WORK HEALTH AND SAFETY (NATIONAL UNIFORM LEGISLATION) ACT 2011 (NO 39 OF 2011) - SECT 114

    (1)     The making of an order in a proceeding under section 112 in relation to conduct referred to in section 112 (2)(a) or (b) does not prevent the bringing of a proceeding for an offence under section  104 or 2011_Actw025.html#_Ref295134186">107 in relation to the same conduct.

    (2)     If the Work Health Court makes an order under section  112 in a proceeding in relation to conduct referred to in section 112 (2)(a) or (b), the court cannot make an order under section 111 in a proceeding for an offence under section 104 or 2011_Actw025.html#_Ref295134186">107 in relation to the same conduct.

    (3)     If the court makes an order under section 111 in a proceeding for an offence under section 104 or 2011_Actw025.html#_Ref295134186">107 , the court cannot make an order under section 112 in a proceeding in relation to conduct referred to in section 112 (2)(a) or (b) that is the same conduct.
