Section 28 does not apply to a person who applies under section 29 for the grant of a tobacco retail licence before 31 May 2003 until -
(a) if the Director makes a decision under section 29 granting the licence - the end of the day on which the applicant is notified under section 40 of the Director's decision; or
(b) if the Director makes a decision under section 29 refusing to grant the licence -
(i) the end of the period for making an application under section 28 of the Northern Territory Licensing Commission Act for a review of the Director's decision by the Northern Territory Licensing Commission; or
(ii) if, during the period referred to in subparagraph (i), the applicant applies for a review of the Director's decision by the Commission - the end of the day on which the applicant is notified under section 29 of the Northern Territory Licensing Commission of the Commission's decision on the application for review.
