UTILITIES COMMISSION ACT - SECT 5

    (1)     The Utilities Commission of the Northern Territory is established.

    (2)     The Utilities Commission is constituted:

        (a)     by the Utilities Commissioner; or

        (b)     if a person is appointed as an Associate Utilities Commissioner under section 12 – by the Utilities Commissioner and the Associate Utilities Commissioner.

    (3)     The Utilities Commission:

        (a)     is a body corporate;

        (b)     has perpetual succession and a common seal;

        (c)     is capable of suing and being sued in its corporate name; and

        (d)     has the functions assigned by or under this or any other Act or conferred by the Minister.

    (4)     The Utilities Commission has all the powers of a natural person together with powers conferred on the Utilities Commission by or under this or any other Act.
