(1) Where an employee or agent of, or a person under a contract to, an owner of radioactive material has been found guilty of an offence under this Act, and the offence was committed in the course of employment or agency or whilst carrying out the contract, the owner shall be guilty of an offence.
Penalty: $5,000.
(2) It is a defence to a prosecution for an offence under subsection (1) that the owner took all reasonable steps to ensure that the employee, agent or person under contract, as the case may be, complied with this Act.
