An Act to request the amendment of the Australia Acts 1986 in
connection with proposed constitutional arrangements to
establish the Commonwealth of Australia as a republic

Preamble-- 1
Parliament's reasons for enacting this Act are-- 2
1. The Government of the Commonwealth proposes to introduce a Bill 3
for a proposed law to alter the Constitution of the Commonwealth to 4
establish the Commonwealth of Australia as a republic with a President 5
chosen by a twothirds majority of the members of the Commonwealth 6
Parliament. 7
2. If passed by an absolute majority of each House of the Parliament, the 8
proposed law will be put to the Australian people at a constitutional 9
referendum in accordance with section 128 of the Constitution of the 10
Commonwealth. 11
3. If the proposed law is approved by the Australian people, it is desirable 12
that the Australia Act 1986 of the Commonwealth and the Australia Act 13
1986 of the Parliament of the United Kingdom be amended to remove any 14
impediment to the alteration by a State of its laws relating to the powers and 15
functions of Her Majesty and the Governor in respect of the State. 16
4. Section 15(1) of each of the Australia Acts mentioned in provision 3 17
of this preamble provides for the amendment of each of those Acts by an 18
Act of the Parliament of the Commonwealth passed at the request or with 19
the concurrence of the Parliaments of all the States and, subject to section 20
15(3) of each of those Acts, only in that manner. 21

2. This Act commences on the day after the day on which the 5
Constitution Alteration (Establishment of Republic) 1999 of the 6
Commonwealth receives the Royal Assent. 7

3. The purpose of this Act is to request the amendment of the Australia 9
Acts 1986 in connection with proposed constitutional arrangements to 10
establish the Commonwealth of Australia as a republic. 11

Commonwealth and section 7 of the Australia Act 1986 of the 3
Parliament of the United Kingdom 4
The Parliament of Australia enacts: 5
1 Short title 6
This Act may be cited as the Australia Acts Amendment 7
Act 1999. 8
2 Commencement 9
(1) This Act commences on a day to be fixed by 10
Proclamation. 11
(2) That day must not be before the day on which the 12
Constitution Alteration (Establishment of Republic) 1999 13
receives the Royal Assent. 14
3 Schedule(s) 15
Each Act that is specified in a Schedule to this Act is 16
amended or repealed as set out in the applicable items in 17
the Schedule concerned, and any other item in a Schedule 18
to this Act has effect according to its terms. 19

SCHEDULE 1--Australia Act 1986 of the Commonwealth 1
1. At the end of section 7 2

(6) The Parliament of a State may make a law providing that 4
the preceding subsections do not apply to the State. 5
(7) Upon the coming into effect in a State of a law referred to 6
in subsection (6), this section ceases to apply to the State 7
as provided by that law. 8
SCHEDULE 2--Australia Act 1986 of the Parliament of the United 9
Kingdom 10
1. Amendment of Imperial Act 11
The Australia Act 1986 of the Parliament of the United Kingdom is 12
amended as set out in this Schedule, so far as that Act is part of the 13
law of Australia or of an external Territory. 14
2. At the end of section 7 15

(6) The Parliament of a State may make a law providing that 17
the preceding subsections do not apply to the State. 18
(7) Upon the coming into effect in a State of a law referred to 19
in subsection (6), this section ceases to apply to the State 20
