ANTI-DISCRIMINATION REGULATIONS - REG 3

Witness fees and allowances for expenses

A person ordered to attend proceedings under the Act as a witness shall be paid in respect of his or her attendance:

        (a)     if remunerated in his or her occupation by wages, salary or fees – an amount equal to the amount of wages, salary or fees not paid to the person because of his or her attendance as a witness;

        (b)     where not so remunerated:

            (i)     if ordered to attend because of his or her professional, scientific or other special skill or knowledge – $92 for each day on which he or she attended or the actual loss of remuneration or income of any kind in respect of that day reasonably caused by the attendance, whichever is the greater amount, but in any case not exceeding $462 per day;

            (ii)     if ordered to attend otherwise than because of his or her professional, scientific or special skill or knowledge – $52 for each day on which he or she attended or the actual loss of remuneration or income of any kind in respect of that day reasonably caused by the attendance, whichever is the greater amount, but in any case not exceeding $86 per day; and

        (c)     the actual expense reasonably incurred for:

            (i)     transport between his or her usual place of residence and the place where he or she attended the proceedings; and

            (ii)     if required to be absent overnight from his or her usual place or residence – meals and accommodation.
