 10
a contravention of a condition. 11
`(2) The local government must give the applicant a show cause notice 12
inviting the applicant to show cause why the decision should not be 13
revoked. 14
`(3) After considering any representations made to it under the show 15
cause notice, the local government may, by a further written notice 16
(a "revocation notice") given to the applicant, revoke the decision 17
previously given. 18
`(4) The revocation notice must specify-- 19
(a) that the applicant must ensure the pool has, around the pool, 20
fencing complying with the fencing standards for the pool; and 21
(b) the day by which the applicant must comply with the notice. 22
`(5) The applicant must comply with the revocation notice. 23
Maximum penalty--165 penalty units. 24
`(6) If the applicant fails to comply with the notice, the failure is taken to 25
be a failure to perform work under the Local Government Act 1993, 26
section 1066.2'. 27

"unamended Act" means this Act as in force before the commencing day. 17
`58B Existing exemption from fencing swimming pool 18
`(1) This section applies if, immediately before the commencing day-- 19
(a) an application for an exemption from complying with the 20
unamended Act, section 14(2),3 had been granted to a person 21
under the unamended Act, section 15;4 and 22
(b) the decision had not been revoked under the unamended Act, 23
section 16.5 24

`(2) On and from the commencing day, the unamended Act continues to 1
apply for the exemption as if the unamended Act had not been amended by 2
the amending Act. 3
`(3) If the exemption was subject to a condition, the exemption is taken 4
to be subject to the same condition. 5
`58C Undecided application for exemption from fencing swimming 6
pool 7
`(1) This section applies if-- 8
(a) a person has, under the unamended Act, section 15, applied to the 9
local government for exemption from complying with the 10
unamended Act, section 14(2); and 11
(b) immediately before the commencing day, the application had not 12
been decided. 13
`(2) The unamended Act continues to apply to the application, and to any 14
exemption, including any condition of the exemption, applying as a result 15
of granting the exemption, as if the unamended Act had not been amended 16
by the amending Act. 17
`58D When resuscitation sign for outdoor swimming pool not required 18
`(1) This section applies to an outdoor swimming pool constructed on 19
residential land if-- 20
(a) the lawful carrying out of the work started before the 21
commencing day; or 22
(b) approval to carry out the work was given before the commencing 23
day, but the work does not start before the commencing day; or 24
(c) application to carry out the work was made before the 25
commencing day, but the application was not decided before the 26
commencing day. 27
`(2) Section 156 does not apply to the pool. 28

`59 Revocation of decisions or previous variations 1
`The unamended Act, section 16, continues to apply to the following as 2
if it had not been repealed by the amending Act-- 3
(a) a decision made under the unamended Act, section 15; 4
(b) a variation given under section 30M as in force immediately 5
before the commencement of the Building and Integrated 6
Planning Amendment Act 1998, part 2.7'. 7
