VALIDATION (MINING TENEMENTS) ACT 1987 - SECT 2

Validation of certain mining tenements

    (1)     For the avoidance of doubt:

        (a)     a mining tenement within the meaning of the Mining Act granted or purported to be granted under that Act before the commencement of this Act is declared to have been validly granted notwithstanding that, in respect of that grant or purported grant, a recommendation of a warden may not have been made, transmitted or considered; and

        (b)     a mineral claim within the meaning of the Mining Act granted or purported to be granted under that Act before the commencement of this Act is declared to have been validly granted to an applicant who was not in breach of that Act or the Regulations made under that Act notwithstanding that the Minister or the delegate of the Minister, before granting or purporting to grant that mineral claim, may not have satisfied himself of that requirement,

as required by that Act.

    (2)     A mineral claim within the meaning of the Mining Act granted or purported to be granted under that Act before the commencement of this Act in respect of an application for a mineral claim or dredging claim referred to in section 191(18) of that Act, deemed, by virtue of that subsection to be an application for a mineral claim under that Act, is declared to be not invalid by reason only that the application or the grant or purported grant of that mineral claim was in respect of an area of land greater than that permitted by that Act

or that the Minister or the delegate of the Minister may not have satisfied himself as required by section 86 of that Act.
