MENTAL HEALTH AND RELATED SERVICES ACT 1998 - SECT 78C
Failure to comply with condition(1) This section applies if a practitioner who is involved in the assessment or treatment of the person believes on reasonable grounds that the person:
(a) has failed to attend the assessment mentioned in section 78(3)(b); or
(b) has failed to comply with a voluntary treatment plan.
(2) The practitioner must report the failure to the court in accordance with approved procedures.
(3) On receipt of a report given under subsection (2), the court may:
(a) issue a warrant for the arrest of the person; and
(b) if satisfied that the person has failed to comply with a condition of bail – deal with the person under the Sentencing Act 1995 .
