2002 A BILL FOR An Act to amend legislation about animal and plant health, and for other purposes

 


 

s1 6 s4 Animal and Plant Health Legislation Amendment Bill 2002 The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 1 Short title Clause 3 This Act may be cited as the Animal and Plant Health Legislation 4 Amendment Act 2002. 5 2 Commencement Clause 6 This Act commences on a day to be fixed by proclamation. 7 PART 2--AMENDMENT OF AGRICULTURAL 8 STANDARDS ACT 1994 9 3 Act amended in pt 2 Clause 10 This part amends the Agricultural Standards Act 1994. 11 4 Amendment of s 4 (Definitions) Clause 12 (1) Section 4, `In this Act--'-- 13 omit, insert-- 14 `The dictionary in the schedule defines particular words used in this 15 Act.'. 16 (2) Section 4-- 17 insert-- 18 ` "exotic disease" see Exotic Diseases in Animals Act 1981, schedule 2.'. 19 (3) Section 4, definition "stock", `section 4'-- 20

 


 

s5 7 s5 Animal and Plant Health Legislation Amendment Bill 2002 omit, insert-- 1 `schedule 2'. 2 (4) Section 4, definitions (as amended)-- 3 relocate to the schedule as inserted by this Act. 4 5 Amendment of s 20 (Entry to places) Clause 5 (1) Section 20-- 6 insert-- 7 `(e) it is a place other than a place where people reside and entry is 8 made-- 9 (i) to check compliance with a provision of this Act about the 10 content, labelling or sale of food for stock; and 11 (ii) for the purpose of preventing the introduction of an exotic 12 disease into the State or controlling the spread of an exotic 13 disease; and 14 (iii) at a reasonable time.'. 15 (2) Section 20-- 16 insert-- 17 `(2) Before entering a place under subsection (1)(e), the inspector must 18 do or make a reasonable attempt to do all of the following-- 19 (a) comply with section 19(1); 20 (b) tell the occupier of the place the inspector is authorised under 21 this Act to enter the place; 22 (c) give the occupier an opportunity to consent to the entry.'. 23

 


 

s6 8 s8 Animal and Plant Health Legislation Amendment Bill 2002 PART 3--AMENDMENT OF EXOTIC DISEASES IN 1 ANIMALS ACT 1981 2 6 Act amended in pt 3 Clause 3 This part amends the Exotic Diseases in Animals Act 1981. 4 7 Amendment of s 5 (Definitions)-- Clause 5 (1) Section 5, `In this Act--'-- 6 omit, insert-- 7 `The dictionary in schedule 2 defines particular words used in this Act.'. 8 (2) Section 5, definition "inspector"-- 9 omit, insert-- 10 ` "inspector" means-- 11 (a) an inspector appointed under part 2, division 5A; or 12 (b) an inspector of stock appointed under the Stock Act 1915; or 13 (c) the chief inspector.'. 14 (3) Section 5, definition "exotic disease", after `rinderpest,'-- 15 insert-- 16 `spongiform encephalopathy,'. 17 (4) Section 5, definitions (as amended)-- 18 relocate to schedule 2 as inserted by this Act. 19 8 Amendment of s 12 (Powers of inspectors in order to eradicate Clause 20 and prevent spread of exotic disease) 21 (1) Section 12, heading, `in order to'-- 22 omit, insert-- 23 `to control,'. 24 (2) Section 12(1)-- 25 insert-- 26

 


 

s9 9 s 10 Animal and Plant Health Legislation Amendment Bill 2002 `(c) destroy any of the following in a restricted area-- 1 (i) an infected animal, animal product or carcass; 2 (ii) any thing used in connection with the infected animal, 3 animal product or carcass; 4 (iii) an animal pathogen or biological preparation; 5 (iv) infected or suspected pasture or fodder; 6 (v) any other thing the inspector reasonably believes may be 7 infected.'. 8 9 Amendment of s 17 (Effect of notification) Clause 9 (1) Section 17(1), `shall not'-- 10 omit, insert-- 11 `must not, without an inspector's written approval,'. 12 (2) Section 17-- 13 insert-- 14 `(1A) An inspector may give an approval mentioned in subsection (1) 15 only if the inspector considers it necessary to give the approval in the 16 interests of public health or safety, or the health or wellbeing of an animal.'. 17 10 Amendment of s 19 (Powers of chief inspector and inspectors) Clause 18 (1) Section 19(1), from `thereof', first mention to `may--'-- 19 omit, insert-- 20 `of the area may, by public notice--'. 21 (2) Section 19-- 22 insert-- 23 `(5) In this section-- 24 "public notice" means a notice published in a newspaper, or broadcast on 25 radio or television, and likely to be read or received by people in the 26 control area, or the part of the area, to which the notice relates.'. 27

 


 

s 11 10 s 11 Animal and Plant Health Legislation Amendment Bill 2002 11 Insertion of new pt 2, div 5A Clause 1 After section 19-- 2 insert-- 3 `Division 5A--Inspectors 4 `19A Appointment and qualifications 5 `(1) The chief executive may appoint any of the following persons as an 6 inspector-- 7 (a) a public service officer or employee; 8 (b) an employee of the Commonwealth or another State; 9 (c) an employee of a local government; 10 (d) a veterinary surgeon under the Veterinary Surgeons Act 1936; 11 (e) an individual included in a class of persons declared under a 12 regulation to be an approved class of persons for this section. 13 `(2) However, the chief executive may appoint a person as an inspector 14 only if the chief executive is satisfied the person is qualified for 15 appointment because the person has the necessary expertise or experience. 16 `19B Appointment conditions and limit on powers 17 `(1) An inspector holds office on any conditions stated in-- 18 (a) the inspector's instrument of appointment; or 19 (b) a signed notice given to the inspector; or 20 (c) a regulation. 21 `(2) The instrument of appointment, a signed notice given to the 22 inspector or a regulation may limit the inspector's powers under this Act. 23 `(3) In this section-- 24 "signed notice" means a notice signed by the chief executive. 25 `19C Issue of identity card 26 `(1) The chief executive must issue an identity card to each inspector. 27

 


 

s 11 11 s 11 Animal and Plant Health Legislation Amendment Bill 2002 `(2) The identity card must-- 1 (a) contain a recent photo of the inspector; and 2 (b) contain a copy of the inspector's signature; and 3 (c) identify the person as an inspector under this Act; and 4 (d) state an expiry date for the card. 5 `(3) This section does not prevent the issue of a single identity card to a 6 person for this Act and other purposes. 7 `19D Production or display of identity card 8 `(1) In exercising a power under this Act in relation to a person, an 9 inspector must-- 10 (a) produce the inspector's identity card for the person's inspection 11 before exercising the power; or 12 (b) have the identity card displayed so it is clearly visible to the 13 person when exercising the power. 14 `(2) However, if it is not practicable to comply with subsection (1), the 15 inspector must-- 16 (a) produce the inspector's instrument of appointment for the 17 person's inspection before exercising the power; or 18 (b) produce the identity card for the person's inspection at the first 19 reasonable opportunity. 20 `(3) For subsection (1), an inspector does not exercise a power in relation 21 to a person only because the inspector-- 22 (a) has entered a place that is a public place and entry is made when 23 it is open to the public; or 24 (b) for the purpose of asking the occupier of a place for consent to 25 enter-- 26 (i) enters land around premises at the place to an extent that is 27 reasonable to contact the occupier; or 28 (ii) enters part of the place the inspector reasonably considers 29 members of the public ordinarily are allowed to enter when 30 they wish to contact the occupier. 31

 


 

s 12 12 s 12 Animal and Plant Health Legislation Amendment Bill 2002 `19E When inspector ceases to hold office 1 `(1) An inspector ceases to hold office if any of the following happens-- 2 (a) the term of office stated in a condition of office ends; 3 (b) under another condition of office, the inspector ceases to hold 4 office; 5 (c) the inspector's resignation under section 19F takes effect. 6 `(2) Subsection (1) does not limit the ways an inspector may cease to 7 hold office. 8 `(3) In this section-- 9 "condition of office" means a condition on which the inspector holds 10 office. 11 `19F Resignation 12 `(1) An inspector may resign by signed notice given to the chief 13 executive. 14 `(2) However, if holding office as an inspector is a condition of the 15 inspector holding another office, the inspector may not resign as an 16 inspector without resigning from the other office. 17 `19G Return of identity card 18 `A person who ceases to be an inspector must return the person's identity 19 card to the chief executive within 21 days after ceasing to be an inspector 20 unless the person has a reasonable excuse. 21 Maximum penalty--20 penalty units. 22 12 Amendment of s 20 (General powers of inspectors) Clause 23 Section 20(1)(h), `trap and destroy'-- 24 omit, insert-- 25 `bait, trap or destroy'. 26

 


 

s 13 13 s 14 Animal and Plant Health Legislation Amendment Bill 2002 13 Amendment of s 22 (Destruction of animals etc.) Clause 1 Section 22-- 2 insert-- 3 `(4) For subsection (1), an animal is taken to be suspected if-- 4 (a) the animal is an animal that is a host for an exotic disease or 5 animal pathogen present, or suspected to be present, at an 6 infected premises; and 7 (b) the chief inspector reasonably believes it is necessary to destroy 8 the animal to prevent or control the spread of the exotic disease 9 or animal pathogen, having regard to-- 10 (i) the animal's proximity to the infected premises; and 11 (ii) the ability of the disease or animal pathogen to spread and 12 the way in which it spreads.'. 13 14 Insertion of new s 24A Clause 14 Part 2, after section 24-- 15 insert-- 16 `24A No review of particular decision 17 `(1) This section applies to a decision of the Minister, under section 22, 18 to order-- 19 (a) the destruction of an animal, animal product, carcass or other 20 thing; or 21 (b) the removal or destruction of an animal pathogen or biological 22 preparation. 23 `(2) The decision-- 24 (a) is final and conclusive; and 25 (b) can not be challenged, appealed against, reviewed, quashed, set 26 aside, or called in question in another way, under the Judicial 27 Review Act 1991 or otherwise (whether by the Supreme Court, 28 another court, a tribunal or another entity); and 29 (c) is not subject to any writ or order of the Supreme Court, another 30 court, a tribunal or another entity on any ground. 31

 


 

s 15 14 s 15 Animal and Plant Health Legislation Amendment Bill 2002 `(3) Despite subsection (2), the Judicial Review Act 1991, part 4,1 applies 1 to the decision as if it were a decision to which that Act applies. 2 `(4) In this section-- 3 "decision" includes conduct leading up to or forming part of the process of 4 making a decision.'. 5 15 Replacement of s 41 (Proceedings for offences) Clause 6 Section 41-- 7 omit, insert-- 8 `41 Indictable and summary offences 9 `(1) An offence against section 9(3), 11(1), 14(2) or 17(1)2 is a 10 misdemeanour. 11 `(2) Any other offence against this Act is a summary offence. 12 `41A Proceedings for indictable offence 13 `(1) A proceeding for an indictable offence against this Act may be 14 taken, at the election of the prosecution-- 15 (a) by way of summary proceeding under the Justices Act 1886; or 16 (b) on indictment. 17 `(2) A magistrate must not hear an indictable offence summarily if-- 18 (a) the defendant asks at the start of the hearing that the charge be 19 prosecuted on indictment; or 20 (b) the magistrate considers the charge should be prosecuted on 21 indictment. 22 `(3) If subsection (2) applies-- 23 (a) the magistrate must proceed by way of an examination of 24 witnesses for an indictable offence; and 25 1 Judicial Review Act 1991, part 4, (Reasons for decision) 2 Section 9 (Infected premises), 11 (Effect of Notification), 14 (Entry and exit places) or 17 (Effect of Notification)

 


 

s 16 15 s 16 Animal and Plant Health Legislation Amendment Bill 2002 (b) a plea of the person charged at the start of the proceeding must be 1 disregarded; and 2 (c) evidence brought in the proceeding before the magistrate decided 3 to act under subsection (2) is taken to be evidence in the 4 proceeding for the committal of the person for trial or sentence; 5 and 6 (d) before committing the person for trial or sentence, the magistrate 7 must make a statement to the person as required by the Justices 8 Act 1886, section 104(2)(b).3 9 `41B Limitation on who may summarily hear indictable offence 10 `(1) The proceeding must be before a magistrate if it is a proceeding-- 11 (a) for the summary conviction of a person on a charge for an 12 indictable offence; or 13 (b) for an examination of witnesses for a charge for an indictable 14 offence. 15 `(2) However, if the proceeding is brought before a justice who is not a 16 magistrate, jurisdiction is limited to taking or making a procedural action 17 or order within the meaning of the Justices of the Peace and 18 Commissioners for Declarations Act 1991. 19 `41C Limitation on time for starting summary proceeding 20 `A proceeding for a summary offence against this Act by way of 21 summary proceeding under the Justices Act 1886 must start-- 22 (a) within 1 year after the commission of the offence; or 23 (b) within 6 months after the offence comes to the complainant's 24 knowledge, but within 2 years after the commission of the 25 offence.'. 26 16 Amendment of s 47 (Regulations) Clause 27 Section 47-- 28 3 Justices Act 1886, section 104 (Proceedings upon an examination of witnesses in relation to an indictable offence)

s 19 17 s 21 Animal and Plant Health Legislation Amendment Bill 2002 19 Amendment of s 102 (Revocation of quarantine or emergency Clause 1 quarantine declaration) 2 (1) Section 102, heading, `or emergency quarantine'-- 3 omit. 4 (2) Section 102, `or emergency quarantine declaration'-- 5 omit, insert-- 6 `declaration, other than an emergency quarantine declaration,'. 7 PART 5--AMENDMENT OF PLANT PROTECTION 8 ACT 1989 9 20 Act amended in pt 5 Clause 10 This part amends the Plant Protection Act 1989. 11 21 Amendment of s 3 (Definitions) Clause 12 (1) Section 3, `In this Act--'-- 13 omit, insert-- 14 `The dictionary in the schedule defines particular words used in this 15 Act.'. 16 (2) Section 3, definition "assurance certificate", words before 17 paragraph (a)-- 18 omit, insert-- 19 ` "assurance certificate" means a certificate under part 4 about a plant or 20 other thing, including, for example, a certificate that a plant or 21 thing--'. 22 (3) Section 3, definitions (as amended)-- 23 relocate to the schedule as inserted by this Act. 24

s 28 21 s 28 Animal and Plant Health Legislation Amendment Bill 2002 `(6) The direction may be given orally or by written notice. 1 `(7) If the direction is given orally, the inspector must as soon as 2 practicable confirm the direction by written notice given to the owner. 3 `(8) When giving the direction under subsection (5)(a), the inspector 4 must warn the owner it is an offence not to comply with the direction 5 unless the owner has a reasonable excuse. 6 `(9) The owner must comply with the direction unless the owner has a 7 reasonable excuse. 8 Maximum penalty--100 penalty units. 9 `(10) If the inspector takes the steps, the inspector may also exercise any 10 of the powers of an inspector under this division. 11 `(11) The inspector may exercise the powers mentioned in 12 subsections (3), (5)(b) and (10) with the help, and using the force, that is 13 necessary and reasonable in the circumstances. 14 `(12) In exercising or attempting to exercise the powers mentioned in 15 subsections (3), (5)(b) and (10), an inspector must take all reasonable steps 16 to ensure the inspector causes as little inconvenience to any person on the 17 land, and does as little damage, as is practicable in the circumstances. 18 `(13) This section does not limit any power an inspector has apart from 19 this section. 20 `(14) If an inspector authorises a person to take steps under 21 subsection (5)(c)-- 22 (a) the person may exercise the powers mentioned in 23 subsection (10); and 24 (b) the inspector must inform the person-- 25 (i) of the steps the person is authorised to take; and 26 (ii) of the person's powers under this section. 27 `(15) In this section-- 28 "land" does not include premises, or a part of premises, where a person 29 resides.'. 30

s 33 24 s 33 Animal and Plant Health Legislation Amendment Bill 2002 (a) a public service officer or employee; 1 (b) an employee of the Commonwealth or another State; 2 (c) an employee of a local government; 3 (d) a veterinary surgeon under the Veterinary Surgeons Act 1936; 4 (e) an individual included in a class of persons declared under a 5 regulation to be an approved class of persons for this section. 6 `(2) However, the chief executive may appoint a person as an inspector 7 only if the chief executive is satisfied the person is qualified for 8 appointment because the person has the necessary expertise or experience. 9 `4E Appointment conditions and limit on powers of inspectors 10 `(1) An inspector holds office on any conditions stated in-- 11 (a) the inspector's instrument of appointment; or 12 (b) a signed notice given to the inspector; or 13 (c) a regulation. 14 `(2) The instrument of appointment, a signed notice given to the 15 inspector or a regulation may limit the inspector's powers under this Act. 16 `(3) In this section-- 17 "signed notice" means a notice signed by the chief executive. 18 `4F Issue of inspector's identity card 19 `(1) The chief executive must issue an identity card to each inspector. 20 `(2) The identity card must-- 21 (a) contain a recent photo of the inspector; and 22 (b) contain a copy of the inspector's signature; and 23 (c) identify the person as an inspector under this Act; and 24 (d) state an expiry date for the card. 25 `(3) This section does not prevent the issue of a single identity card to a 26 person for this Act and other purposes. 27

 


 

s 33 25 s 33 Animal and Plant Health Legislation Amendment Bill 2002 `4G Production or display of inspector's identity card 1 `(1) In exercising a power under this Act in relation to a person, an 2 inspector must-- 3 (a) produce the inspector's identity card for the person's inspection 4 before exercising the power; or 5 (b) have the identity card displayed so it is clearly visible to the 6 person when exercising the power. 7 `(2) However, if it is not practicable to comply with subsection (1), the 8 inspector must produce the identity card for the person's inspection at the 9 first reasonable opportunity. 10 `(3) For subsection (1), an inspector does not exercise a power in relation 11 to a person only because the inspector-- 12 (a) has entered a place that is a public place and entry is made when 13 it is open to the public; or 14 (b) for the purpose of asking the occupier of a place for consent to 15 enter-- 16 (i) enters land around premises at the place to an extent that is 17 reasonable to contact the occupier; or 18 (ii) enters part of the place the inspector reasonably considers 19 members of the public ordinarily are allowed to enter when 20 they wish to contact the occupier. 21 `4H When inspector ceases to hold office 22 `(1) An inspector ceases to hold office if any of the following happens-- 23 (a) the term of office stated in a condition of office ends; 24 (b) under another condition of office, the inspector ceases to hold 25 office; 26 (c) the inspector's resignation under section 4I takes effect. 27 `(2) Subsection (1) does not limit the ways an inspector may cease to 28 hold office. 29 `(3) In this section-- 30 "condition of office" means a condition on which the inspector holds 31 office. 32
