OMBUDSMAN ACT 2009 - SECT 108

Ombudsman may require further action

    (1)     If, on receipt of a report of the police complaints resolution process or investigation of a police complaint by a member of the Professional Standards Command, the Ombudsman considers the complaint has not been adequately dealt with, the Ombudsman may:

        (a)     refer the complaint to the Commissioner for further investigation; or

        (b)     make a decision under section 66 to deal with the complaint in another way.

    (2)     If the complaint is referred to the Commissioner under subsection (1)(a), the Commissioner must refer the complaint to the officer in charge of the Professional Standards Command for further investigation.

    (3)     This section applies despite section 97.
