MENTAL HEALTH AND RELATED SERVICES ACT 1998 - SECT 117
Confidentiality(1) This section applies to each of the following persons who obtains information in the course of carrying out functions connected with the administration of this Act:
(a) the principal community visitor;
(b) a community visitor;
(c) a member of a community visitors panel;
(d) an employee of the Agency.
(1A) A person to whom this section applies commits an offence if the person:
(a) makes a record of, or uses, the information; or
(b) engages in conduct that results in the disclosure of the information to someone else.
Maximum penalty: 40 penalty units.
(2) However, subsection (1A) does not apply if the person makes the record, uses the information or engages in the conduct in accordance with a direction of the principal community visitor.
