CARE AND PROTECTION OF CHILDREN ACT 2007 (NO 37 OF 2007) - SECT 103
Applying for temporary protection order(1) The CEO may apply to the Court for a temporary protection order for a child if:
(a) the CEO reasonably believes:
(i) the child is in need of protection; and
(ii) the proposed order is urgently needed to safeguard the wellbeing of the child; and
(b) no protection order is in force for the child.
(2) The CEO may make the application:
(a) whether or not an assessment order is in force for the child; and
(b) whether or not the child is in provisional protection.
