PRIVATE SECURITY ACT - SECT 59

Protection from liability

59. Protection from liability

(1) In this section "official" means -

(a) the licensing authority;

(b) an inspector; or

(c) a person acting under the direction of an inspector.

(2) An official does not incur civil liability for an act or omission done honestly and without negligence under this Act.

(3) A liability that would, apart from this section, attach to an official attaches instead to the Territory.

(4) This section has effect subject to Part VIIA of the Police Administration Act to the extent it relates to the civil liability of an inspector who is a member of the Police Force.
