Northern Territory Consolidated Acts Northern Territory Consolidated Acts(1) A person shall not, unless authorised by section 14 or otherwise by or under this Act to do so, take water from a bore except in accordance with a licence granted under this Division.
Penalty: For a first offence – $2,000.
For a second or subsequent offence – not less than $1,000 or more than $5,000.
Default penalty: $200.
(2) In proceedings for an offence against subsection (1), proof of the existence on land of pumping equipment or other prescribed means whereby water is capable of being taken from a bore is prima facie evidence that the water was taken in contravention of that subsection at the time that equipment or those means are proved to have existed.
