WATER ACT - SECT 104

Definition of default penalty

    (1)     Where in, or at the foot of, a section or part of a section there appears the expression "default penalty", it signifies that a person who is found guilty of an offence against this Act in relation to that section or part is guilty of a further offence against this Act if the offence continues after a complaint alleging the commission of that offence has been issued and is liable to an additional penalty for each day during which the offence so continues of not more than the amount expressed in the section or part as the amount of the default penalty.

    (2)     Where an offence is committed by a person by reason of the person's failure to comply with a provision of this Act by or under which the person is required or directed to do something within a particular period or by a particular time, that offence, for the purposes of subsection (1), shall be deemed to continue so long as the thing so required or directed to be done by the person remains undone, notwithstanding that the period has elapsed or time has passed.
